Ok, I've got a friend that recently got caught up in some trouble... he was having a party, things got wild, he called the cops, cops come and take some of his pipes and collect some baggies that had some weed in them (all of which are in fact illegal) but they also take his spores. Well, I know my shroom stuff enough to know that the spores don't contain psilocybin or psilocyn and thats why they are legal. Unfortunately, the cops in this little town are ignorant. When they found the spores my friend said they where talking like it was blotter acid if that helps you get an idea of how dumb they are. But anyway, he found out what charges are getting pressed against him today and its only a 2nd degree - 1st offense Trafficking violation for Hallucinogens... I'm in kentucky, and I'm like 90% certain that trafficking for weed is considered Trafficking Cannabis, although marijuana, thc, psilocybin, and psilocyn are all under schedule I hallucinogens. I figure either the cops still think its acid or they think spores are illegal. He didn't have enough weed or anything for trafficking, they just found a good amount of paraphanelia in the house and a bag he had full of celephanes that was mainly used when he was buying weed off someone and needed a baggy.
Anyway, I'm trying to find some good documentation on the legal status of spores and/or how spores don't contain any scheduled substances. I'd also like to try and find some info on what point during the mushroom's life cycle the psilocybin and psilocyn actually begin to be produced. ANY HELP IS GREATLY APPRECIATED. He goes for his preliminary thing on the 24th of this month and hopefully it'll be able to be settled then. Other info is that they got about 12 prints, 5 spore syringes, an empty grow chamber, and a pressure cooker. I doubt they know what the chamber and pressure cooker was for, but I'm not going to overestimate there ignorance. He didn't have ANY shrooms and hadn't even began to grow yet (who's to say he intended to grow though, heh). Anyway, please reply to this post if you have any info or incite on this situation.

The judge will know better, so will his public defender. If theirs nothing to worry about he shouldnt be worried..
In some states, counties are free to make their own laws about stuff like that, spores may be legel all over but a county can make it a punnishable offence if they want...
