Things didn't work out for Pastor David and anyone who ordered from them might care to make sure they have nothing in the house for a while in case the DEA wants to check.

Pastor David sought for Extradition by the USA for Mushroom Distribution

Dear Marc Emery: I write this to you from prison in Switzerland. I’m in solitary detention here in a jail in Bern, unable to see my wife and children. I have been here since June 9th, 2006. My laptop, books and money have been confiscated. There is some kind of investigation of me in regards my Church of the Sacred Mushroom and our distribution of the wonderful mushrooms.

For years I tried to tell local Swiss officers of what I was doing: that I, Pastor David, was doing missionary work with the sacred mushrooms. I was ignored, now to be treated very harshly. They read my mail and perhaps are seizing correspondence sent to me. I am now in big trouble. My lawyer, jailers and the police have all said I may be extradited to stand trial in the United States for my mushroom work. I have been told that I have been indicted twice already by a US grand jury.

Swiss authorities have treated me like I’m the Taliban. I believe the Swiss are violating my citizenship by finding ways to have me extradited to the USA. If I make bail, I will inform you, but so far after four weeks I have no prospects for release. I’m being held without bail because officials see a “danger” of “collusion” as long as I can talk and write. I doubt my tongue and fingers will be cut off like worshippers of Teonanacatl experienced 500 years ago.

I asked for jurisdictional clearance from the police, they let me go on for years, and then when their ‘non-action’ was “understood” by me over these years, the police, without warning, raid me and put me in jail. I was naive, no doubt. But now I sit here waiting to find out if I will be sent to the US to spend my eternity in jail there.

My children of course do not understand, and my wife is heart broken. The religious community of Teonanicatl is now without support.

I remember this guy. I've always thought there was some thought of catch to his church, finding it odd that he is sending a Schedule I narcotic over the border for a nominal price. I still find the neglect of the police very odd, he's been doing this for several years now, and only now gets nabbed.

How were the charges different between the two arrests? If he was found innocent the first time, then it would be illegal for the US (I am not aware of Swiss laws) for him to be prosecuted the second by double jeopardy.

As a long time member of the Philosophy & Spirituality forums of The Shroomery, I would bid you welcome, and accept my sympathy if you are living in a state of incarceration.

It would be helpful to you to know that many members who frequent this forum and who use entheogens in the service of their personal seeking, do so in a manner which I personally see as a U.S. Constitutional right to "life, liberty and the pursuit of happiness." The lesser governing laws do not see it quite that way and so entheogen enthusiasts must live their lifestyle in a subculture and keep a low profile. The attempt to force the establishment to regard entheogens as sacraments of "true religion" was made by the late Dr. Timothy Leary in the 1960s, and it did not bode well for him, as it has not (apparently) for you.

The fact that entheogen users have plenty of latitude to buy spores and cultures and growing equipment attests to a great deal of freedom in the USA. Unless one is growing large quantities for profit, the government pretty much leaves the humble fungus farmer alone. Becoming inflated with one's own importance (not the importance of the Entheogenic Experience) and proclaming a religion, with adherents, will always be dealt with in this world swiftly and harshly. The world religions are more than established and since history continues to flow, their major structures can be added to by the Entheogenic Experienceas Gnostic or mystic embellishments of their depth and height.

Dr. Albert Hofmann, identifier of Psilocybin and inventor of LSD is a Christian by faith (probably Swiss Reform Church), and once wrote back to me stating that "the LSD inebriation represents the most comforting truth of the gospels." He was able to integrate a 'sacred substance' into his faith without the need to proclaim its sacramental nature (although many of us with Christian sentiments could see it that way) or lay claim to being a prophet who received the Knowledge (gnosis) for the preparation of LSD from 'on High' (pun intended). Dr. Hofmann has tripped less than 20 times, but the whole world knows about it from his book LSD: My Problem Child, yet he remains at age 100 a renowned scientist, respected the world over - not one treated as a criminal. It's all in the delivery friend, all in the delivery.

