Under his instruction, I taped drumsticks to his head and turned him into a sort of mummy, or perhaps a caterpiller in a cocoon. He remains this way for about three hours, making bizarre noises, pretending to be a new species that must learn to walk and talk and eat, etc. And he communicates with other life forms by way of the antennae on his head. Eventually we jam a tube from a waterbong into it's mouth and figure he's learned all he needs to know.

Well, Mushrooms charges are about like heroin charges. Pretty much. A jury might not see it as so, but a judge and the DA will. I have a friend you got locked on a cultivation of mushrooms charge and I believe that charge was worse than the 500 or 5000 rolls he had. Also, yea, if you are growing people assume you are doing it at your house. IF you say... "Hey man, I am growing mushrooms now man, they'll be fruiting soon" then they think you have them in your closet. Which, very well be true. Even if they dont think your doing it at your place they will tell someone who will, and in turn they will set up a little thug team to break into your house at 5am to rob you, forcing you to shoot them repeatedly, and then in turn causing the cops to find all of your shit.

Im pretty damn sure hes talking about someone whos been a friend for 15 years, not a 15 year old kid who busted him..I could be wrong..and Magash is right, you would be better of in court if it was a 15 year old kid that your talking about...of course pretty stupid to tell him if so. No one was 15years old,it was a person I knew 15 years(he).

Right now I,m out on a 25,000.00 bond, about 6 months before I go to trail. will take that long TX DPS to check out the shrooms I had.

At the time I,m drinking a lot.Got to get that undercontol.

I,m on a computer know one knows I,m useing, must portect everone.

Best thing for me is to keep holding my 6 month grandbaby.That helps alot.

Will keep ya,ll updated ,The cops did get my computer and all passwords. Just want you all to know.

your luckey if they don't take your car and house. This one guy who got busted sent his wife out and traded in his new truck he had just paid off, and got a different one with a loan and cash back so there was no equity in the truck to take. he lost everything else but it wasn't worth messing with the truck he didn't own.

Why wouldnt they? Information can be had from there..people often keep business lists or pictures or contact info or SOMETHING, at least hidden in the back files. Besides that, they usually sieze most of your assets if not all.

GL man, my prayers will inlcude you. The human condition is something all of us have to deal with everyday of our lives, but this is just cruel. Keep hope up, get your attourney cracking, and who knows maybe he'll find a loophole in procedure and seizure or something. There's usually some part of the process cops fuck up and if you can prove it, it can sometimes be enough to get the case thrown out (especially if it had to do with the evidence against you IE illegal search and seizure). Im seriously hoping these cops had a warrant when they busted you, if they didnt, jump on that train and ride it to freedomville. GL man

I get so pissed off everytime I hear about someone getting busted! This is insane, your gonna probly do some jail time, and deffinetly gonna have to pay a ton of money, and for what? For growing mushrooms, something that grows naturally on this earth, it was put on this planet for a reason. And just becuase you were growing these mushrooms (which are basically harmless) your gonna go through a whole bunch of bull shit! America is FUCKED UP! I can't actually belive I'm gonna be celebrating my independence on the 4th even though I can't legally eat some fungus that grows naturally on the earth and smoke some plants that grow naturally on this earth! Shits so fucked up. I gaurantee I will end up moving to amsterdamn some time in my life, they see it the same way I see it, the way it should be. And everything is fine over there! I can't belive that mushrooms and the marijuana plant are illegal and the want these things to not exist on the face of this earth! Mother Nature put those things here for a reason, for humans to enjoy them and for us to enjoy life, not for people to get busted for them and to fuck up their live's! Hey all. Goodluck with all your trials and tribulations. I have to agree with a previous poster. These things are natural. What's not natural is making a pill and handing it out like candy that keeps 87 year old men erect all day long....I sympathize. That being said, what are the chances of shroomery ever getting shutdown. I'm not worried about getting busted because I barely grow enough to feed my dog, but I love the comraderie and culture here as well as the information posted. I am still also interested in the basic details of what happened...did they just come knocking on your door with a warrent...what sort of evidence was there, or was it a setup? I dont think one persons word is enough to get a warrent alone...whenever you get time, it would be a learning experience for us.

