im glad you googled it but i dont think you can admit you are wrong since you moved the goal post so openly and obviously.

AlChemicalResearch said:
technically speaking, being an undocumented immigrant is a crime in and of itself.

no. its not. it still isnt.

I researched it before. how did I move the goal posts? it literally says its a criminal offense.

We are all criminals here to one degree or another. That's not why ice is doing its job dictated to them.

fundamentally, in a democracy if everyone is a criminal, no one is a criminal.

and it is my sincere hope that current-ICE features prominently in what I'd refer to as Nuremberg 2.

Legal immigrants that overstay their visa are subject to due process because they are persons.

Due process is for persons, not just citizens.

Nope, it's a civil offense, not criminal. Enlil has been pointing that out here for many years. But why listen to a lawyer, when we have a President who keeps passing cognitive impairment (aka senility) tests and bragging about it. Trump can still tell the difference between a zebra and a dog.

No, dude. Its a crime.

Arizona versus united states case says you are a liar.

I just looked it up.  The AI said its a criminal offense and several other sources did too.

I think youre being dishonest:teabird:

I posted the criminal code that specifically states its a criminal offense, as well as associated with civil offenses

I posted a supreme court case that makes it clear that it is a civil infraction.  It is not a new thing.  a case back in 1879 made the same point that it was not a crime.  There are some in-between as well.

Don't lie or miss-lead.  It is not the right thing to do.

Quote:
did it clarify civil offence or criminalYes, the Supreme Court explicitly clarified that under federal law, unlawful presence and seeking unauthorized work are civil offenses, not criminal offenses.Justice Anthony Kennedy’s majority opinion explained that because the federal government treats these matters through a civil regulatory system (such as deportation and civil fines), states cannot pass laws to turn them into state crimes. The Court applied this clarification to strike down Arizona's attempt to criminalize these actions:Unlawful Presence is Civil: The Court noted that as a general rule, simply remaining in the U.S. without legal authorization is a civil violation that makes a person removable, not a crime. Therefore, Arizona could not create a state misdemeanor (Section 3) to criminalize the failure to carry federal registration documents, as it would effectively criminalize a status that federal law treats as civil

No.  You quoted a law that you either didn't read, didn't understand, or simply wanted to misrepresent.  It is not a criminal offense to be in the united states illegally.

We definitely should.  People should be free to come and go as they please.  As long as they abide by the law here when they are here, everyone is welcome.

Euro countries should do this too so I can go there in and out freely without vetting and tracking so I can jack the ripper 2.0.

They check passports. They'd know I am there. It needs to be easier and more convenient. I will not lower my self to a dingy ride.

it is a misdemeanor to
  • Enter or attempt to enter the United States at any time or place other than designated by immigration officers;

  • Elude examination or inspection by immigration officers; or
  • Attempt to enter or obtain entry to the United States by willfully concealing, falsifying, or misrepresenting material facts.

So if you come on vacation and happen to stay a few days extra. Not a misdemeanor. If you come through a legal port of entry, then set up a life where you are working, raising a family, paying taxes, yadayadayada that is a misdemeanor. You willfully falsified your intent to leave after a certain date. If ICE agents attempt to detain you and you try to elude them, that is a misdemeanor if you are an undocumented immigrant. If you hopped the border and make it 5 years without being caught, but then you are caught, that is a misdemeanor. No one would call someone who stayed a few days extra on vacation an undocumented immigrant. The literal word "immigrant" is what makes it a misdemeanor. A traveler is not an immigrant. Someone who leaves their home country to permanently settle in another place is an immigrant. If you gained entry, even through a legal port, they wouldn't let you in as an IMMIGRANT without the proper paper work. If you got through, you concealed, falsified, or misrepresented facts. Which makes it a MISDEMEANOR.

You sir, are just wrong.

But ok, if you're like smuggled into the USA against your will, and you are undocumented, that probably isn't criminal, just a civil offense. I guess you're right on that point.
