How about your Republicans proclaiming they will continue torture, and go further than waterboarding, regardless of whether or not it gets any sort of results? Regardless of treaties signed (and authored) by the United States? That's unconstitutional.

I think it's wrong, but Democrats also support it.  It's not exclusive to, or.necessarily endemic to being a member of the Republican party or to more generally support the idea of a Constitutional republic.

article 2 section 2

Uh, no he can't.  The president can nominate anyone he wants for a Federal Judgeship, the Senate decides whether or not he is confirmed and appointed.

I am in a minority on the shroomery, as I frequently defend the opposing side when they have a point about something or when my side make believes something about them.  I also attack my side if I think they're wrong.  People here get very confused by that and think it means I prefer the other side.

Well hell... I didn't write the constitution. The obstructionism from conservatives like Mitch McConnel saying he will do everything in his power to prevent Obama from nominating a SCOTUS judge seems to disregard the constitution more than the POTUS doing his fucking job.

No one can stop the president from nominating anyone.  Whether or not the Senate confirms him is the answer.  Those fucking idiots should have just shut the fuck up, Obama nominates a candidate, and the senate can approve or reject him.  Its that simple.  The point is, the Senate has the power but under the brilliant leadership of mitch McConnel, they've shit themselves.  Why do you think Ted Cruz stood up and called Bitch a liar on the senate floor? There isn't anything in the constitution requiring that the judicial branch be free of political influence.  Quite the opposite in fact.  As for biased or "unqualified" judges, the constitution doesn't even require that nominees to the supreme court be a sitting judge. or even a lawyer for that matter.  Obama could nominate you tomorrow, and if the senate approved, you would be supreme court justice for life.