If it makes you feel any better I got set up with 25 pounds of ganja, and yes my friend my balls fell to the Flore lol. Now I am serving 4 years probation and have to pay $3,500. But I payed a really good layer I think I payed around $4,000 he got me out and got me probation. In Texas we have a no tolerance LAW so to get out on probation is well.....WOW lol it's now 2 1/2 years later and it's like a bad dream I had only every time I go to probation I remember.

I took the blame my for my best friend of 10 years now and I would do it again, BUT he did pay my layer lol. cya round my friend, IF you go to jail look at it as an experience not a sentence. LIKE....a Vacation some thing new.

I would try and play the Religious Freedom card. Obviously this is a big part of your life if you are growing and tripping into your old age! As long as you weren't caught selling, you might be able to get a higher court to overturn any convictions based on a violation of your First Amendment rights.

I can't believe people will get locked up and fined huge amounts of money for trying to be a farmer (assuming you have no charges of selling).  I just don't find freedom in not being able to grow and eat the plants and fungus you wish.  Punishment of victimless crimes really gets me down.  :shake:

A little over a month has passed, blood pressure is down as are my nerves. The whole thing will realy shake up the system. Have a great lawyer(time will tell forsure)and now its time to wait and see what the lawyer can do.Hoping for probation and fines.

All I can tell anyone going thru a bust is keep your cool. After your out you will have time for your world to come back into focus.Does't seem like it at first but it will happen.

Lawyer called today. DA wants to give me 10 years in the pen.

So its going to be a jury trail.

In a few weeks (3 to 4) DA will have to give up all the evidence he will use against me.

  All participants played their own free will no one is innocent or guilty. Just responsible for their own actions.

  This is the cops story so he could get a warrant.Couldn't scan it so I typed it.( Affiant = Investigator Garcia) Left out Some stuff like when he tells what a great cop he is.

"Withen 24 hours of the date of this affidavit, Affiant received information from a confidential informant(hereinafter reffed to as "CI"). CI informed me that Ci was inside the suspect house within the past 24 hours and that CI personally observed the Suspected Party in possession of a quantity of Psilocybin Mushrooms, therein.CI's name is being withheld for security reasons. Although my confidence in CI is sufficient to justify seeking an arrest or search warrant with the infomation first provided,Affiant decided to attempt to obtain an update on the information by sending CI ti the suspected place to make a "controlled buy" of psilocybin Mushrooms.Affiant thoroughly searched CI prior to CI going to suspected place to ensure that CI was not in possession of contraband.Affiant gave CI quantity of money observed CI exit my vehicle and go directly into the suspected place. CI returned to my vehicle a short time later handed me a quantity of Psilocybin Mushrooms. CI made no stops either going to or coming from the suspected place.Based on my search of CI before the buy and CI going directly from my car to suspected place and back,Affiant knows that the only place CI could have obtained the Psilocybin Mushrooms was from inside the suspected place.Affiant therefore has reason to believe and does believe that the suspected party is in possion of the said contraband inside the suspected place.
Suspected party has a criminal history record and upon reviewing same Affiant learned of two previous arrest for drug law offenses."

  Now if one were to believe this story the CI would be Quinton Herman. The only person I had a shroom deal with that day. Someone I've known 15 years. But I was standing downstairs waiting for Q to come over. He walked out of his front door got on his three wheeled cycle and peddled on over across the street. On another note I had not given anyone shrooms for a period of two weeks before the 12th.Another hole in the CI's story.However that time was also Q.And as for the Affiant learned of two previous drug law offenses. I was busted for a joint when I was 17 years old and I guess by some far reach of the imagination, one could consider a DWI a drug law offense.

  June 20th 4pm

I pull up to my house to get some paint for the job I was on that I left there. Before I could get to my door, Garcia pulled up behind my truck and calls out my name. I walked over to see what the man wanted.He produced a warrant and a badge and told me I was under arrest. In shock I ask "for what"? He said "for selling mushrooms".Then I ask "do you want to hand cuff me in front or back". He said "in front will do". He then ask "where are the mushrooms? At first I told him I didn't have any shrooms just a little pot in the house. A look of disappointment came over his face.As Iwas setting thereI started to think to myself only have to open the top dresser draw and there they are.So I told him I did have shrooms in the house and I show him ever thing.He had a warrant and was coming in.

