I got away with thousands of dollars worth of merchandise before I finally got caught... I stole some DVD's one time and got caught. The guy said if I fess up and give the items back I wouldnt get in trouble... I was brought upstairs and in walks in cops!! The cop searches me and finds five dollars worth of pot on me:rolleyes: Luckily, because I had pot on me, all the shoplifting charges were dropped and I paid the minimum pot fine:smirk: Its funny because I ended up getting in less trouble because of the pot:thumbup:

Actually I believe in this situation he was assaulted by the mall cop. I don't believe they are allowed to do much of anything to you other than bark orders assertively. Especially if you are not on the property they are securing.

They can place you under citizens arrest, but that is something you can also do to them.

I'd love to see a security guard try to put me under citizens arrest, because then he's assaulting me, and I can put him under citizens arrest.

It IS assault if I feel the arrest is not legitimate. Security guards are not police officers. If a security guard tries to place me under citizens arrest for doing basically nothing (skateboarding for instance), and then attacks me under the pretense that he is citizens arresting me, I can kick the shit out of him and hold him under citizens arrest for assault.

Whether or not charges are filed against anyone all comes down to the discretion of the police, once they arrive on the scene.

So in a sense citizens arrests are meaningless and security guards can't put hands on you without affording you the same opportunity.

That's called excessive force, and it's not a form of assault.  And no, you can't kick the shit out of him, as that's not acting in self defense.

Citizen's arrests are legal by the way.

Damn dude that is quite the story. Am I the only person who thinks its fine to steal from stores and big businesses? It it 100% WRONG to steal something from someone who cannot afford to lose it, such as taking someones wallet or whatever. But taking a $10 item from a store, no one is hurt, no one is being cheated, except the store, and who really gives a fuck? The millionaire business owner is out .001% more profit, like he doesn't already have enough. I say good for you OP for getting away.
