no one should be put in jail for refusing to serve anyone -- a fine for discrimination, on your establishment, suffices as a punishment.

laws exist for a reason -- discrimination laws are no different. freedom of religion dictates that, in the public sphere, you have to adhere to a modicum of respect for other's beliefs (wait, the punchline is approaching), even if you outright hate them and speak ill towards them and their religion/beliefs, by at least not discriminating against them in terms of services and goods, because in a free country, you don't do that, that and no one wants to expel people from the marketplace due to their...hair color, or their insistence of the existence of Gods, or whatever the case may be...hell even if someone is stinking up your establishment with their colitis...WHAT the fuck are you gonna do about it?

1st amendment - Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech (a hair style would fall under expression of this particular right), or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

ie no governments in bathrooms because of people's non-harmful expression. ie also, note the end of the clause. no one wanted her out of the bathroom...the police were morons and did not listen. they are legally bats.

You do realize that that says congress will not do those things right? Businesses are not congress. Aside from that, not serving someone doesn't limit their freedom to express their religion. No one's religion says "go out of thine house and shop".

Lolno. All it says is that congress can't make any laws respecting any specific religion or laws that interfere with religious exercise. Businesses are not congress and they do not make laws.

It doesn't say anything about me or any other private citizen. It says something about what congress cannot do. Just because the word "respect" is in the sentence doesn't mean that I have to respect shit. The constitution isn't metaphorical. It means exactly what it says.

businesses that are funded with public interest by public tax dollars is a state affair. you can just deny that if you want. but that's neither here nor there, in reality. perhaps a petition should be filed to tie up the ambiguous language in the 1st than, if you don't think that state powers should be subject to the establishment clause, like it says in the establishment clause.

Whether or not businesses are allowed to discriminate in provisioning their goods and services has nothing to do with the first amendment. That's what I was replying to, not the bathroom laws. I don't know the details of the bathroom laws.

yeah, by services, we were talking about the services of the public washroom facilities. not about goods.

in privately owned business you can deny services to whomever, why, because it's not discrimination (unless you make it explicit of course) to deny anyone any service or employment that you, as a private business owner, would wish to deny from employment or service -- because you are not beholden to the public as a service for the public.

see: private firms -- schools -- plumbers -- electricians -- ect ect ect

"Public" washroom facilities that are located in private businesses are not actually public. Many places only let you use the bathroom if you're a paying customer. Anyway, how is using the bathroom religious expression?

but it's interesting because as part of the 1st amendment, there is a total separation between church and state, and yet private business are openly discriminating against people for being gay or whatever due to their religious beliefs. that's violation of the 1st amendment on the grounds that the state is supporting the decision to discriminate based on religious grounds; it could be argued that it isn't "state" law that defines this, but it certainly is state law that justifies it. it's an inherent contradiction, that should be addressed, and rarely is. but nevertheless, to avoid the obvious confusion...there should just be anti-discrimination laws...oh wait there is already. so between to the 14th and the 1st, according to them, there is some obvious blinders being placed on the heads of certain old people, and certain credulous idiots.

Dude, I don't even know what you're talking about. Where is there a business that is discriminating against gays in not letting them use their bathrooms but still letting them buy shit? That's not happening.

So the state not forbidding discrimination on religious grounds means that the state supports that discrimination? That's nonsense. The state doesn't make laws discriminating against religious people. That means the state actually supports those religious people. But wait that's against the first amendment. But they can't make the laws discriminating against religious people because that's against the first amendment too. Well shit, I guess everything is against the first amendment.
