Re: neighbors have trapped deer [Re: passifloracaerulea]

Bow and arrow is legal in city limits, at least here anyway, and you can kill them out if season if they're eating your garden or harassing your livestock. You can also shoot a dog if it's chasing whatever you're hunting, can also shoot a dog if it wanders on your property. That fence situation is really messed up. If they want deer they can setup trap cams and throw them apples to fatten them up and keep them around.

I'd stay far away especially if it's a sheriff. They're going to do what they want even if it's wanton waste and/or cruelty or out of season kills.

I fail to see how this is harassment or mistreatment of animals.

found this at http://www.oregonlaws.org/ors/498.006

Quote:
§ 498.006¹
Chasing or harassing wildlife prohibited

Except as the State Fish and Wildlife Commission by rule may provide otherwise, no person shall chase, harass, molest, worry or disturb any wildlife except while engaged in lawfully angling for, taking, hunting or trapping such wildlife. [1973 c.723 §74; 2003 c.656 §11]

this doesn't mention anything about fences on your own property...

i found this at http://friendsofbigbearvalley.org/environmental-laws/wildlifelaws.html

Quote:
CALIFORNIA CODE OF REGULATIONS TITLE 14
§251.1. Harassment of Animals.
Except as otherwise authorized in these regulations or in the Fish & Game Code, no person shall harass, herd or drive any game or nongame bird or mammal or furbearing mammal. For the purposes of this section, harass is defined as an intentional act which disrupts an animal's normal behavior patterns, which includes, but is not limited to, breeding, feeding or sheltering. This section does not apply to a landowner or tenant who drives or herds birds or mammals for the purpose of preventing damage to private or public property, including aquaculture and agriculture crops.

hmmmm....

i found this at http://www.ncwildlife.org/Hunting/LawsSafety.aspx#531381-unlawful-harassment

Quote:
In North Carolina, it is unlawful for a person to interfere intentionally with the lawful taking of wildlife resources or to drive, harass, or intentionally disturb any wildlife resources for the purpose of disrupting the lawful taking of wildlife resources on public or private property. NOTE: This law does not apply to activity by a person on land he owns or leases or to a person who incidentally interferes with the taking of wildlife resources while using the land for other lawful activity such as agriculture, mining, or recreation.

Violation of this subsection is a misdemeanor punishable for a first conviction by a fine not to exceed $1,000.00, by imprisonment not to exceed 30 days, or by both and punishable for a second or subsequent conviction by a fine left to the discretion of the court. (North Carolina General Statute 295)

i don't know where you live OP, and i'm not gonna look up all 50 states, but it sounds like your harassment of wildlife argument is imaginary

Well

"harass is defined as an intentional act which disrupts an animal's normal behavior patterns"

"This section does not apply to a landowner or tenant who drives or herds birds or mammals for the purpose of preventing damage to private or public property"

Pretty sure fencing in wildlife counts as disrupting an animals normal behavior patterns, and it doesn't sound like they are doing it for any reason.

Especially if deer have been getting into their greenhouse... Oregon could be even more strict so I don't get what your point is

What proof is there he is trapping deer on purpose? I've seen none.  Unless it's a 12 foot fence (unlikely) they are probably hopping in and out on their own accord, and OP seems freakishly paranoid.

What part of that says you can fence animals up?

It says not to change animals normal behavior, unless it "drives or herds birds or mammals for the purpose of preventing damage to private or public property"

Which is clearly not the case, OP has said deer have died inside the enclosure and it has trapped pregnant and young deer.

That sounds like some detrimental changes to behavior to me...

but if the purpose is to keep the deer out, it doesn't matter that a small number get incidentally trapped inside.

The sheriff isn't "driving" a herd though... He has a fence meant to keep deer out that is clearly not working as intended from all OP has shared.

Where dos it say it doesn't matter if some get trapped inside? That is still altering the behavior of a wild animal and that is what the law specifically is protecting...

If a deer gets trapped inside a fence by itself, how is that altering the behavior of a wild animal? They went there by their own accord.. There was literally no human intervention in that case..

If he drove the deer in there and then locked the door you might have a point, but unless that fence is freakishly high, it isn't going to stop them from escaping.

The deer is trapped and traumatized. I haven't even seen it today. She's probably dead by now like her yearling. She is pregnant and her ribs are visible.

... That sounds like behavior altering to me.

Also did you not read the super pregnant deer part? I would imagine a very pregnant deer would not be able to jump nearly as high as others, not to mention its baby.

You people are impossible to reason with. There is a dead deer caused by absolute negligence on the part of the land owner cop. All he has to do is lower the wire for a day and they would have gone free. If you build a deer fence on a deer highway to keep the deer out, it is your responsibility to make sure that is what you're doing, rather than trapping them. I should have filmed the whole ordeal and you guys would have been upset too.

I sympathize with them, but I'm still trying to figure out how the landowner is at fault here. He built a fence, they crossed it, and they died because they crossed it. It's sort of like how a bird flew down my chimney the other day and died in my stove. The circle of life is cruel. Very few fawn make it to adulthood as it is. Imagine what predators there are outside of the fence.

You did say you're in city limits however. If there is a carcass on his property he may be required to remove it.

the fence is altering the behavior of the animals by being there.

if i line my property with 1ft high barbed wire and a child gets stuck in it, or a bunch of animals, or whatever and i get reported to the police, i will be fucked.

and its not because barbed wire is illegal or something, its because i used it in an improper, negligent and dangerous way.

or for instance, say i leave a loaded pistol in the middle of the road on purpose. its not illegal to own that pistol, but it is illegal to place it in the middle of the road for any kid to pick up

That's grasping at straws.. By your logic my chimney illegally alters animal behavior too
