Auto-SummaryA woman sued McDonald's for $800 after spilling hot coffee on herself, and after initially offering only $800, McDonald's offered $2.7 million in a penalty. The woman received over $2.7 million due to the company's negligence in serving the coffee. The author criticizes this as an example of personal responsibility and excessive litigation, arguing that companies should be held accountable for their products' safety.

The rest was paid by McDonalds because they were negligent and partially at fault for her injuries.
You're welcome to keep crying about it though.
I'm not crying. But she was. She purchased the same hot beverage that thousands and thousands of other people purchased but managed to handle successfully.
I had a friend many years back who was at a restaurant where the server slipped and poured hot coffee on her. She got burned. The coffee wasn't "insanely hot", it was just hot. She did sue, and won, because the server was negligent in handling the hot beverage, NOT because the beverage was hot. Assholes like this stupid bint who burnt herself, and her enabling fuck litigator fiends, are part and parcel of the decline of personal responsibility in this country. Scummy lawyers who think every injury and sad story is somehow cause to make somebody else pay are a plague.
Dude, do you not understand how hard on them self they made this case? McDonald’s could have offered to pay the $10,000 instead of the $800, and dropped it at that. Then later it went up to over $100,000, still they could have paid it, but offered her like $8000. What they offered was always short of what she asked. They were stupid playing a game. Finally after not paying the jury awarded her claim then also awarded 2 days penalty of total corporate coffee sales, hence she got 2.7 million dollars. Big fucking whup. They make $500,000,000 a year JUST selling coffee? The poor fucking babies. She could have been disabled FOR LIFE
I'm sick and tired of all these companies caving to every slip and fall shyster. I know why they do it but it is ruining commerce and adding tremendous costs to consumer goods. Ever buy a ladder? Do you see all the fucking labels on them? It is because of retards. Everybody has to pay for the la durr faction of the populace that doesn't have the sense to get out of the rain. You are not supposed to apply hot coffee topically to your groin. Most people know this.
McDonalds has 2,400 owner operators with 13,000 franchises. Of course they sell a shit ton of coffee. La durr. Just because somebody has money doesn't mean they are obligated to pay for somebody else's stupidityQuote: You always blame some bum for ruining the economy because he gets some shitty $1000 check every month for welfare. But when a company like AIG goes belly up and needs $80 billion, you don't think it effects anyone. You say it's a benefit to the tax payer. But let me ask you, even after it's paid back, what does the tax payer receive for money they lost in the time they were waiting for AIG to pay that money back? You wine about the consumer, well guess what, McDonalds is RICH BECAUSE OF the consumer. If they want to keep the sales rolling, they need a safer product, and they need to pay claims. It's that simple.
Knives are dangerous. If you cut yourself with one do you think you should be paid by the knife manufacturer?
Why do you persist in being so abysmally ignorant about AIG. The taxpayer made a tidy profit of over 20 billion dollars on that LOAN. In 2011 the governments of the United States of America gave away just about one trillion dollars in means tested assistance. I doubt much of that was in the form of loans that will ever be repaid. I don't have a problem with some bum receiving a thousand dollars a month. I have a problem with over a hundred million of them getting some form of largesse at my expense (The profit the government made from AIG paid 2% of the welfare bill for 2011. That doesn't count the taxes they and their employees paid. How much did you pay?)Quote: Otherwise I question their billion dollar enterprise and I question the premium quality of their restaurants and if they indeed do deserve the money in net revenues. You realize that if this was a health case, the government could have sued McDonald's for enough money to pretty much shut down like half the company right? It was a mosquito bite, they got cocky, they paid, in mosquito bite terms. The poor corporation.
Then don't fucking eat there. I suspect you should avoid forks. They are pointy.
$20,000,000,000 return huh? Wow you are good at math $20,000,000,000 thrown into a Ponzi spending loop Obama helps create where he spends over 1 trillion a year extra equals........... wait for it.......... wait for it............. wait for it.....................
NOT A SINGLE FUCKING PENNY BACK TO ANY DAMN TAX PAYER!!
