Child porn in Ohio. Legal!?!? WTF

What a fucking snake in the grass lawyer. Protecting these fucks under free speech. Sick.

Alright opinion out of the way..... can anyone understand all this?

Nothing im involved in.

But someone i used to know is being charged for a bunch of kiddie porn charges. Guy has lots of money and got a real shifty expensive lawyer.

There is a trial set for the near future. Jury trial.

Now his lawyer is filing for a continuance of the jury trial and filing a "Motion to reconsider applicability of decision in State V. Tooley"

What does that later statement mean in regards to this present case?

The Tooley case is basically Tooley was charged with pandering minor then got the whole thing aquited under free speech, saying the kiddie porn images were "virtual forgeries" of real kids.

Tooley was convicted of child-pornography charges, but an appeals court reversed the conviction after concluding that the images were composites. In many cases, the creators of the images merged pictures of adults and children to create the appearance of children engaged in sexual acts, without actually depicting child nudity.

Sounds to me like the guy took legal adult porn and photoshopped it into legal non-nude pics of kids. It's kinda weird, but it's legal, and no kids were exploited or abused.

I don't see the problem. If anything, letting the guy get off to his faux kiddie porn is better than having him go after the real thing.

Pedophilia isn't something people choose any more than gay people choose to be gay, and from what I've read, many pedophiles hate that they're attracted to kids. Maybe this guy created these images so as to satisfy his sexual desires without actually hurting any children?

As long as no kids are involved, I give him the benefit of the doubt.

BTW, this issue has come up recently re anime kiddie porn. I think that's kinda weird too, but again, as long as no kids are involved and no one's hurt, who cares what weird people do?

From i have read into on the Tooley case the pictures were based on or used 'pieces' from actual children.

As, even though the the DA in that case positively IDed kids in his porn collection AS know kids in the victims database, they still consider that 'faux'

So where is the line drawn? They go on to say that any digital image can be forged to look like anyone. Thus, protected as art under free speech.

they are saying child porn of kids known to be in the victims database is not really what it seems? that seems awful open ended.


As for my statement: I would love to see this guy get busted. YES i would. I know detail i wont give out until the case is over with. But its some twisted shit. So (not pointing fingers, just saying) lets leave opinion out of this and discuss the ramifications of the Tooley ruling in present day child porn trials.

Prosecuting people under the pretext of their actions being wrong or immoral is the precise reason you have to worry about being arrested when you decide to smoke a bowl. Don't fall into that unfortunate mindset.

It's disturbing that he's attracted to such things, but if the pictures do not contain the actual nude bodies of actual children then it is not illegal and there is no good reason for it to be. Insisting on illegality of it might be a convenient way to force deviants who society isn't comfortable with into a prison cell to be forgotten about, but it's also wrong. If the images are artificial constructs with the nude bodies of adults with non-nude images of children merged into them, there is no child nudity and no real child exploitation.

This sounds similar to a controversy over a form of hentai porn known as "lolicon", which consisted essentially of cartoon child porn. It was made illegal, despite there being no good reason for doing so as it does not victimize children in any way whatsoever... and despite the fact that it is art and as thus it is supposed to be protected by first amendment privileges.

What would be the danger of me talking about what i know about this case?

Im livid because this asshole i know is trying to get out this with the tooley case as precident.

this guy(not tooley)was/is involved in obviously legit(very real) kiddie porn and illicit deviant acts based on what i know and have seen.

what im saying is the tooley case(even if legit faux porn in that case) is being used to get REAL child pornographers off the hook

If that case's precedent is being abused to defend instances of real child porn, then yes that's definitely wrong and hopefully both judge and jury will see through the ruse.
