You can be called illegal and not be guilty of a crime.  Being undocumented is not a crime.  It is a civil matter.  You are trying to change the conversation and then using that to say they all committed a crime.  You know what you are doing and you should be ashamed.  But I know you are probably doing it on purpose and shame would not get in the way of that.  That makes it just another lie being perpetrated based on agenda.

Hence the term ‘illegal alien’.

You can assume but it means nothing and can be done in an unjust manner.  I could point at you and say you are a dumb fuck but it wouldn't carry much weight in law, though you could do enough for others to assume it is true by what you do.

no one said it is. i said its a reasonable chance they came in through the border and not a port of entry, so you can ascertain how they got in. if they don't comply, that is a misdemeanor

no one is saying being undocumented is a crime. being an undocumented IMMIGRANT is a crime. because, even if you get past a point of entry, if your intention was to IMMIGRATE you are concealing your intentions to the immigration agent.

I have friends who had home births and their kids don't have birth certificates or socials. that is not a crime. but they were born in the USA. they didn't lie at a port of entry.

if you changed your mind, there would be proof in that you contacted immigration services and started the legal process of being able to stay longer.

and yet people prove motives in court all the time.

I'm sure it would be a case by case basis, but ultimately if you changed your mind, to maintain legal status you would contact an immigration attorney and start the process to extend your stay or change your immigration status. if you didn't, and did stuff like say, buy a house, start a business, get married, aka any long term life situations, it would be indicative that you intended to stay when you told the immigration official you weren't intending to stay past your visa. aka, you lied to the immigration official.

if something comes up, like a hospital stay, etc that can be proof you did not lie to the immigration official.
