It doesn't take shit to get throwin in jail for spousal abuse.  They put my mom in overnight for throwing something and hitting the wall.  It's just a mandatory thing that you have to spend a night in jail.  On that note, she also got arrested for forgetting to register our dog.  Fucking police.

I think the real term is domestic abuse, so the definition would definitely cover that.

WEll... um yes.

You can get one night in jail for farting when you walk by a cop in a bathroom. If your woman calls the cops you will prolly get cuffed and put in the car for an hour at the very least. Even if all that happens is she lies and says you threatend her with violence you can go to jail for a night.

Anyways i watched my mom get smacked around when i was younger, and belive me ive never hit a woman. I hate that shit acctually.

Some might need it still

I've taught domestic violence classes for almost a decade.
Most of the guys get to choose between a year in jail or a year of classes [which they have to pay for - about $2,500].  I don't think a night in jail is the norm.  A lot of them, as far as I can figure, were set up by their spouse, and the police took them to jail, cuz they were the man.  Some were there for a reason.  One has been there 3 times.  He mellowed out after a bit.  He had a great line.  "I never hit my wife.  I just took a chain saw and sawed the wall off her house."

I have to say that ACTUAL domestic abuse is a tragedy, however the police and domestic violence courts have abused so many innocent lives.

All it takes is a call to 911, a threat of violence or a "battery" which could be poking your finger on some part of her body, and the "male offender" is going to jail.

I've also seen a woman charged with "attempted murder, domestic violence" for shooting her boyfriend once in the groin, and once through his bicep into his chest after an argument. She was sentenced to, get this: 10 years probation, yes, no fucking jail time at all, none at all for trying to kill someone with a 40 caliber beretta, thank God the thing was loaded with ball rounds for training.

If the guy in this situation had shot her twice he would have received an automatic life sentence, and the news stations would lauded it.

Amen,

but, sometimes, this actually does happen the other way around...

All the more reason we need to program un-emotive robots to police our societies

The legal system in the US is extremely corrupt, the courts sentence based on how they are going to make the most money, remain popular, rather than what is the safest, and fairest punishment.  Justice is blind, and the US has mislead it.

Re: Spousal abuse [Re: Zinglons Acolyte]

the whole "domestic abuse" or whatever is bullshit.  Shouldn't be a crime.  We need to stop singling out individual groups and making their behavior criminal.  If its wrong to strike someone against their will then it should be criminalized the same whether you hit a guy on the street or your wife. Why can't we just charge actual abusers w/ assault and be done with it?  Same with "hate crimes" and other bullshit.  This stuff may be relevant in sentencing decisions but not in the offense.

If the offense of assault is deemed to have a set aceptable range of punishments, the legislature has allready detemrined the maximum amount of time that crime is worth for the most heinous example.  How then is it justified that the same crime, charged differently, somehow has a different name and penalty?

And yep, the overreaction to spousal abuse is stupid.  Crazy shit, like much of the domestic courts and issues they deal with, total overreaction.

I also would like to see some evidence that these classes "anger managment" "drug abuse" whatever else they give to people actually work.  These folks pay tons of money for something that appears to be little more than a plaque the judge and prosecutor can hang up and claim they are rehabilitating someone... stupid.  Oh wait they allready have... Presuming the experiments are sound you get around a five percent improvment: five people out of a 100 who go to the classes won't commit offenses aftergoing to the classes that otherwise would have... Is it worth the expense?

Quote:
If one relies exclusively on the five experimental studies, the effect sizes are even smaller. However, the effect sizes may be small as a result of measurement error and methodological difficulties common to research in applied settings  McCartney & Rosenthal, 2000 .  McCartney & Rosenthal, 2000 warn that “(g)iven that the stakes are so high, we should be wary of accepting the null hypothesis when it might very well be false—as it almost always is.” Based on the experimental studies, the effect size ( d) due to treatment is 0.09 and 0.12, based on victim report and police records, respectively. This means that treatment is responsible for an approximately one-tenth of a standard deviation improvement in recidivism. Based on a partner report, treated batterers have a 40% chance of being successfully nonviolent, and without treatment, men have a 35% chance of maintaining nonviolence. Thus, there is a 5% increase in success rate attributable to treatment. To a clinician, this means that a woman is 5% less likely to be re-assaulted by a man who was arrested, sanctioned, and went to a batterers' program than by a man who was simply arrested and sanctioned. Whether this success rate is cause for celebration or despair depends on a cost–benefit analysis; taking into account the cost of treatment and any potential “side effects” vs. the benefits of injury prevention and decreased psychological risk to the victim as well as the children exposed to family violence. A 5% decrease in violence may appear insignificant; however, batterers treatment in all reported cases of domestic violence in the United States would equate to approximately 42,000 women per year no longer being battered.

So in the above, if you have a class of 20 domestic violence folks, one of those will not commit an offense who otherwise would have had he not taken the course, presuming the experiments were perfect and that the class wouldn't have been as effective if he had just gone to jail for a few hours a week and had to stare at a poster saying "don't beat your..."

Does it make sense to make everyone pay a shitload for this "treatment" so the one guy in the class of 20 doesn't beat his wife or whomever?  I doubt it, but whatever...

My wife has worked at domestic violence shelter for many years.  Two major demographics of abusers are police and hispanics.  Thats just how it is, macho/machismo culture.  When the police get called to the shelter, they are not even allowed in because of the probability they are an abuser looking for a woman taking shelter.  The crazy shit abusers do to keep the women under their control is crazy.

There should be stiffer penalties for physically violent abusers.  Statistics show they simply dont change no matter how you try to intervene.  They are a lost cause, raised rotten from the beginning.

johnm214 mentioned the similarities between a fight on the street and domestic violence, but they are quite different.  Domestic violence can involve a whole system of long term control and exploitation.  Domestic violence has things like theft, rape, torture, kidnapping, forced prostitution and indoctrination or brainwashing in addition to the common notion of beatings.  Also, keep in mind that children are often involved and victimized.  Many times the kids are exploited by the abuser as leverage against the woman.  He uses them against her in various fucked up ways.  So anyway, I could go on and on... You can see how domestic violence is a crime unique unto itself, diverse in its manifestations and frightening as hell.
