      Is that absolute legal fact or just a custom through throughout our history? I googled your statement and didn't get a sure answer. I can't remember, but I guess from what you said Nixon was charged after he resigned.

Nixon was never charged.  He almost was, but he resigned just before that happened.

Is it an absolute legal fact?  No President has been charged while in office.  It is well-understood that the purpose of impeachment is to temporarily remove a President from office to prosecute him.  This has happened twice, but in each time, the President was not convicted.  Andrew Johnson and Bill Clinton were impeached and prosecuted, though.

If it is possible to charge a sitting President, it hasn't happened yet.  Most likely, the President would enjoy Executive Privilege, however.

Again, the Supreme Court ruled that Clinton could be used while in office, so why not prosecuted by a state court? The problem i guess is actually arresting the president and arraigning him on charges.

It is a bit more complex than simply applying the ruling in Clinton v Jones.  That case basically says that a President can be sued in a civil action for things that arise out of conduct that occurred prior to taking office, and only if the suit would not interfere with his duties as President.

Now, you're asking about a criminal prosecution. That's a whole different ball of wax:

1.  Conduct occurring in office vs. out of office.  The huge difference here is that conduct prior to taking office is not protected by any privilege or immunity.  Unprotected conduct can absolutely be prosecuted, whereas conduct during president's term most likely cannot.  WHEN that prosecution can take place is another question.

2. Prosecution occurring in office vs out of office.  It is pretty much assumed that no President can be criminally prosecuted while in office because a criminal prosecution necessarily makes it impossible for the President to carry out his duties.  The impeachment process is where a President is removed from office to face prosecution.  Now, AFTER leaving office, a President can be prosecuted for all crimes committed outside of office AND for any crimes committed while in office that are not subject to executive immunity.


So, lets look at murder of his wife.  That depends.  If he murders his wife by ordering a drone strike on foreign soil where his wife happens to be, he's probably immune.  If he stabs his wife in the oval office, he's probably not immune.  In either of those situations, however, he has to be impeached to be prosecuted...or be prosecuted after his term ends.

Close.  Impeachment is a removal from office to bring charges.  Those charges may not result in a permanent removal, though.  Bill Clinton was impeached but not permanently removed.

can people explain to me why people think he would resign? seems the least likely imo. I expect he will finish his term and depending on his opposition he could win again.. but I hope for impeachment.

i see, ty. so the idea is that he would jump before being pushed? Yeh that makes some sense.

I think i didn't see it as an option because I thought he would see it as admitting loss but he would probably just claim he left on his own terms rather than be an impeached loser.

2.  His time is too valuable to waste on helping people who won't work with him.
