I've been watching this thread and although I have mixed feelings about it being in the pub, im going to leave it open for debate as long as it stays civil.

mj,
you'll get zero.

why not allow MJ back on to state his case if he can do so in a civil manor, I agree with john that the cubes are cultivated, I disagree that they donot grow on horse poo as I have several horses in one of my pastures and do on occasion find a few

MJ mentioned the base as not having a 'straw', I noticed they were far too clean, another point he was incorrect about was the 'white out' on ffingers and shrooms
Quote:
ANd again, I can understand someone blockingout or whiting out their fingerprints, but why were portions of the shrooms whited out. And they are whited out and it is as plain as day is light.

whats plain to me as a former photographer that has worked extensive ly in digital and film is that the camera was a digital and has a white balance problem with the use of the flash, it results in hot spots on parts that are brighter or closer to the lens when a strobe is used...

I know its your board hippie, you set the rules and since you had edited the first post from john tis really had to make an accurate assesment as to how out of line he was but, as mndfreeze had said, regardless of whether he posted the pics or not, he has the ability to recind permissions on the images that he holds the rights to... here is a small reference, Cornell overview on copyright law digging a little deeper you my find that your disclaimer is worthless and that john can charge a royalty for each image on each CD you produce...

this is an arguement that has been happening in OTD a great deal lately, I'm no lawyer but I am a photographer, a great deal of my photos are used with and without permission on the internet and in magazines, I have been through it before... think very carefuly before you lose out on a great deal more than you may initialy believe.

again, give him a chance to make a civil debate with the original poster regarding the 'found' mushrooms, you may find that john is right but has handled it poorly

As far as the legal aspects are concerned, MJ's lawyer is right -- since it's copyrighted material there need not be any formal notice -- Hippie3 has the responsibility to prove that the work is, in fact, not copyrighted, since he is the one selling or distributing it.  Neither ignorance nor laziness precludes this legal responsibility.

As for my opinion on the rest of the situation:

Join the fucking club   Hip banned me, too, for some sort of trivial transgression, but since I have never really liked him or his site in the first place, I haven't much cared.  As to mushrooms growing on frozen horse patties in Alaska I'd say it sounds quite strange, but no stranger than other "proven facts" that have spawned from his site, such as the photographically proven fact that mushrooms (as well as the mycelium, itself) grow off of salt water in petri dishes.  I left his site (by tantalizing him to prove to myself his totalitarian views) in order to force myself away from all that nonsense.

Thank you ripple for keeping the forum thread open. AS I noted above I was not sure exactly where to post this because i was interested in others advice as to the legalitity of Hipies disclaimer notice and if it was or not binding in court.

I did not deny in any way that I said some rude and gross things to hippie3, but again as I noted above I did not in any way remove or delete a single thing hi said I said about him when he posted what he would not allow in his forum site.

And it was he who removed a whole post of mine which I first posted about the story fo the Alaskan cubes.
AS for cattle and horses in Alaska, someone should go to google.com and bring up "Cows in Alaska or Bovines in Alaska, then try dairy or cattle farms.

I think some will find some interesting facts about cows in Alaska.

For one, they are referred to as moose.

Here I was attempting a little humour at the transportation of cattle to Alaska from Florida or Texas when there are more valuable cattle available in most states closer to Alaska than Texas or Florida.

Sure there is probably a horse farm, but they were cultivated shrooms which had most likely had the compost from a terrarium or aquarium dumped out doors. I have also posted similar pictures of cubies in the woods in woodchips in Washington near where PF lives. and they grew a few flushes and did not return. Since I am not at home I cannot post them to show them.

I also noticed that SeVen , the origianl poster of that wild alaskan cubes four days later posted another outdor patch of shrooms he thinks may be gulf coast shrooms, dumped outdoors he said but was not sure which strain they were that he dumped outdoors so that shows he has dumped composted shroooms outdoors on previous ocassions so him walking into a strange field in Alaska where people might use rock salt or buckshot on private property, something valued in Alaska by its citizens, is rather strange.

So he likes to say they came from one place and then another, rather than were they really were grown at.

I too admit I haev picked shrooms on one side of Seattle and posted them as from another area. But I do not post shrooms and say where they are growing where they normally would not be found. I did that in response tot he kid who last year posted an exact lcation of where Itook him shrooming, which Thor and others deleted.

Known species of Alaskan shroms include:

Amanita muscaria
Psilocybe cyanescens Wakefield. (Guzm?n, 1983; Stamets, 1996, one time only from transplant).
Panaeolus ater (Lange) K?hner & Romagnesi. (Pollock, 1976).
Panaeolus subbalteatus Berkeley & Broome. (Miller et al., 1982).
and they are really the only magic shrooms in alaska, having been deposited in herbariums for several years by several collectors so they know those species are there.

P. cubes are grown there indoors in vitro incllars, basements, nook, crannies and attics.

mj

Appreciate the comments from all.

Thanks

I think a MJ, a respected member at the shroomery has every right to post this concern hear. Requesting the pubbers input on this dilemma is not an act of question IMO. Where else is he supposed to post it, OTD where it gets flushed out within a few hours with no serious responses, Support Group....where few actually go not mentioning hes not asking for emotional support.... I know the pub is just supposed to be chill happy talk and Im not directing this only at you Alounacara but if you guys really despise the topic, is it really that hard to just ignore the thread?

Quote:
The fair use doctrine is a privilege in others than the owner of the copyright to use the copyrighted material in a reasonable manner without his consent. The reasonableness of a use is determined on a case-by-case basis applying an equitable rule of reason analysis. There are four factors in determining whether the use was a "fair use": 1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; 2) the nature of the copyrighted work; 3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and 4) the effect of the use upon the potential market for or value of the copyrighted work.

mjshroomer posted the materials on mycotopia
for educational purposes,
and we continue to use those materials
for educational purposes under
the 'fair use' doctrine quoted above.
if mj wants to spend the money and time
to drag this into a federal court,
he will ultimately lose.

a wiser choice would be for mj
to apologize for his rude, unprovoked attack against
our member, Seven, whom mj flamed,
and for his threats against my family and myself.
after said apology,
i'll reconsider his expulsion.
until then,
i've already conveyed my sentiments to him
via PM here.

Sounds like the beginnings of a negotiation.

John?

At the very least you did say that the things you said about Hippie3 and his family was rude and im sure you will admit wrong.

I've tried to stay out of this because of the respect I have for both of you but I believe this can be fixed if level heads prevail.