In my own life, I have ritualized the Mystic Mushroom as an 'Entheogenic Eucharist' - with a prayer, the passing of a goblet of wine following the ingestion of the Mystic Mushroom (in apple sauce, both for practical and symbolic reasons as the 'fruit of the Gnosis of Good and Evil). I could claim that I am a 'priest' of a 'cult' of four members, but I'm not so I won't. I have given thanks +++ In the Name of the Father +++ The Son +++ and the Holy Mother +++ which clearly identifies my theology as outside of mainstream Christianity, while drawing upon moral, ethical, contemplative, visionary, mystical and gnostic elements of Christianity, where each individual is a Priest or Priestess, a god and goddess - to be regarded as highly.

I do not think that you will find many proselytes in the Spirituality & Philosophy forum of The Shroomery, but as for me, an Entheogen Enthusiast for 35 years, I would be happy to dialogue with you here.

I hate the governments attitude towards mushrooms, they treat this stuff like crack,

So what if Pastor David distributed, if this is his crime he did nothing wrong IMO, this is not crime and vendication will take its course


look at OD reports and make ur conclusions, there hasn't been any mass shroom empidemic

That's not true. They leave alone those who they do not catch. If they catch a humble fungus farmer with a small crop he will be prosecuted to the fullest extent of the law.

Perhaps I was too general. Florida has the case of Fisk v. State of Florida and contends that merely being in possession of mushrooms, the average citizen who picks them will not be prosecuted. I learned years ago from Stephen Peele, who owns the Florida Mycology Research Center, that up to 13 'cells' or grain jars can be cultivated for scientific reasons, but the fruit must be made inedible with a reagent such as carbon tetrachloride. But that's Florida. We have so much marijuana and cocaine smuggling, not to mention the occasional meth lab, that mushrooms must be very very low on everyone's list. I've even spoken to FBI (former neighbor) and a DEA agent who gave a lecture to fellow substance abuse specialists. I don't think they care since no crime or violence or big money is attached.

Now, if you happen to live in 'Mayberry, NC' or a place that is considerably more sane than south Florida, I imagine that growing some grain to moldiness is the height of citizen perversity, and the local yokel constabulary might dig up laws that have never been enforced in their entire careers, just for the novelty if not for the hope of notariety.

:eek: 'Attention! Mr. and Mrs. America and all the ships at sea! FLASH! College student found with jars of moldy grain in ice chest - some with actual mushrooms growing from them! Local law enforcement has been contacted along with Special Agents of the FBI, DEA and ATF (who left because there was no alcohol, tobacco or firearms at the scene). The young man has been arrested and is being held in the local police station awaiting a hearing. The student's parents - a well known fundamentalist pastor and his wife are requesting the death penalty for their son - rather strict considering the 20 year sentence that is expected for allowing one's bread-making grain to become moldy. The student's name is being witheld on account of the extreme humiliation to his parents, both well known for their rousing church activities and popular yearly KKK picnic.' :eek:

Seriously, jail is the most unfunny thing I can think of short of terminal cancer. Personally, I'd rather bite through the veins of my wrists than go to prison. Word. But, just like during prohibition when every American was permitted to brew 5 gallons of wine at home (and who was gonna know if it wasn't 15 or 20 gallons), lots of people just weren't satisfied. They HAD to have beer and they just HAD to have hard liquor. Yesteryear's moonshine still was as big a deal as today's LSD lab, and whereas some people would rather have a lifetime supply of LSD, the difficulty of procuring raw material and likihood of being caught for its procurement, and actually making it plus the penalties for doing so seriously outway the risks of a small, occasionally grown jar of moldy grain that so many people put together these days. I see it as the same allowance for wine-making during prohibition, without stating so explicitly in law books. Homemade wine could not be sold - THAT was a violation of federal law. Mushrooms should not be sold either, if one wants to avoid a similar legal fate. One needs to be as humble as the mushroom is on the phylogenetic ladder - hardly noticeable, practically invisible. It is a social correlate of a spiritual life. It is the opposite of Ken Kesey's dayglo bus 'Furthur,' blaring music and sound effects to the establishment from costumed crazies inside.

But this is all just an opinion, and I've had coffee for the first time in many days (to rid a hangover from poor Shiraz last night), and so I'm wired and rambling. Don't get pissed, I'm on summer vacation, blah, blah, blah........