The supervisor arrives. I unlock the door.This is better than getting it kicked in and me having to pay for it. I show them the 18 planets in the closet.They thought they look good. They were right. Then it was into my bedroom and showed them pot in my nightstand and the shrooms in the dresser.Now we go back outside and wait for the rest of the investigators so they can go thur my house.I didn't even think about my lab(nothing was growing in it) or my incubator(5 lb bag of mcy. in it.Ready to go.).
I'm set down with a female investigator while they do there thing.I'm in shock.More than I realize.
After a bit Garcia comes out and says" Your quite the cultivator". I reply "I've cooperated with you". The supervisor behind him says "Thats right".(like thats going to make feel better)I then told Garcia "I think I need a lawyer from this point on".He gets an unhappy look on his face.They go back in.Now I'm setting with this female investigator, we have been "chating".Then she starts asking me questions. I told her I wouldn't talk about the bust.She says "its just for my on info". Think to myself "yea sure so you can set in a court room and repeat everything I say". After this she ask one of the investigators "when am I going to get to see the room"? Again I think to myself" They must think I'm one evil scientist".
The deputy sheriffs finally show up and its off to jail I go. 24 hours later I go before the JP, I've been dealing with this man in business for the past 12 years. He also helped me keep my daughter out of trouble when she was 14 and married her. He cuts my bail from $50,000 to $25,000. At this point I feel lower than low. Within a few hours I've bonded out and heading for home.
From my house they have taken 18 pot planets, 1 1/2 oz pot, 12 spore prints,25 spore syringes I made, 10 I bought and Me.
Pot was not on the warrant so I could not be charged with it.(LUCK, I needed some right now)

Getting Home
  Walking into my home.What a mess. My daughter told me the pot leaves from my first grow where put all the house. Have no idea why they did that. She cleaned that up. Still I could how lucky I had gotton. Five lb's of mcy. setting on the stove. If only they knew.They had removed it from the refrigerator I made into a incubator. My computer, martha and most everything I had built was still there.I thought great all I have to do is put it away till all the shit was over.
Wrong!
The next day they come again.They had time to figure out what they had missed. Thank God I had gotten rid of the myc. Once again I'm setting outside in cuffs while they do there thing again.This time just about everything goes.They did leave my refrigerator/incubator. To heavy. In my carport they started to haul off my newly made flow hood(2x4)I told them it was a dust filter. They left it.They really didn't like having to haul stuff off. After all they are investigators not movers.

A little note(don't laugh)In the kitchen I had four qt. jars of rye grain that grew nothing but the mean green.I found out later One of the investigators smelled them. He was sick for two weeks.I couldn't believe he did that.

Garcia comes up to me when they were done. I found more pot in you home.I told him they must of missed the first time around.(1/2 joint that was under the computer) I really drained by this time.

  A few days later I'm on front page of the local newspaper.(bummer)
Made me sound like a big time dealer instead of someone growing to help out pain. I think at this point if I had a few shrooms I would of eaten them. Sleeping on a jail floor was no fun.
Two months pass, my business is in the toilet.(this is from living in a small town. Most everyone has heard by now) and I get indicted. The norm for being indicted here is 6 to 9 months. My lawyer say's I've been indicted so fast because the DA wants to make an example out of me.

On the informant(s)
Quinton Herman is someone I've known since he was 8 years old.He grew up with my daughter.Until now I would of put my life on the line. He was like family.(heartbreak) In the last year we've traded shrooms for hydro.After our last trade on the 12th he would only look at the ground, not me.(Bad body language)He knew something before the bust, Garcia had been at his house twice before My bust.
However after talking to his stepfather I now do not believe he was Garcia's informant.It was a so called friend of his, Allen Moore. Allen has been busted, way before me and is now doing a year in county jail. He will be out in 6 months without any probation.
In a small town word gets around. Like a city cop introduce him to Garcia.

As for Quinton he never holds more than personal stash or what he is going to do. He will go pick up drugs for people but get rid of them fast. While making a buck or two. Cops have started pulling him over lately asking him how he can afford his sweet BMW on a $7.00 an hour job. Looks like hanging with Allen has gotten him hot too.
All this is my personal opinion.

