It isn't surprising to hear someone from Canada with that opinion.  Canada isn't known for it's protection of free speech.

Canada also isn't known for having a fascistic govt that openly declares its intent to cheat in elections in order to cling to power.

I'd take a reasonably nerfed freedom of speech ala Canada's over whatever the fuck we have going on here.

Short sighted af, but whatever gives you the quickest bang for your buck, homie.

Canada is known for putting people in prison for expressing unpopular opinions, however.

Can you link us to an example of a criminalized unpopular opinion? -- Canada criminalizes hate speech, but a lawyer should know that the legal criteria for this is not "expressing unpopular opinions".

Canada has a different political theory underpinning freedom of expression, which gave rise to hate speech limitations,  but functionally there is not a significant difference in how the freedom of expression manifests for the average person.

And especially once we start to consider things like free speech zones being intentionally used to prevent or obstruct political protest in the USA, it quickly becomes clear that the argument isn't that Canada limits free speech while the USA doesn't, it's that the two countries limit free speech in different ways -- so it's particularly odd when people choose hate speech as the limitation to focus on.

I've seen videos of people going into police stations and calling black police officers the n-word. Didn't get arrested, barely asked to leave. Because it's protected speech.

Also, thats a cool wiki link to a "free speech zone", but in the USA, we literally had a protest storm our capital building. Shit, in the 60s the Weathermen bombed the capital building and fast forward to the Obama administration, one of the bombers is one of his personal advisors. Don't even try to pretend like Canada has anything like the USA in terms of free speech.

And I would argue that there is a time for hateful speech. I'm sure we all hate some things. Not being able to express a human emotion is literally stifling your God given rights. Freedom and rights are about being able to behave with what you are born with. If you sit on a tack, you bleed from your ass. By denying your ability to express hatred for something, you are destroying part of your humanity. Often times the first step in remediating a situation is hating something about that situation and then taking steps to amend it.

and as a side note, I'm assuming there are blanket hate speech laws in canada for all groups. wouldn't it be weird if the only group it was illegal to hate were the jews.

Canadian comedian fined $42,000 cause he made fun of a disabled person. It's literally his job to make fun of people. Someone wants to interpret that as hatred, boom, life changing fine.

How does one define hatred btw? Cause according to the ADL saying "Christ is King" is anti-semitic. Or criticizing globalists. You shoudl check out their website its' wild what they consider anti-semitic. Oh and they train the FBI on what anti-semetism is. we're lucky we have free speech in the USA. or most of us would be fined millions of dollars a year. Which is outrageous.

The ADL doesn't define Canadian law.

Your article about Mike Ward is from 2016 and out of date -- this was a significant case that was very controversial, and went all the way to the supreme court, and created a new binding precedent: https://www.scc-csc.ca/judgments-jugements/cb/2021/39041/

Quote:
The Supreme Court finds the Quebec Human Rights Tribunal did not have jurisdiction to proceed with the case of a comedian who mocked a well-known teen singer with a disability, because it was not discrimination under the Quebec Charter of human rights and freedoms.

The Court also explains the legal framework that applies to a discrimination claim involving a public figure’s right to dignity and a professional comedian’s freedom of expression. The Court said a reasonable person would not view the comedian’s comments as inciting others to detest or vilify the young person’s humanity.

The Criminal Code doesn't define antisemitism, but the federal government does provide a working definition which begins: “Antisemitism is a certain perception of Jews, which may be expressed as hatred toward Jews.”

This specific law was created in 2022, and I could only find four people charged so far, and only one conviction -- this person pled guilty, so it wasn't necessary for the crown to establish their speech as antisemitic.

I agree that having an undefined criminal term is problematic, but the available evidence doesn't suggest that this is being used to criminalize unpopular opinions, nor that it is being widely used at all. I imagine that, given time, a contested 319(2.1) prosecution is a likely path by which Canada will eventually develop a judicial definition of antisemitism.

Still waiting to see you provide an example of a person jailed in Canada for the crime of "expressing an unpopular opinion".

The Liberal government’s censorship legislation, when considered in the context of Trudeau’s sweeping abuse of governmental powers during and after the Covid pandemic and new subsidies for government propaganda, sets a new watermark in rising totalitarianism in Western societies.

In an unusually long statement in response to a series of questions asked by Public, the Trudeau government’s “Canadian Heritage” department, which regulates the media, tried to ease our concerns.  “Bill C-63 is meant to bolster the rights of Canadians to express their thoughts and opinions,” said the anonymous official, “by creating a safer and more inclusive online space.”

But the government spokesperson went on to confirm the shocking truth about the legislation, which is that it would put people in prison for life for things they’ve said, specifically, “advocating genocide.”

“Bill C-63 would increase the maximum penalty specifically for advocating genocide from 5 years to life imprisonment,” said an unnamed spokesperson for the Canadian government, “and from 2 years to 5 years, on indictment, for the willful promotion of hatred (section 319 of the Criminal Code)” [emphasis added]

In a historic legal decision, a North Bay man has been sentenced to nine months in jail after being found guilty of promoting hatred and denying the Holocaust through dozens of disturbing social media posts and videos promoting hate and violence against the Jewish community.

It marks the first-ever conviction in a Canadian court for Holocaust denial, according to Crown prosecutors.

The conviction was a result of a seven-month-long investigation into a hate crime by the North Bay Police Service’s Criminal Investigation Section.

Kenneth Paulin, 51, was sentenced to nine months in jail and two years of probation on September 18 for the wilful promotion of hate against Jewish people and the wilful promotion of antisemitism by condoning, denying, or downplaying the Holocaust, according to a release from the Friends of Simon Wiesenthal Center for Holocaust Studies (FSWC).

The case involving Gabriel Sohier-Chaput was heard Wednesday at the Quebec Court of Appeal in Montreal. Sohier-Chaput was not physically present.

Quebec court Judge Manlio Del Negro sentenced Sohier-Chaput in September 2023 to a year and three months in jail followed by three years' probation. The accused appealed both the guilty verdict and the sentence.

15 months in prison for being anti-semitic.

I'd post all of them, but searching Google I've found like 20 people who have been sentenced to over a year in prison for hate speech.  in Canada.

wow so he had to pay out the ass for legal fees, have his life overturned, probably lost friends and job opportunities cause of that situation, but since he was found guilty, then it was overturned by the Supreme Court, it's all fine.

You're missing the point.

No it's not -- I think you may have just misunderstood what I was asking for initially.

You: "Canada is known for putting people in prison for expressing unpopular opinions, however."

Me: "Can you link us to an example of a criminalized unpopular opinion?"

I wanted an example of a person jailed because their unpopular opinion has been criminalized -- you instead provided a section of the criminal code which you personally defined as an unpopular opinion, and I engaged in good faith, but now I've clarified my initial inquiry: can you provide an example of a person jailed in Canada for the crime of "expressing an unpopular opinion"?

I read convictions for hate speech, not unpopularity.

Sure, in the USA you have the freedom to incite hatred -- just make sure you only do it in the prescribed free speech zones when the police tell you, or else you'll get arrested for doing it in the wrong place.

Even the USA limits freedom of expression.

you should watch First Amendment Auditors on youtube. you can say basically whatever you want, where ever you want.

And no, those people are convicted under the hate speech law that specifically uses the phrasing "unpopular opinion".

That was done so people could get into and out of the world cup.

Someone's freedom of speech doesn't trump someone's freedom of movement, not without a permit anyway.

Freedom of expression is used in Canada, freedom of speech is used in the USA.

If anything, expression is the broader concept, so I'm not sure why it upset you so much.