For a minute, you thought I was going to fall for that one huh? I'm supposed to be getting as a citizen a nice little tax return on the $20 billion, I almost given a free million. I was pretty happy, oh wait that's not real.
Do you think a person who falls into a pot hole and didn't actually purchase a product in a parking lot and somehow falls and cracks his spine and can barely walk again should be scolded "you shouldn't have fallen dude", is it fair the company won't pay a claim of his surgery? His life is over, job, medical, it's at the whim of his credit. Why couldn't they fix the parking lot? Where is Obama care to come in and pay for it? Oh wait you disagree with Obama care AND paying claims? Ok so the guy is screwed.
Do you think coffee should be served so hot that a person spills it on them self and has 3rd degree burns and needs $10,000 of surgery and skin graphs? Wow, I've spilled hot water and shit on myself like a dozen times, never sued, but also never needed thousands of dollars worth of surgery. Shucks, maybe I didn't realize I needed the skin graph because I am too dim to realize how hurt I was. Last I heard, falling off a ladder doesn't guarantee you are going to break 15 bones just falling off the first step of the ladder, and need $10,000 in hospital bills. Last I heard if I cut myself with a knife, and aren't deliberately juggling the knives or aiming towards a vein, I can just put a band aid on the cut, or at most need stitches but probably that won't cost $10,000.
Was this lady doing some arduous task? Was she doing back flips with the coffee? Was she riding a bicycle? Was she even driving? Would it have been too hard to pay the $10,000 claim? Instead of $2.7 million? What's the hardest part? Here is the hardest part, for you to realize. Ok dude, since you know how the law works, understand this, and understand it well. If someone sues you, AND YOU OFFER A SINGLE DOLLAR TO THE PERSON you automatically admit you are wrong. If they wanted to pay her claim, $10,000 should have EASILY sufficed. Why offer to pay a claim and short change it? Most of these companies spend hundreds of thousands a year hiring defence law firms, they pay them to avoid paying claims. So why did they offer $800? To avoid paying a large amount? Real bright, they pay these fucking law firms to keep them out of trouble, then offer an amount not suffice to suddenly show liability, what a great way to spend millions of years hiring shitty defence law firms.
Is it getting through your head yet? $2.7 million was a penalty of TWO days of the companies total revenue in coffee sales. The damn company makes $500,000,000 a year in coffee sales alone. You think she should have to cough up all the money for shitty skin graphs over a coffee cup, as though she was making it up? "Oh the poor corporation :crybaby: wahh, poor people all collect welfare they deserve their poor status"
It's what you sound like. Hey, not all people who are poor and make under $11 an hour, collect welfare, some do have kids, pay their insurance, spend every penny they have on their life and family, work 65 hours a week, and have shitty lives on shitty pay. I know you don't care, you think assuming company responsibility and taking care of an over head suddenly means employees are expendable and aren't worth the complaint. But not every company has a HUGE over head and I don't think a person on the bottom end of society deserves to be treated like a joke and be offered an $800 claim over a cup of coffee that resulted in $10,000 of skin graphs and shit, when if the company offers to pay a claim, it shows they are liable in the first place.
Sorry, this is a persons life, if they don't get surgery, a skin infection could occur killing them eventually or disabling them and preventing them from walking and being able to maintain a job and a living. It was a fucking mosquito bite in the long run for the company to pay. The owner of McDonald’s is still flying private jets and driving yachts and buying huge three story mansions with extra select gold Calcutta marble double stair cases and travertine stone around the pool, mean while a lady got compensated. That was a damn hot cup of coffee. I've spilled boiling water on myself before, and while the pain and burn wasn't minimal, and the amount spilled may have been a tiny splash or two, I didn't need $10,000 of skin graphs. I'll repeat myself, that was a damn hot cup of coffee. Do you not like the way the law works in a capitalist society as a Republic role modelled after democracy? If not perhaps you should try a socialist government, they aren't as big on claims.
I thought you liked democracy, you bitch about who pisses on it sure enough all day.
