Yesterday the court made it legal for k-9's to be used w/o consent.
So here's the fear, they can have dogs at check points, around parked cars, and were ever else they see fit. "there goes the neighborhood"

It's not that they have the right to do it without concent. The never needed consent, just probable cause. Now they don't have to have probable cause. I don't see this as a huge deal because probable cause is often bs anyway. Before all a cop had to do was say that a person looked nervous and they could have brought the dog out.

And to address the last part which I missed , it's is still only allowable to use the dog on vehicles in the case of traffic stops, at least relative to the new ruling.

seriouslly lately iv been contemplating moving to canadia (i know how its spelled if you dont have a sense of humor) more and more, and each time I inch towards it more and more.

Everything you claim above is false. K9's could always be used with out consent, this is nothing new. The ruling simply states that if you get pulled over for a non-drug related driving offense, the police can use a K9 to search for illegal drugs without cause. The ruling does not give the police permission to use a K9 to search for illegal drugs without some other violation happening first. In other words, they cannot pull you over for no reason to use a dog to search your car... but if they pull you over for not wearing a seatbelt, they can then proceed to use a K9 to search for drugs. The ruling really doesn't change anything, but does take away an avenue that the defense could use to try and get somebody off after a bogus search.

What really bothers me about this is the length of time one can now be detained for a simple traffic stop while the police wait for a K9 to perform a search. It also encourages police to make bogus traffic stops in order to search people that match a 'druggy' profile. It also bothers me that the police can perform this search on a passenger in the car while it was the driver the broke the law resulting in getting pulled over in the first place.

What happens if the police pull you over for an apparent offence (e.g. having a seatbelt undone) but it turns out you in fact had it buckled up, and they were mistaken? Can they still search your car with a dog? If they did, would the evidence still be admissable in court?

I'm just curious....

This court decision is only formalizing what was already in place. Someone probably got busted, but found a loop-hole by saying that they had been searched by dogs without consent in a public place. So now they're covering their asses by making it "writtingly legal" for a dog to search without consent.

Besides, when is the last time you heard or a cop asking permission before they have something searched with a K-9 unit. They still need "probable cause" and a search warrent before they can search your home or private property anyway.
