Anytime you're in public you give up certain rights.

If your walking the streets at night (especially in a residential area)....
any cop has the right to ask you, where you're going and what you're doing.

Again, I have had this happen to me.

Me and three friends were going to another friends house a few blocks over. I had a quarter ounce of weed in my pocket. My friends had drugs on them also. I think one was drinking a beer.

The cops pulled over in a squad car, and asked us the standard questions....
Who are ya, what're ya doing and where ya going?
They asked us if we had any weapons on us, we said no, they patted us down, and let us go.

No drugs were taken, nothing bad happened.

I found out the next day that there had been some thefts recently, and the cops were just patrolling the area, keeping an eye on the 'hood.

The cops were actually out doing their jobs. :whoa:

What reason was there for me to get pissed?

I had a cop pull me over one day on my way to work. My truck matched the description of another truck that stole some gas. I told him that it wasn't me, that I would have a full tank if I took the gas.

He apologized and sent me on my way.

I can name several different times that a cop has stopped me  to ask a question and nothing ever happened.

Asking questions.....

is NOT harassment.

Asking questions.....

If there is probable cause that a crime had been committed he has the right to detain you.

However simply walking down the street, no matter what time of day, is not probable cause.

If your walking the streets at night (especially in a residential area)....
any cop has the right to ask you, where you're going and what you're doing.


A cop certainly has the right but I should also be legally allowed to not answer a single question and keep walking without be hassled.

I had the same thing happen, the cop said that a car fitting the discription of
mine as the get away car in a convienience store robbery about 10 minutes
before, interesting since the cop followed me for 10 minutes from a party and
sat waiting for a drunk to leave for more than 45 minutes, my police scanner
didnt indicate anything more than a few 'roadchecks' in the county

the reason I know he was bullshitting, my car was covered in grafitti

you are allowed to do just that, there may be consequences for those actions, arrest being the least serious, death being the more extreem, some states have a 'fleeing felon' law, it equates to if you run, they can shoot you.

give a cop proper ID and make sure you request his prior to presenting yours,
you just never know if he's a real cop with all the impersonators out there

no, but once you live in a place where the police (thankfully) don't arrest and/or shoot people without any reason (for the most part), then we have to start looking at the other bad things they do, albeit to a lesser extent. as an analogy - now we've gotten rid of sex-based segregation (to some extent) in the workplace. however, would you say to women "well now you can get the same jobs as men, so stop your bitching just because you get paid less!" i wouldn't - i'd say "well you've partially won one fight, time to move on to the next."

I'd like to know where that place is, I remember in 1984 there was a 14yr old
black kid walking to his grand mothers house to cut down a tree that had fallen
against the house, the police shot him without warning, I was detained at gun
point for auto theft by a cop from that same jurisdiction a couple of years
earlier, I was stopped while I was walking.

hence the 'for the most part' - the 1st world (in general) has a lot less violent/corrupt police than, say, the 3rd world.

it's simply more visible in the 3rd world and many industrialized nations as well,
the corruption here is simply less obvious, an 18yr old athlete dies in police
custody, 5 officers are implicated and aer suspended with pay pending an
investigation. it is pretty uncommon for the officers to be charged and convicted.


they announce it in the media and it means nothing to people, they pay cops to take a short break from being a state sponsored criminal
