It is also illegal to remove any living plant materials from any public park or place, not just mushrooms.. on State or Federal Property.

Howeve in Oregon you can purchase mushroom picking permits from logging companies who let you into two or three clearcuts to legally pick mushrooms.

If you pick flowers in a state parkl you can be arrested. Those laws have been in effect for many years.

Even her ein Seattle one can be busted for removing plants a and mushrooms, bark mulch or wild animals form their habitatz.

And here in Wshington it is also illegal, and again Weyerhauser sells mushroom permits for about $35.00 a year.

It was actually washington. people got mixed up cause it was down on the border at cape dissapointment or fort canby (Pacific county) on november 22nd... They were azurescens and I have a mcdonald's bag full of them. I ditched it in the brush but apparently they noticed and pulled it out. I'm still kicking myself over that. I should have just suffed it down my pants and not allowed them to search me cause they didn't have probable cause.

As many of you may or may not remember, I got caught and have a large thread somewhere in here.... Here is my two cents from experience

If you have money, get a good lawyer. I got off with absolutely nothing... and they had a lot of shit on me...

But you most likely wont have a felony. You can plea bargain this yourself down to a misdemeanor with some strings attached... but should not get a felony.

But you have to know what you are talking about so call some lawyers who have free consultations. I wouldn't suggest telling them you have no $$ right away though.

I think it's just the ease with which they can arrest this type of drug consumer. They know that meth and coke are far more dangerous substances, but the easy bust is the harmless stoner. Fuckers.

so I went down friday and it wasn't too bad at all. They didn't ask me what I plead yet and told me that it being my first offense I'm only looking at 0 to 6 months in jail so hopefully it will be at the 0 end of things. They gave me a not guilty plead and appointed me a lawyer but she's from fuckin oregon... I feel a lot better now though. My pre-trial is on the 18th of june and my trial is somewhere in august. I haven't gotten a hold of my lawyer yet but I'll keep you guys updated... by the way, can anyone tell me what a normal lawyer costs?

what property was it was it state or federal property, my advice it to look up the laws of that state and if its a state or federally protected land then its easily a felony, but if its state you might be able to fight it anyhow look up the laws, like my dui in georgia, i didnt know that i could ahve refused the sobriety test and lost my lic for only a year! but seeing that i didnt i lost it for 3 years, and on top of that i could have repealed it and got it back in 90 days. if i denied the sob test, any how my point is to look it up

take that time to research the laws, its there they have to have assesable < spell check, its there im telling you look it up under controlled substances, by the way if i can remember right in 1934 or sumfin they passed a law banned mushrooms, but they mispelled the term psilocybe or what ever term they were using back then and then they kept on adding to that law, in other words its not illegal in a way, and tehy never redid that law cause the law got so big before they relized that they misspelled a few things! i cant remember for sure what all it was but i know those facts here are pretty much legit!

^^^ I smell probation coming. I seriously doubt they would hit you with a felony for you first offense. Something similar happened to my father where they initially charged him with a felony, but was later dropped. They tend to always throw the big charge threat in there to scare the piss out of you.

Once I got reckless driving. Took strait to jail, and was told I would spend 11-29 (11 months, 29 days) in the workhouse. Ended up with probation until I paid my fines. The 2nd time I got reckless driving I only got driving school. (honestly, the first time, I was reckless. The 2nd time I accidentally squeaked my tires on a right turn, and got reckless driving. If I had wanted to burn the fucking tires off through third gear I could have, but 'twas just a little squeak). Not really the same situation, but they always throw the maximum punishment at you first. Basically I think they are just trying to make you do something stupid and rack up more charges, or prove youself quilty in your own words (use them againsed you in court).

This is the drug war we are all part of. All of us (even non-users) are affected by these bullshit laws. All that ever happens is the government makes money, siezes our property, and ruins our lives. Meanwhile that crackhead on the corner that has nothing continues to harass you for a dollar everyday...

Here we have another case of urban legend and misinformation provided here by JoeyBond who does not know what he is talking about.

I should explain. The chemicals in Psilocybian mushrooms were named for the genera of the mushroom.

No one knew there was psilocine/psilocybine in Psilocybe species in 1934.

The chemicals were not discovered and named until 195l by ALbert Hofmann who also discovered LSD.

Please do not go about spreading misinformation at this site.

And Psilocybe is not a term. It is, in fact, is a word, not a term and Psilocybe is the genera of which there are more than 115 know species of mushrooms containing the alkaloids psilocine/[psilocybine.

Why would you think they banned the mushrooms in 1934. Apparently you do not know what you are talking about.

And where did you get the idea they banned Psilocybe in 1934 when no one knew what was in any of the shrooms since they weren't rediscovered until the early 1950s and the chemical substance was not known until 1958. 24 years after you claimed they banned the term (sic!) Psilocybe.

shit i got my lic sus more han 5 times on points violation all tehy wanted was my money but when i said no they caught me running from the police, reckless opp, dui, sus, lic, speeding, a few other things
all i got was 14 days in jail
they threatened 3 years in jail! i got three years on probation lol

I must totally disagree with that MJ. I know for a fact that it is perfectly legal for you to pick mushrooms in Yellowstone, and it is also perfectly legal to eat nuts and berries you find there as well. Yellowstone is my favorite place in the whole US, I have checked on these things. After the fires in '88 they had to issue mushroom permits because so many people came just for the mushrooms. But normally you do not require a permit...

Killing an animal, removing a plant, disturbing habitat, or littering will land you in some serious trouble.

Also, here in Michigan where I hunt is a National Forest. If it were illegal to collect mushrooms from state land, DNR would have a field day busting people out there (or anywhere that is state land, which is everywhere around here). I don't think DNR would just be "looking the other way" on this because they will get you for anything they can around here. People come from all over the country to hunt mushrooms there, and the weekends can be quite busy. I think it all depends on the actual nature of the park (there are wildlife preserves you cannot even enter here, let alone pick anything), the state you are in, and what you are doing there.
