Any convicted felons in the house?
    #17423818 -

So, I'm a professional woman (meaning I have a college degree and HAD a career lasting several years) who was convicted of a felony back in 2009.  I had never been in trouble before in my life, and sorry if this sounds entitled, but I was expecting to catch a break and plead out to a misdemeanor, but no such luck at the time.  I filed for an expungement last month, but it will be another month or so before I even hear anything about it from the court.

Needless to say, this has pretty much barred me from obtaining work in my field of choice, and if it weren't for "other" means and having a supportive husband, who knows where I'd be right now (I have absolutely no family other than him).  I had lived a relatively calm and sheltered life up to that point, and looking back on it, I have to laugh about it, or else I'd cry.  So, I'm nervous about potentially re-entering the work force after a 3 year gap.  Also nervous that an expunged charge could still potentially show up on a regular old background check and continue to mess me up in the future.  Any other ex-cons wish to share their experiences regarding finding work.....how do you get by??

(If it helps, the felony I was convicted of was a gun charge - I got pulled over with a gun improperly stored in my car.  In my sort of defense, we had just moved to a new house, and I had a car full of crap that I had been too lazy to take inside the new place.  Cop pulled me over on a traffic stop, then wanted to search my car once he saw all the crap in there.  I agreed, not knowing what about to ensue.  Then admitted the gun was mine, because it was registered to me - d'oh, I should have just kept quiet, snitched on myself!  If only I had known then what I know now, never talk to cops EVER).

Me and my wife have switched roles since I can't ever find a job. I worked at a fast food place for a few months at one point, I worked at a restaurant for a week as a dish washer.. (bitch manager had it out for me) but other than that I haven't really ever had a job. My conviction was when I was 15 (almost 16, actual offense being even earlier) and it has carried over with me to adulthood. I was told I could seal my record or whatever, but I've never really had the money to do it.

Anyways I stay home and do all the stuff the 'woman' would usually do. Dishes and cleaning house, cooking, also keep the yard cut and what not. We don't have to pay rent, just have to pay half the utilities. We're on govt. assistance, too. (People should really keep stuff like that in mind next time they don't wanna give me a job. They can let me legitimately work for the money or they can just give it to me while I 'do nothing'.)

I know a lot of people who have felonies who struggle too.. Most deal drugs or worse (breaking into cars/houses). All because people wanna turn their nose up at felons instead of giving them a chance to reintegrate into society.

We thought about getting food stamps, etc. to help, but we don't have any children so figured it would be a waste of time for us.  I feel like before this happened, I was a normal worker bee, a functioning cog of society who went to work and always did as she was told.  After this happened, I still receive tons of job offers, but they are always rescinded after completion of a background check.  I've gone through about 20 good career job offers in the past 3 years this way (I always fill out the form and submit on the off chance they won't actually run it, but they always do!)  I've never stolen anything, but I have done a lot of things for money that I don't think are right.  This whole experience has made me live the life of a completely different kind of person, and that worries me.  But I'd still rather take my chances vs. slaving it out for $9 an hour doing menial work when I have a degree and years of actual work experience.  Employers unwilling to give folks a second chance make them resort to doing whatever they have to do to put food on the table and a roof over their head (we have a mortgage and all that shit, so we really need two incomes).  Hmmm.

I have 7 felonies.

I received food stamps for a little bit, but then found a sales job that paid too much to continue getting them.  Me making a measly 12,000 this year stopped any kind of gov't assistance I could possibly get.

Lucky for me I didn't have shit going on for me before my felonies, but I had a way way better quality of life then I do now.  Felonies are bullshit, and maybe you should think about relocating.

Some states look differently on different charges.  I would really look into various states gun laws and find states where it's really not as big of a deal as more liberal gun law states.

It's really just who you know once you are a felon.  You have to make a lot of contacts and move up through bonds instead of your resume.  It sucks but I am making it happen.

great advice BTW.

........And yes I have a felony. I was lucky enough to have it expunged after I reduced it to a misdomeanor. I have no idea how it will effect my job seach because ive only worked minimum wage jobs while im finishing school. I hope it doesnt show up once people start backround checking me.

I did get denied a job at CVS before when it wasnt expunged, but hopefully that will change now that its off my record. I still cant own a gun (unfortunatly), but

I feel bad for you. I actually earned my felony. It sounds like yours was an honest mistake  I got resisting arrest with use of force.