October 12
  The day before pretrail the DA calls my lawyer.Asking for the 4th time if I going to take the ten years TDC they are offering me.My lawyer replies "I think we will let 12 people of Aransas County decide".Later that day the DA calls back  and offers 10 years probation, a $2500 fine and $140 to DPS for analyzing the shrooms.At this point this sounds good to me. I have the night to think it over.Probation sounds good because you never know what 12 people will decide. Maybe more, maybe less or maybe not guilty but all maybe's.

October 13, Pretrail
  The indictment reads:
  "... was indicted for possession of psilocibin, with intent to deliver, manufacture psilocibin, a first degree felony. the indictment alleges on or about June 12,2005, he did "intentionally or knowing possess with intent to deliver a controlled substance listed in penalty group 2, to wit:psilocibin, in an amount of four grams or more, but less than 400 grams aggregate weight, including adulterants and dilutants."

Sitting in the court room at 9am. Waiting( so here is so more info. When I got arrested I knew I had 79 grams. When they got to the police station there was only 69 grams. When they got to the DPS lab there was only 5.1 grams. Them dryed shrooms are drying up fast.)
So now my lawyer and the DA are talking and guess what the DA has been thinking of me during the night.Now I'm only going to get 5 years probation and fines.That means if I don't mess up on probation I can be off in 2 years.If I do mess up 10 years TDC. Plus they took the part out about me delivering. However that will not be in the newspaper. So everyone that read the newspaper will still think I was selling.Also will get back my computer, that computer will never be online again. I now have 30 days for the judge to set guide lines for my probation.

Now the DA starts talking about taking my home and what I have to do to stop it. There are no leins on it and the lawyer said I can sell it.Its been sold. My lawyer called to talk to the investigator they wanted me to  work with. He can't see us for a week. Lawyer told him to call us when he's ready. That puts the ball back in his court. They only have a 30 day period to use me. Once I start probation I'm under the judge's protection and judge's don't like this. Will let you know later.

Don't worry I'm not a scallywag.

On another note my back is sore from some back stabing(some people thought I was going away) but only one has gone as deep as the heart.

I was set up and knoxed down like a bowling pin.(sounds like a good song)

i had a friend go down recently in TX for 98 chocolate mushrooms. some one ratted to the cops that he had some, and were they ever surprised to find 98 or them. well the most important lesson here, is this part about "adulterants and dilutants." they took the wieght of all of the chocolates, about 450 grams, though there was only about 150 gms of mushroom. thats how it works. i think if they caught you while growing, they could weigh your casings, cakes, jars, ect, and charge you with that weight.
something to think about when dealing with your mushrooms.
my friend got 10 years of probation, $10,000 fine, mandatory NA meetings, and other bullshit recovery programs. thats serious boys and girls. be careful, most people in the world are blind.

You know what guys this brings up a very large subject. This is total bullshit what society is doing to people. Here we are good people. If you get caught growing shrooms in any amount they will through you in jail for a long time. You will probably go to jail longer than somebody that murdered someone. It sickens me. I wonder if you could agree to become an informant... make sure you read the "contract" first, and then if the conditions allow it, you could agree, and then develop "memory problems", you know, when you "do too much drugs" it can have severe consequences on your "ability to remember things".

Of course if that can be interpreted as being uncooperative, and have negative consequences for you, dont do that...

No but I have told the probation dept. I bought my spores off the net. They didn't know spores were legal. I will have to do some kind of drug rehab. I do have ins . Checking out what they will cover. most likey will get off easy on this to. Worse case drug rehab(in Texas)year in local jail waiting to go to a boot camp type drug rehab.

your lawyer is wrong, there's a paper trail to follow for court, you are
mirandized and are asked to sign a rights waiver/statement noting that

I was Framed for framing someone by a girl who claimed loved me like I was romeo and she was juliet. Their evidence was all hearsay and my court appointed attorney was a DA for another county some years back. Some defense lawyer huh? Anyway...moral...if they're on the side of the court (and sometimes even not in my case)...they'll bend you over, slam you in the ass, and get away with it because this is the Divided States of Embarassment.

