it was either that or get tickets for being on public property after 10, and tresspassing
me and my friend kimmy were bored out of our skulls and we decided to go chill on the village soccer fields, we parked at the train station and walked over. un-known to us people had been breaking into cars at the train station and also robbing the vending machines in the park... so we were sitting there, and saw the cops come around 5 or 6 times, we were ducking laying flat on the field so they wouldnt notice us... after they left (or so we thought) we headed back to the cars and started driving away... well they were hidden waiting for us. they blocked us in, and started bitching at us. they asked if they could search my car (since they had searched hers while we were in the pack because it was un-locked) and i said no. it came to the point where they said they would be giving me 2 tickets for trespassing, which i was guilty of.... if i didnt concent.even after telling him how much i did for the town (im an eagle scout and have done soooo much comunity service in that park alone) so i told them they could search the cab only
i had 4 new glass pipes, brand new in the trunk, that they decided to check on their own, they confronted me and asked how i got them, i told them that i traded some cd's for them, and that they were for tobacco. so they let me hold on to them and did not charge me or her witih anything and let us go.
there were also shroomery business cards in the back seat. but they didnt say anything about them, im sure they noticed though.....

i knoew i was clean and legal, i have nevre once been arrested, ever. and i out alot of work into keeping it that way. i rarely even travel with anything illegal, and when i do its well taken care of.
plus i only concented to a search of the cab, which did not include the trunk so if they decided to press some charges on me bcause of the glass pipes, i could have contested in the local municipal court that i did not concent to a search of my trunk.

I may be incorrect, but I think you can only consent to some or all of a search of your vehicle.

Actually, I think I remember learning in my law class that you can in fact consent to only a partial search of a moving vehicle. For example, if the officer asks for consent to search, you could technically say, "I consent to a search only around objects beginning with an 'S', like a Steering wheel." Although that would probably really piss the cop off and they would end up searching your whole vehicle, though illegally.
The law is fuzzy around this subject, and frankly, I doubt anyone would want to test it.

yeah im very sure about this. i made it very clear to him that he could only search the cab, but knowing that he would search the whole thing anyways. but at least this way i would have had a defense in court had he chosen to prosecute me under the local paraphanelia ordinance, which i actually just looked up in the library.

Why did they bother searching after you told them they couldn't look in tha trunk?? I mean if you had stolen goods you would have told them to look anywhere but where they were kept!!??

Every state may be different, but here, your trunk is treated as a seperate entity from your car. (sorry if you have a station wagon or SUV) If you really wanted to be a dick to the cops, you could make them wait to get a search warrant to search your trunk. If you make em wait though, you better not have anything in there, otherwise they will be huge hemmroids. And if they searched your car and moved on to your trunk alone, you may have some room to argue illegal search.

Hahaha
It's true, the law is pretty fuzzy about 4th amendment search-and-seizure procedures. Here's a case to read (unrelated but very interesting): ILLINOIS v. CABALLES Justice Ginsburg's dissent is quite good. Also note that Caballes was only going 71 miles per hour (6mph over the speed limit) and he got pulled over. Better drive exactly the speed limit when you're carrying drugs!
Pretty scary huh? No reason for suspicion, and yet the cops got away with it.

yes, but with the dog thing, they cannot delay you longer than it would take to write a ticket. i think that caballes v illinois is actually the case that went to the supreme court which made it legal nation wide for these warrentless dog searches.

I know for a fact that cops cannot search a locked glove box or trunk if you do not give them permission to. I said a cop could search my car (knowing I had a LOT of shit locked in my glove box) and he didn't find anything. He arrested me for the weed I did have in my coat, and then went through my pockets while I was handcuffed. He took out my keys, and used them to unlock the glove box and take out my shit.
Couldn't press any charges because that was hella illegal.

Here in South Africa, I got pulled over once, after apparently scoping out my dealer and being seen buying some weed.. Cop gets out of his car with a machine gun in his hands pointed straight at me locked and loaded ready to fire, and screams and swears at me to get out of the car, at which point his partner proceeds to search my car before I even have a chance to say a word. They find the weed, put handcuffs on me, put me into the back of the cop car and take me to the station.
I was out about an hour later after paying a bribe.
I wish I was given the choice to consent to the search haha. I hate my country sometimes.