Haha, yeah I feel like I got fucked hard....since I straight up admitted it was my weapon, the prosecutor had a slam dunk case, so no need for him to offer me a plea as I'd never win at trial.  They even wanted to send me to prison for 6mos-1y, even though I was working at the time and had never been in trouble before!  And I was 30 when it happened, so it's not like I was a youngster getting started on a life of crime - I was old and established lol.  But I digress, I've had years to indulge in my pity party over here, hehe!

I think I've scared myself pretty well by reading horror stories of expunged convictions coming back months and years later on background checks, because those companies are private and not required to update their info on any kind of regular time schedule, so some sealed records slip thru the cracks that way.  I will be beyond enraged if that ever happens to me and it costs me ONE MORE JOB - I feel after my probation, fines, and forced poverty these past 3 years, I have more than paid my dues for any "damage" I inflicted on society.  Aaaargh.  I swear if I was younger I would have just said fuck it and started stripping

Im a convicted drug felon here...it absoloutely ruined my life for a period of time,it kept me from obtaining employment. I paid my fines, did my time and did probation without incident...everything I was supposed to do,I did. But yet these mistakes still haunt me,and they will forever. No chance of having them expunged because I have multiple drug felonies, from one case...not like I kept making mistakes time  after time. It put me in an extremely hard position for a number of years,I took my chances and did what I had to do to survive and pay fines...and Im extremely bitter towards society for this. Its just a fucking game to the judges and probation officers.
But Im doing good in my life now,my past is far behind me and I no longer break any laws. Being in that position forced me to make decisions on how to handle my life, definitely for the better. I figured out that since no one will employ me,I have to employ myself. I applied myself and learned a couple skilled trades....hvac and small engine repair. Now I dont ever ever have to worry about working for someone else again.....Im my own boss.
So now I say a giant fuck you to all judges probation officers and piece of shit judgemental employers, keep your shit jobs because I dont fucking need you. They can give me 100000 felonies, and Im still going to be able to have a job.
You can still have a successful quality life, you just may have to look into being self employed.

Re: Any convicted felons in the house? [Re: Anonymous #6]
    #17428167 -

Self employment is something I've thought about, however every time I come up with something I could do to make money, there are too many reason why it can't work, for me to do it. I mean other than the obvious fact that most of the profit margins are too low for me to make any kind of living off of. I've known more than one self employed person, just because you have a 'product' that is in demand doesn't mean you are necessarily going to be well off just because you provide it. For example my grandpa did lawncare, when you factor in the charges for the equipment/truck/gas and everything, there really isn't much profit to be had. Sure that 400 dollar mower does a lot of yards, but eventually it breaks and needs to be replaced. All of the equipment does, including the truck. That stuff adds up quick.

Anyways I considered making furniture (I'm good at woodworking) but I don't have any of the necessary tools. Not to mention we don't have a truck for transporting lumber (or possible delivery of said furniture) nor do we have anywhere I could set up shop. This house is cramped as is, we've already ran out of spots to put stuff and now we have to get creative if we need to add something new to the pile of our junk.

I thought about organic gardening (or just gardening) to go to like farmer's markets or something but we have only a very small yard. Even if I turned 100% of our front and back yards into the most productive gardening space, I still wouldn't be able to grow enough to make any kind of living off of. I can't do that though. There are too many trees blocking the sun around the yard. These trees are all tangled up in power lines and some aren't our trees, blah blah. It would cost THOUSANDS to get rid of them, and even then that would give me maybe 50% of my yard). I never really appreciated just how much time and space is needed to grow decent vegetables. Not until I started gardening anyways. You develop a whole new appreciation for food when you grow it. Also, again, no truck. It would be a must just for picking up and bringing home the compost/fertilizer needed for growing healthy vegetables on a large scale. Paying exorbitant delivery fees would really eat into your profit margins over the long term.

I could go on, but this is kinda long already. My point is, every time I thought I found something that was good enough, I'd find a lot of reasons it was impractical if not impossible for me. It's gotten to the point that I've started  to seriously consider going into business my brother and start dealing. I'm tired of being broke and living paycheck to paycheck. I'm the last person who you'd think would be a dealer, it's just not in my nature. I prefer to just walk away rather than fight. But you can't just let people get away with shit when you're dealing. They'll just keep walking all over you. Seen the movie Savages (the new one)? I'm the damn hippy, maybe even worse. My brother is like the other guy though, so I guess it's doable.

