Sued by debt collectors
    #12861529 -

I'm being sued by a law firm for a credit card I canceled a year+ ago and now have a ~$1,000 debt.

I have nothing and no job so I'll most likely get a judgment against me. Since this is the case I was wondering should I even go to the pretrial conference?

I'm about to enroll for another semester at college, so would this affect my financial aid?
I'm also on felony probation, I'm sure this won't violate me, but I'd like a second opinion.

Did you cancel it in writing and how did it get $1000 on it?

To be honest with you I can't remember if I canceled it in writing or if I did it online, but I know I canceled it.

Originally the debt was at ~$500 but they kept adding late fees and finance charges and other bullshit

at the very least make sure you file an answer to the suit (it probably cost 15 bicks or so)--this can prevent, or at least slow down, a judgment or levy against you

take the time to research and file papers in the case; very often these 2nd or 3rd party debt collectors cut corners, misfile papers, and right out lie in their documentation---

Don't make the mistake of ignoring the letters.

if it's only like 500 you can call them ( the lawfirm) and they will set up a payment plan.  if they don't just tell them you will file bankrupcy and they can get pennies on the dollar.
fact is they want all the money they can get because they will split that with the cc company. they do not want you filing bankrupcy.

Eh, you can't get blood out of a rock. They can bitch about it and harass you all they want, but eventually they'll stop and just write it off. Of course, they will also add a bad debt note to your credit report, so you'll have a hard time getting a CC or a loan in the future when things improve.

Fuck em

I plan on fucking my CC company as well.  Like #6 said.  You can't sucker me for money if you don't know where I am. GG

Yea, they piled the fees on me too.
I was saving my cash and one day just called them up. The original ballance was like 1200, and they had it all the way up at 1800.

So I says look, do you want this 1200? They say no, we want 1800. Lemme talk to your supervisor
Hold music.

Supervisor: blah blah blah
Look man, if you want this 1200, that's what I can do. If you won't settle for 1200 then good luck getting anything outta me. I'll wait the 7 years to get another card. I don't care I dont have a job I don't have shit that you can take from me. No car no nothing unless you want a Nirvana In Utero clear vinyl and we'll call it good on that?

They took the 1200 after they realized I was serious.

It shouldn't affect your probation since it's a civil matter, worse case scenario you'll have a judgment against your tax returns, if you want to avoid that follow the other anons advice and negotiate a settlement.

A national CC company is taking you to court for less than $1000?

Seems fishy, to me. Usually they write it off if it's under 5k.

Usually they sell the debt to a collection agency who will say whatever to elicit your response, the whole lawsuit thing might even be them bs'ing you (unless you received a subpoena).
