WOAH, Searched and Warned after hunting in state park!!

Wow, so for the first time, I'm really glad I didn't find anything. My *former* hunting ground is a huge cow field in a state wildlife managment area. The land is open to the public, which is why I have always driven all the way there to hunt--to avoid law issues.
Well, yeterday, I spent about a half hour trudging through the fields, and somehow didn't find one mushroom. (After tons of rain, I guess the field is taking a break or something..) When I got back to my car, there was a white pick-up truck waiting there, and it pulled in front of me as I walked to my car. An armed wildlife officer jumped out and said "Let's see your mushrooms!"
HOly hell. Thank God I hadn't found any. He thoroghly searched my backpack (filled with paper bags, rubber gloves, scissors, wet towlettes, and a perscription bottle which I forgot was in there, luckily he didn't open it..)
He explained that taking any plant out of a wildlife mang. area is a 2nd deg. misdemenor, and ended up issuing me a written warning for "attempting to pick mushrooms."
I have to get it framed!
SO-- just a warning to anyone who may think they're hunting safely. Always hide your finds before you get back to your car, then make sure you're clear before retrieving them!
note: This happened in Indian River County, Florida.
STAY SAFE!!!!

why would you ever consent to letting them search you in the first place? Did you admit to hunting? When confronted by the law, you dont have to tell them what you were doin...jus answer questions with questions of your own...and take advantage of your 5th amendment! If you didnt say anything, you should of told em you dont consent to any searches, and ask if he is detaining you, or if your free to leave. And as i heard before, get a camera from a buddy, and if confronted later on...tell him you dig photography.

Yeah trespassing in Florida to get mushrooms is no joke.
The cops down here, and the mushroom pickers, don't mix too good.
I hear crazy stories all the time about coppers busting on shroom pickers.
It's unfortunately, entirely too insane of a situation to pick those magic mushrooms in the cow pastures.
Florida is not mushroom friendly for the most part when it comes to the dung loving Psilocybes and Copelandia. People are crazy about it and they will get the coppers involved trying to catch shroom hunters.
Land owners form alliances with the coppers, and the coppers will be very sneaky to bust mushroom pickers for trespassing.
Trespassing is a big risk to take for mushrooms. Land owners I have talked to say that mushroom hunters are a big liability issue for them.
Anyways, Floridas shroom season is starting very late this year. People should start finding them in decent numbers pretty soon tho.

Yea, the only thing you need to watch for is where you put your car, if the cops have anything on you its your vehicle, if they have suspision of shroomers they're deff not going to come in the field themselves and chase you on foot, the fields down here get endless and are surrounded by woods mainly and it'd be nearly impossible to catch someone unless all you had to do was wait until they came to get their vehicle... Thats the problem I face, is my truck, but I dont mind parkin it half a mile away and running the rest, but that turns into a diffrent story with a bag full of shrooms in your hand. If you're good though you'll know how to not get caught.. Its instinct.
P.S. Never fkin let them search you, please. You're just letting them take advantage of you for no reason.

Good to hear it didn't go worse for you And thanks for making a post. I get my edibles from elsewhere, so, I'm not motivated to tresspass. But, the mushrooms still call to me. I find myself irresistably attracted to the fields, they're just so beautiful! But the thought that I may be out there thinking everything is going good and finding LEO at my truck when I return has definitely kept me out. *LEO and the horses, LOL. There are cubes growing on horse dung right down the street. I've tried at different hours of the night to collect them, but the horses have made it clear that they don't like me being there

That's crazy. I guess that place is a known area. If I were you I'd stay the hell away from there. People must have been busted there before.

The law always freaks me out. Thank god that's all that happened to you. Anyways I bet if you had some mushrooms on you all you would of had to do would have been to split them with the cop. Sounds to me like the guy just wanted to trip, but was to lazy to go picking. J/k o'course!

hey, was away from my comp. yesterday, thank you all for your concerns!
In response to why I let him search me, I did ask him if I could refuse and he said no! Any bags entering or leaving a nat'l wildlife area are subject to search w/out consent or probable cause. (he gladly showed me the law on paper). But since I knew I had nothing I wasn't too concened. I guess he believed me when I told him I had nothing in my car; he didn't search it at all. Also, I did have a camera with me, But I didn't even bother trying to tell him I wasn't looking for mushrooms lol, he knew damn well. As far as tresspassing, that wasn't it at all. The land is open to the public, which is why I would drive the 30 miles to get there! Last time though.
^^ "Is mushroom hunting considered game?" lol! Apparently not. In fact, he mentioned as he was writing my warning (not drug related, just taking plants out of WMA) that the only things I can take out are pictures. I sarcastically replyed, "And dead animals if you can shoot em.." He said, "if you have a license"
Oh well, I too am glad it turned out ok. More of a thing to laugh about than anything, but it certainly made me realize that we're a persecuted culture, so to speak. again, stay safe, and have better luck than me out there as far as finding anything!

For all those interested, many public parks and wildlife management areas allow the collection of berries, nuts, mushrooms, and pine cones. Some do not. There will usually be a sign near the park office or trail head listing the rules.
It's always good to know the law, especially if you plan to disobey it.

Wise words indeed shroomydan; I'd say that's the only time that the law is important, when it's disobeyed.

"attempting to pick mushrooms."
HA HA HA HA HA.
how can you be issued a warning for a non-crime.
there were no mushrooms, how could you attempt to pick what was not there.
do they give you a citation for attempting to drive a sofa while intoxicated? last i checked, it doesn't qualify as a vehicle.
you should go back again and again, picking gear intact, and pick nothing, just walk around pretending to. stick it to the man.
if they ask why youre pretending to pick mushrooms, say someone jacked your warning and you want another.