Well from my understanding felonies never go away, expunged or not. It may always come up in a background check thanks to this thing called the freedom of information act. Its ironic that the same society that expects you to succeed,is the same one that does everything it can to kick you in the teeth.

I believe that criminal records can be purchased by private organizations. Therefore your felony may be expunged from police records, but will still be available elsewhere. And who knows,do you really believe that in the event you pay an attorney to have your background expunged, they really do? I dont.
I may be wrong about what I say though. A good person to ask about these issues may be a member here named Enlil,he seems like a straight shooter or possibly Alan Rockefeller.

^^^^

It really just depends on where you're applying whether or not it's going to show up. If you tried to apply for law enforcement or something you can bet your ass it'll show up.. Taco Bell however, probably not.

Yes, even though a conviction is sealed, police can still see it when they pull you over, and courts can also see it (if you ever land before a judge again).  State/fed background checks can always see sealed records as well.  Other background checks (for private corp. jobs) use 3rd paty data gathering services, and yes they do purchase legal records all the time.  They also aren't legally required to update their data to reflect expungements.  They "usually" do this (although it can take months after your record is sealed before it drops off their background check report), however you could run into a situation where a check could still pick up a 10 yr old sealed record, just because that particular company never got around to updating your info.  And that stuff is totally unregulated.  So yes, in a sense, your record is never "truly" expunged.  This is what I've learned through my own research.

And yes, I've done plenty to break the law to support myself after my court case was done - some I feel ok about, some I don't.  I just don't want it to be this way forever.  But I suppose I do prefer this to working at McDonalds or whatever (I couldn't even get a job working 3rd shift at a gas station because of my felony - and I have a goddamn college degree WTF :mad2:)

Also, once you're "in the system" you are never able to get out.  I had a couple traffic stops after my case, and both times the cops asked me "where are the guns??"  And both times they wanted to search my car.  I told them to fuck off.  I wasn't in a hurry (no job to go to) so I made them waste their time by calling the k9 van on me.  Now I have no cars titled to me in my name.  That's also something I'd suggest to do if you haven't already - make sure any cars you have are titled to your spouse/bf/gf/parents - anyone but YOU, because you will get pulled over on some bs and get fucked with.  It's a certainty lol.

I'm sure it varies by state - I'm in OH for example, and I wait to wait 3 years from  final disposition (3 years from the date my probation was terminated) and it cost me $50 to file for expungement. You should call your county clerk of courts and ask them, they will be able to direct you where to go.

I was convicted in 2 states for the same "sting op". (Sold weed twice, once in my state, once in the other state).
Both states charged me, both conviced. Other state let me complete my shit and dropped the conviction, my state made it stick.
This was all in 03-05. I had trouble getting a job due to it, but now I work with family, so its ok....I just hope I can do this forever.

Worst case scenerio, grow a ton of mushrooms. "They" don't want you to succeed, so fuck em.

(Its made me pretty jaded)

I got a felony for driving with a gun in my car in New Jersey.  Sucks but what can you do.  The gun wasn't illegal but it wasn't cased, had a bullet in it and in New Jersey you need a license for it I think, New Jersey's known to have strict gun laws from what I hear.  It's annoying but I don't have plans to go back to college or look for employment outside of what I'm working on now so doesn't matter to me so much but I may try to get it expunged down the line though.

I have a few misdemeanors, but they are bad ones like theft.  I just lost a job where they liked me and let me start working prior to the background check completing.  I worked there for 6 days, and it was the first time I worked in over a year.  They called me into the office, and after asking if there was some mistake like the check coming up for a different person, they dismissed me.

I've passed a few casual background checks after my first offense, but this one was for the payment card industry.  It showed EVERYTHING, even some stuff I had expunged.  Sure, it said the charge was expunged, but it still showed up and had every detail of the bargaining, expungement, jail time, community service etc.

So, I'm basically getting to the point where I'm scraping together change, begging from relatives, even from an ex-GF who still has a soft spot for me.  I swore I would go on the straight and narrow, but I'm getting angrier and angrier as I can't even meet my basic needs.  My credit is totally and completely fucked, which is another thing they love to check.  "OH, you can't afford to pay your bills??  Well then you clearly don't need a job or paycheck.  Hit the bricks."  Pretty soon my only option will be to become a criminal again.  I need to fucking eat.
