Facing 10-15 for Salvia!

A few close friends and I were smoking salvia in the front yard (large, grassy, very relaxing), thinking that there was nothing illegal in our actions. A cop drove by, pulled in and turned on the sirens pointlessly, one friend ran off... thats not suspicious, and the officer came over to us.
After a long talk between he and I that all I had was about 30 grams of salvia and nothing else, and that he was free to test the pipe, he yanked me around and put me under arrest. I did not know salvia has just recently become a SCHEDULE 1!  drug in Ohio.

It seems like they want to make an example of me, I was released on bail to my parents custody (not a minor), but I'm hearing all kinds of things about ddistribution and jail time.
I'm really starting to freak out!

I did not think I was breaking any laws, just exploring  after a morning of grad studies

Don't you read the news on this site?

I think most people here know the recent actions against Salvia in Ohio.

While I think its ridiculous that the government has the power to do this, you really should have kept yourself informed.

You also should have had more respect than to smoke mind altering substances in public.  You could have done it inside.  You were inviting trouble by smoking in your front yard.  Legal or not, you didn't need to invite attention to you.
You did it because you're a smart ass, flaunting what you thought was legal in public.  I wouldn't be surprised if one of your neighbors reported you.

Your right that it must have been a neighbour... my yard is far from public, we could not have been seen from  the street.

Did they actually say 10-15? Well if you explained yourself in court, it would be really hard to be a judge and sentence you to 10-15 for that shit.

Of course, they dont give a fuck. All their worried about is getting off work to eat their sandwich and fuck their old floppy wifes.

yes he was stupid for smoking it in his front lawn, but that in no way justifies our stupid ass drug laws.

i don't think you have much to worry about though. ohio hardly even prosecutes for pot anymore unless you're moving serious weight, and considering salvia was so recently classified as illegal, you can probably get off with some drug classes/probation if you just explain the situation to the judge.

Isn't there a grace period, usually, where they will inform you that the law has changed and tell you that next time you'll be arrested? I know it's like that here (Germany). If they make something illegal that has previously been allowed they give you a warning during that grace period, but not more, because it's pretty obvious that not everybody will know immediately and automatically that the law has changed.
I mean it's pretty obvious that you didn't know, or otherwise you wouldn't have been sitting in your front yard smoking salvia.

Come on, your the reason shit like salvia becomes illegal.
If you show some respect to these entheogens and do them in a responsible way you wouldn't have this problem.
I think if you had any common sense you get a decent lawyer and start thinking about how you use these things in the future cause is doesn't even matter if you didn't know it was illegal, why the fuck would you smoke salvia in your front yard?

It'll depend on your previous record and whether you get a lawyer.

Most first time offenders wouldn't get more than a ticket for MJ.
