Ok, you've made this silly point too many times to further ignore it, so I suppose it should be addressed. If you are flipping through the channels you are actively seeking random content. This is not a variable that has to be accounted for.

by that same logic if you are watching a tv show then you are actively seeking the ads that are associated with it.

if you watch rush limbaugh and rush says "vote against obama"

its fine. no rules. freesome of speech applies

if someone pays him to say "vote against obama" its subject to rules

if the station puts up a 30 minute ad to ross perot (the greatest candidate we ever had).,, its freedom of speech...

if ross perot pays to have a 30 minute show (also free)

if glen beck pays to have a 30 minute show on why obama is the best guy for the job, and in this 30 minute show someone pays to have an ad for bill clinton.... the rules apply only to the bill clinton side.

if you call an ad a show and its long... its up to the content provider of the show.

etc etc.

The problem with all of these statements so far is that they're so god damn subjective. Just a handful of posters on this board have been able to throw dozens of scenarios at you that circumnavigate the rules you've been putting forth. Now extrapolate that to 300+ million people.

The contribution limit applies to both.

If the content provide plays it for free, then it's part of what the provider is about, and it's not subject to limits.

So far there have been zero scenarios circumnavigating the latest rule.  Expand that to 300+ million people... gives you zero.  Do you see a hole in the latest version???

Comedians can freely tell jokes if they're not paying someone to tell them, or if a 3rd party isn't paying to dictate the content.

This rule has become so vague as to be meaningless.  "generally not sought"?  I have no idea what that means, but I know that the rich will have lawyers that can have a field day with that phrase.

Comedians pay to put on the show. They pay the venue, their staff, equipment costs, advertising costs, etc. Does that not count towards the individual contribution limit?

Seems easy to me to understand.  Perhaps we'll need an example to demonstrate whether this is too vague or not.

When it was specific, some people complained about that, so we'll give this a try.

What is a medium where political content is not sought? People use the internet, print, television, and radio to seek political content all the time.

I've known many comedians, and not one ever paid to put on a show.  They get paid to do a routine.

And as I said above "Comedians can freely tell jokes if they're not paying someone to tell them"

The problem you're running into is that there is no workable test :shrug: 

At this point, you've basically created a "I'll know it when I see it" test that leaves so much discretion to the courts.  Discretion leads to disparity and discrimination...always has...always will.

The more general the test is, the more it will be subject to abuse by the ones who can afford the most lawyers.

Fine, but the question is not limited to comedians. If a comedian, musician, speaker, etc. has to incur costs to present their show, and they make a political statement, are the costs they incurred subject to individual contribution limits?

Perhaps medium is too general a word.  A more specific word should work (something that describes a "basketball game" rather than just "television".)

So maybe get rid of the constitution all-together since so much of it is open to interpretation?

That's the whole point of this thread, I suppose. But, at the moment, I'm not sure what word or phrase would concisely describe what you are trying to describe.



And maybe it's fine as is.  At a high level, political speech isn't banned on television, but for televised basketball games it's subject to the contribution limit.
