Cops showed up today....

The cops showed up at my house today with a search warrant. They said that they had information that said I was growing magic mushrooms. I haven't grown them in almost a year, but the cops confiscated my humidifyer which I is covered in spores. I had an active shitake mushroom grow which was also confiscated. Anyone know if it is possible that I will be prosecuted for growing magic mushrooms? If they do try to prosecute me does anyone know of a good defense?

EDIT: Nothing illegial was found at my residence.

If you honestly had nothing going on at the time the search was warranted for and they confiscated your stuff... I would countersue for every possible cent which could be accounted for in the time your humidifier, chamber, etc was missing!
I'm guessing by the cicumstances you probably live in a small town, maybe you don't want to draw this attention to yourself but, personally, I would make sure if someone broke my rights and found no reason to be doing so, I would make sure they payed consequences for it, maybe you got lucky in the timing and will think twice about what you are doing but I would definitely make known that someone fucked up and your liberties were at stake.

I'd be careful from now on who knows about anything you do.Someone who knew you either now or at one point knew you used to grow and they tipped the cops off to try to get you caught.If they try to prosecute you for anything call all the local new stations...bad publicity for the police is the best defense.It makes them look horrible to the public and every media personality will be jumping at the cops demanding information lmao

Since you have no magic mushrooms and nothing illegal even if they find magic mushroom spores on your humidifier it isnt illegal and DO NOT admit anything about growing magic mushrooms.It's a liability posting here as it is because they may monitor your comp or could have been monitoring it.I suggest you start thinking or finding out a good reason to have magic mushroom spores like mycological study of some sort.However airborn spores are a solid sign of magic mushroom growing since in syringes they are in liquid and they only become VIA fruiting bodies.So make up an excuse why there would be spores on your humidifier.Say you spilt the syringe on it or something.They may be able to tell the difference but Im not sure.A bad excuse is better than no excuse though and whatever you do stick to your story and ADMIT NOTHING.

Don't even have a story, don't tell them anything, remember they have to prove you had, or were doing something. If they go to press charges get a lawyer, and still tell them nothing. No reason to tell them anything ever.

Magic mushroom spores are proof that magic mushrooms or at least the spores were there.Not telling them a reason why you had spores is far more incriminating than reason why you had spores.For example "I have a strong interest in mycology and I bought perfectly legal P. Cubensis spores (or whatever type but use the scientific name) and I was comparing the spore structure from a hallucinogenic mushroom compared to a edible mushroom like shitake(although using the scientific name makes it look more credible)." Or whatever excuse.

Instead of:

Policeman: We tested your humidifier and we found P. Cubensis spores on your humidifier.Why are there P. Cubensis spores on your humidifier?Were you growing P. cubensis mushrooms?

You: I'm not saying anything until I talk to my lawyer.
or
You: I don't have to say anything.

In alot of cases not saying anything is far more incriminating and can make you look very bad.

No, any reasons and excuses should be told to the defence lawyer, not the police. Never tell the police anything once they have targetted you.

You have no fruiting bodies....you have nothing containing any proscribed chemical.
The search warrant could be construed as harrassment over the growth of legal mushrooms that the "informant", whomever it is, believed were illegal.

Sue them, get your stuff back, keep your head low.
Don't admit anything. It may be viewed as suspicious, but unless you have a microscope and a decent amount of spore plates around, the "for comparision" bit will never fly.

I agree with the no story needed. The only thing you ever have to say to a cop is "I'd like to exercise my right to remain silent". Since you didn't get caught with anything, I'd start trying to figure out how they got the warrent.
I also think trying to countersue is a stupid idea. The cops didn't just pick a random house and kick down the door. They obviously had an investigation going on you, and gathered enough evidence to obtain a warrent. They were doing their job, not breaking any laws. It's not like he was an innocent housewife getting raided for having a high electric bill, they were there for a reason.

The only evidence needed for a warrant is a complaint from another person.Especially when it involves illegal drugs.

Hypnotoad - your remarks are logical, but misguided - and wrong from a legal perspective. Asserting one's right against self-incrimination (5th ammendment right of silence) can never be used in court as evidence of guilt.

You are ALWAYS ALWAYS ALWAYS ALWAYS better off letting your lawyer do ALL of the talking.

I have never done anything illegial at tha address where the cops showed up. I have been out of anything even slightly drug related for about a year.

My main concern is that I live in one of those states where spores are not so legal. Kinda funny that once I stop breaking the law they finally come after me.

I just got off the phone with the police officer heading up the investigation. He said that the warrant was obtained because of syringes in the trash. He also said that my cultures had been sent to the crime lab to be analyzed and that if everything came back negative I would get most of my stuff back in a few weeks.

Amen. It dosn't matter how incriminating something looks. It dosn't matter what the cops think, or even know.....the only thing that matters is what they can PROVE beyond a reasonable doubt in a court of law.

IMO, in a situation such as this the only thing that matters is the fucking headache and expense. even if you play your cards half right your gonna walk away from this. so will your lawyer, with a good portion of your hard-earned money in his pocket.
