This has nothing to do with a majority v. the individual. The word in question here is "desire" and how it is defined. You have previously said that if a person watches a TV show then they likely desire to watch it, but if a person watches an ad, they don't. Why are the person's actions (which are extremely similar in both cases) leading you to two very different conclusions?

This, in my mind, is crucial to your definition. Unless you want to take a survey for every piece of new media that comes out, you need to have an objective way of defining whether or not people desire to watch it.



You seem to think that approximately 50% of people want to have paid political content added to the programming or publications they are viewing and that it's going to be a tossup each time paid political content comes on.  I say let's take a poll on The Pub, and see approximately how many people would like to have paid political programming inserted into the program or publication they are watching.  I'll bet it comes no where near 50%.

Because if I desire to watch basketball, I'll turn the tv channel to the basketball game.  If I desire to watch political ads, I'll go to the Internet to watch all the political ads I desire.  Sure some people might like both, but it's not 50%.

Let me start fresh and try to explain this a different way, because I'm clearly not explaining this in a way that makes sense to you.

My argument, summed up is: your test is subjective. There is no two ways around it. Your definition is based entirely upon whether or not people desire to watch something. You could measure this objectively with a survey for every new piece of political content produced, but that is completely unreasonable. Since we can't measure it objectively, is there another way we can determine it? You say yes; people never desire to watch ads (or at the very least, a majority don't).

Your definition for what a person does or does not desire to watch thus hinges entirely on how whether or not the media in question is an advertisement. I've asked several times now, and I've yet to see (maybe I missed it, if so, link?) how you define an ad in an objective manner. Just like you've offered this definition for how to determine if something is political, you should provide a similar objective definition to determine if people are desiring to watch something. I disagreed with these statements earlier, but I very much agree that right now your definition is a "I'll know it when I see it" one, and that just won't work.

Does what I'm saying make sense? You need a way to describe things objectively and saying "a majority of people will never desire to watch ads" without even defining what an ad is, is hardly objective.

How unreasonable of me to not want to send people to jail for non-violent speech. And once gain, I am not arguing that point. I am arguing that your definition is far to vague and subjective.

TV stations already have a monopoly on television. That is the only place they would have a monopoly. If you want to get rid of that then you're really going to be limiting speech.

I think you're posting on the wrong thread.  This is about limiting campaign spending, not one person want to censor any specific content.

I see what you're trying to say.  We disagree about the how subjective this is, but I understand your point.

A real simple answer, though I think some people didn't like it, is that if you pursue the content (political documentaries, newspapers, etc), there is no limit, but if the content pursues you (paid ads before or during a movie, paid ads in newspaper, etc), then there is a limit.

But the issue is not how precisely you can tell, it's that you can't tell at all. You can make assumptions, but I don't want laws based on assumptions, especially not ones that could send somebody to jail.

In my opinion, the definition should be a concise description of objective criteria that a statement has to meet before a punishment is allowed. Just as an example, the criteria could include a way to objectively define that the statement is political in nature, that the statement is meant to be persuasive (i.e. an advertisement), and that it's funding was the result of very lucrative donations from outside parties with a vested interest in making influential political messages. In example, I think criteria 2 and 3 are hard or impossible to define objectively.

With your definition, one of the criteria that a statement has to meet is whether or not the statement was 'desired'. That's not objective. I can't simply state the message was or was not desired because I have no way of measuring it without a survey, and taking a survey for every bit of media a company/individual makes is completely impossible. We can assume the message was or wasn't desired, but that's not objective. Who has the power to make the assumption? What are they basing it on? How do you prove they were right/wrong without tracking down a population of the viewers and asking them? Etc. I'm not okay with a system that is so open to interpretation.

I can't offer a better solution at the moment, and quite frankly, I've thought about this problem for a while now, and I don't think there is an answer that will be completely objective and specific enough so that it doesn't infringe on the right of free speech. I can assure you that the current definition you have is not completely objective. However, I would love to see such a definition.

Can you define how content pursues people? The entire reason content exists is so that people consume it. All content pursues people in some way or another because that's how content earns money, by convincing more people to consume it.

For some reason you guys think fines won't work. It will become the cost of doing business, but as any economist will tell you, when the business costs too much and isn't providing the proper return on investment, it dies.

Massive fines and/or sanction on business would work wonders for making the cost of political ads just far too high to be worth it. Keep in mind here, when I say 'massive' I really do mean outrageously high penalties. Why do you think that wouldn't work as a deterrent?
