Re: Gun owners should pay a security fee to help pay for police protection [Re: Enlil]

So basically koods wants legal firearm owners to pay for crimes that they didn't commit nor had anything to do with whatsoever. Pay for your rights lol. This is communism at best.

The military budget would have to skyrocket for that.

Should we tax homosexuals to cover the cost of HIV treatments?  Maybe a tax on each newborn to cover its societal cost?

The military doesn't pay the same taxes as civilians, many states exempt the military from certain taxes. And homosexuals already pay to cover the costs of treatment. As for newborns, that's ridiculous and you know it.

The whole thesis of the thread is ridiculous.  That was my point

That's just like your opinion, man. As it's already been shown, there is existing precedent on taxation of items in an attempt to discourage or reduce the destructiveness of industry. Cigarettes are a great example. Guns should not be an exception.

They're not analogous. There is no safe way to use cigarettes.  Nearly every cigarette causes harm to a human.  Less than a fraction of a percent of firearms do.

Also,  there is no constitutional right to smoke.  Maybe we should tax speech that is critical of trump.

I wasn't saying that they are analogous. I was saying that there is legal precedent, but okay.

Cite one.  Show me a legal precedent where the exercise of a fundamental right has been taxed to discourage that exercise and that tax has been upheld on review.

I'll be waiting with baited breath.

There's no need to. Lack of taxation isn't a fundament right. You should know that.

The tax isnt about discouraging violent crime, its to cover the costs of violent crimes from gun use.

Same with car insurance. U pay it even if u dont need it your whole life.

No.  Bearing arms is, however, so where is the legal precedent for taxing the exercise of a fundamental right?

You aren’t taxing a right. You’re taxing an industry, one that’s already taxed. What are you even arguing?

Driving a car on public roads isn't a fundamental right.  Completely different thing.

Can anyone give me an example of a tax on the exercise of a fundamental right that was upheld by an appellate court?

That's not what this thread is about.  Taxing an industry isn't the same as making gun owners pay a tax every year for exercising their right to own a gun.

Tobacco and alcohol are taxed. Those are not fundemental rights. Why not tax firearms too?

Because the right to own a firearm IS a fundamental right.

What the hell does this have to do with due process.

I’m sorry... where in the constitution does it say your rights should be provided at no cost. Not even the right to counsel provides this. You gotta pay if you can. You may be required to pay for security and permits to exercise your right to assembly and protest. Reporters have to pay their own costs even though their work is a guaranteed right. All of these are fundamental rights, and none of them are required to be without cost.

Registering a gun fits perfectly within the 2nd amendment’s rationale that the security of the nation requires a WELL REGULATED MILITIA of armed citizens. Regulation is literally built into the second ammenfment.

[Mod edit: removed personal attack]

Keep the personal attacks out of this forum.

Can you cite an example of any other fundamental right that one must pay the government every year to exercise?  No one else has been able to.  Maybe you can.

Apparently, 45 states already have a tax for firearms and ammo: https://www.ttb.gov/firearms/faet-faqs.shtml

Where is the annual tax for ownership like koods is proposing?
