Prenuptial Contract

But my father always said to tell my future soon-to-be wife that if I didn't have one, that he'd write me out of his will.

It's a good idea, but one that usually women disdain. Here's the way I see it:

One party acquires property, etc., and then marries someone else. Yes, you're in love, and want to share everything, and it will never end.

But one day, it ends. Suddenly, you're spending a lot of money on attorneys trying to figure out what percentage of the property is separate and what percentage is community. And it doesn't always end just because of divorce. Sometimes it ends because of death.

So a prenuptial agreement sort of works out these issues ahead of time. Reality is that about half of marriages end in divorce. It would be nice if our marriages would never end, but shit happens.

A prenuptial is like a contract. The parties are agreeing as to the designation of the property with which they are entering the marriage, in the event of a divorce or death or anything like that. This protects children and spouses from a previous marriage.

I would not go into a marriage again if I didn't have a contract. Well, that's if I owned anything.

A prenup is a tough day, and a lifetime of comfort. Bear out the tough day, because that comfort is impossible to reaquire after it is lost.

Thats the best way to do it I've ever heard! I will be telling any future Mrs DoctorJ that same thing when I meet her!

But yah, as for SWAMI's question, I am firmly of the opinion that prenups shouldnt even be an extra step. It should just be a required part of the marriage liscense. I mean, the fact that it isnt only benefits divorce lawyers. "Tou get what you put in." That seems totally logical and fair and should be a stanmdard legal component of the institution of marriage (which really shouldn't exist in the first place but dont get me started on that...)

I think that since technically marriage is nothing more than a legally binding contract between two people, a prenuptual agreement is just another optional technicality to that contract. A relationship should go deeper than the papers recognizing it.

One would assume that the relationship is going to go deeper than the papers which define the rights of the parties and the characterization of the property. What is wrong with a contract?

When someone doesn't want to sign a prenuptial agreement, especially when the other party has acquired a substantial amount of property, whistles go off, in my mind. Shouldn't the person who is balking at signing be able to understand that it's important to protect one's assets for prior children or ex-wives?

And the person balking usually doesn't have any property, or they would want to sign also. And even if they don't have property, they can make sure there's a clause protecting them, should he or she stay home and take careo of the home and give up work opportunities.

Really, the only people who win when a prenuptial agreement isn't signed are the attorneys.

I guess I didn't express myself very clearly. I agree with you 100%. I meant to imply that when agreeing to recognize your relationship in legal contract such as marriage, it seems like a prenup should just be accepted by both parties as a natural inclusion of the contract.
