i must say after reading this thread;
there are three things you are required to tell police (at least here in europe) your name, your address and what you do for a living if you do anything. People who start talking have a tendency to talk their way all the way to jail when their mouth first opens. the police is those who tries to put you behind bars and find eveidence _AGAINST_ you in a court of law, its your lawyer thats on your side talk to him instead. Its like going to war and helping the enemy defeat yourself. talking to the police-.

How about asking the police chief for one? If he's so personally sorry, sounds like he's personally responsible....if his personal apology was in written form, it might be relevant to a civil claim. Sue them for 250,000 they will offer $25,000 just to shut you up, your attorney gets half. You just got paid $12,500 for a few shitake cultures!

Along with...

A freedom of information act request for a copy of the police report relevant to this incident, copies of any and all stored data (printed or electronic) leading to the incident, including but not limited to a copy of the subpoena for the search of your home. This was all bogus; your local law enforcement needs to be taught a lesson. If they refuse to give you ANY of the above, write a written complaint to the FTC (based on the freedom of information act, this information must be provided in a timely manner)

They will black out whose name they got the information from, but if there was only one person, and they took his or her word for probable cause to invade your privacy, they need to be sued. Of course this is not legal advice, IANAL.

Quite frankly I have been involved in quite a bit of illegial activity in the past. Some of it is impossible to prove and some of it isn't. As much as I like the idea of vengence I'm inclined to not rock the boat.

Let me start with IANAL (I Am Not A Lawyer)

It is up to you to sue or not to sue. Some things you should know.
#1 There is a limit, In Years, to bring a suit against them. You have time to think about it. ( I would find out what it is)
#2 There is a statute of limitations on crimes. (For example) if you were involved in crimes, they can not prosecute you for those crimes after 5 years. (murder being the exception)
#3 consider any advice given here to be BULL S**T!

Talk to A LAWYER!

#2 Contact a Lawyer ASAP!
#3 Do what your lawyer tells you!

I know this issue has already been resolved, but I just wanted to note for future readers that they most likely won't be monitoring your computer. For one, most small police offices don't have the resources to monitor your computer. It takes quite to do that. And They would most likely also need to get your ISP to agree to the monitoring. Second, I believe it would fall under some sort of "violation of privacy", especially if they didn't have a warrant for to monitor the connection.

I'm going out the the forest tomorrow. I remember seeing some oyster mushrooms, pleurotus ostreatus, last time i was out there. I dont know how to preserve them for you, but I'll try to get some spores from them. (I have some sterile agar petri dishes, but know nothing about using them with a wild specimen).

i would look at the grounds for the warrant, just someone's 'hearsay' is NOT ENOUGH to get a warrant, btw hearsay = is someone saying they heard your growing.....

too legally get one they would of had to do a trash pull and find pyscedelics shrooms or stems or something contains the active chemical in shrooms (i cant spell it worth a damn)
basically they have to have tangible evidence

WHen i was in highschool i gave my friend a pot seedling, it was maybe 4 inches high. The next day i take them up town and opon returning to there house SLED was waiting at the door WITHOUT a warrant sitting on the guys porch. After threatning him with jailtime and other crimes a SLED member went threw the back door and came out with a bag of pot seeds and the lil seedling. The guy got probation for 2 years and did 3 days in jail.

Fungushead is right. There is a lot of information that is available to you for the asking. Write your letter to the police or the DA. There may be form letters attorneys use you can find on the net. Send it certified mail and keep a copy. When they fail to produce the requested info, then sue for failure to provide that info. Prisoners do it all the time.
Suing for serving the warrant is not likely to do much for you. They are NOT going to give you a big settlement. Wrong as it may be.

It would really help this community if you did find out just what led to the cops showing up and posting it here.