I've had a few 40's and got a little carried away right there but fuck it. FUCK COPS. EAT SHROOMS AND BE SAFE!!!

Miranda rights are only necessary if they are going to use what you said in court.
I didn't say anything but "I wish to speak to my attourney before answering any questions sir", so they didn't bother reading Miranda rights.
I have a similiar bust story (with a few more big charges) that is still  a little to early to tell.

ive been busted twice now. the first time i was pretty much red handed with an ounce of fungus and an 8th of pure beautiful MDMA shards. it cost me $12,000 to the best lawyer in town.
the second time the sacks o boomers were under the passenger seat that i was sitting in when we got pulled over. the driver rolled over to the cop and told him that they were mine. he drove away with a quarter of coke in his pocket while i went to jail.
upon release i did as ordered and called my probation officer. i told her, "fuck off, i cant afford a lawyer right now. ill call the courts when i can".
im facing some pretty nasty felonies. Possesion of a controlled substance schedule 1, a class A felony. manufacture of a controlled substance schedule 1, class A felony.
i figure 24,000 on up to 36,000 should buy my fredom. hence, i been makin lotsa grain jars.

Lawyer fees are astronomical, $150/hr seems standard for a criminal defense attourney.  I found out who Narc'ed on me pretty quickly, and proceeded to hand out flyers at a local Ratdog show stating: Matt Falco is a narc, do not work with him, this is no joke.  It got the point across to most of the people he could have tried to narc out, as I was not the first.  The few friends he had turned on him once he openly admitted to narcing to save his own ass from charges that paled in comparison to what I'm now facing.  How could one live with oneself with that on their conscience?  If Karma really exists, narcs (civillian informants) will face a fate much worse than death; I can only hope.
Good luck with your case KaptKid, and thank you for being a real human being and dealing with the charges instead of passing on the consequences with interest to a friend, like some weak-minded individuals do, as we know all to well.

P.S.  When it is sensible to do so, I will post a thread similiar to yours describing the details of what happened to me, as we can all learn from other's experience.  I truly hope your case is dismissed with all charges dropped.

I had to scrap my plans to grow, my girlfriend showed her true face today, she would narc me out for very little reason at all, even if she was on the rag and just felt like it.

She playfully told my parents and there friends that I was going to grow shrooms when we were over there, as a joke...
It's like having a friend that whispers loud enough that everyone hears him anyways, but he is fucking clueless to the fact.

She has no concept of what she does, it's all a game, and when she fucks something up seriously, she just says sorry{like it is some sort of learning experience for her, on someone else's account}

We had a long talk, I found out why she was acting so weird, she was scared, and scared people are very dangerous.

I find most people I meet are uneducated about the law, and are very afraid of the police, and would tell them anything even if they are not sure if they are even in trouble or not, which usually gets them in trouble, and others too.

This boyscout/girlscout need to confess all is not rewarded by the law, and will be held against you in the court of law.
But no one seems to understand that around me...

I guess I'm a victim of my surroundings.
So no shrooms for me.

I'm seriously thinking about moving somewhere without obnoxious drug laws, I am resenting living in the states more and more every year.

Been a few months since ya last posted, hope it's all goin well. I read about cases like this every single day and every time I do it bugs me. There will come a time, sooner or later, when americans will be called upon to use their 2nd Amendment rights to protect the others. Again I would like to thank everyone for there support.It has been a great help in a ruff time.

To recap, I got 10 years prison, probated to 5 years + a $2500.00 fine and lost the privilege to drive for 6 months.

Now 3 months into probation. Got to have surgery to my left hip. Going to play that for all its worth. The investigators have stop driving by my home all the time but from time to time they do keep tabs on me.Guess they think "Mr. Big" will be seen here. LOL

I just plan to do my time as easy as possible.

i hope its probation, even though PO's can be aholes but its better than spending your time in a cell with a guy named bubba..

thumbs up to keeping a positive attitude... you have no idea how many people see the negative out of the smallest things and get depressed and down for 'simple' mundane things like losing a job.

just an idea...

but consider moving to another place in the world than fucked up amerika. until THE revolution begins, this place will only get worse. You could go to the Netherlands, were you can resume your 'hobby' with peace and like minded people :smile:
