Ohh right.... That is why pre-employment drug testing is illegal. It is not illegal to discriminate against drug users. It is actually government mandated in the United States that drug users not be allowed to do certain work, and governmentally encouraged that drug users be denied employment.



In the US its not illegal, where I'm from it is.

We don't have any interest denying jobs to addicts. It would only increase crime and result in them going to jail. That wouldn't be fair.

Therefore, its illegal to discriminate against drug users.

companies dont want to ensure for any liability, any company that hires drug
users which is why the tests are mandatory in many places, other pay the
higher premiums and dodge the testing because they know many of their
applicants and even best workers use drugs. the real drawback at least for
the user is that if you get hurt, they'll test you for workers comp and it
may not pay

in several of the jobs I've worked had I decided to get stoned
before work I damned sure could have been killed

Its generally not recommended to get high before going to work. I might get you fired. Or in some cases, like you said, killed or injured.

yep and with most drugs, how do they determine if you did it on the drive to work or the night before

Who said they would pay if an accident happened because someone was high?

If an accident happens, drug test the guy. If he was high, the insurance company doesn't pay. He took the decision to take drugs, therefore he took the decision to live with the risks and consequences.

If he wasn't high then the company pays.

Instead of drug testing at the start of the hiring process, drug test only when accidents happen. Drug testing before the hiring process doesn't stop people from taking drugs. We see it here all the time. They find a way to pass the test, then they get high 5 minutes after they get the passing grade.

Ask a doctor / medical examiner / forensics technician / investigators. There's a way for sure. If we can tell accurately when some guy died after finding a rotting body in the forest, I'm sure they figured out a way to know when a drug was taken given blood concentration.

If it truly is impossible. Ask a lawyer, he'll figure it out.

Oh right. They are simply gonna say no to billions of dollars coming from businesses because of drug tests?

They won't stand for legislation like that? If it passes, they don't have a choice. Its the beauty of laws.

And like I said... if an accident happens, give a drug test, than leave it in the hand of investigators and lawyers.

The real question I want to ask is why do you want to become a pharmacist?  If you can answer that with a legit question, such as you enjoy the study of medicine and want to eventually step up to it and make sure people are being safe and getting the right medication, and you don't have any major drug issues on your hands or any felonies and such, you're fine.

Someone said it was illegal to discriminate.  To clarify, private companies can easily reject you if you've got felonies or drug problems, especially if you're working in that field.  This isn't 'discrimination' in the sense businesses aren't supposed to commit. Businesses can't discriminate against sex, race or disabilities.  If you're a druggie and have felonies, they sure as hell can refuse to hire you.

someone comes in high and is involved in an accident either the company
or the insurance company has to pay? why not make the pothead pay, why not
jail him for criminal negligence resulting in injury, loss of life and loss
of revenue

you even said "he made the choice" so why should the insurance company pay
for some jackasses choice when they insure the business, not the individual

put the cart before the horse, brilliant. it's no different than drug
testing someone that gets hurt because someone else caused an accident
that resulted in a different person's injury

the current process doesnt stop them from taking drugs, it allows a company
to assess the risk and the consequences and refuse to hire because the
person could be a serious liability due to a drug addiction. if someone is
clean when they piss and get the job, nothing here stops them from blazing
as they drive out of the parking lot

Make it illegal for companies to do pre-employment drug tests in order to eliminate discrimination

If an accident happens and somebody gets really hurt, you need to investigate to see if there was negligence. If its determined that the company should of made it safer, then they get in shit. If they determine that the company had safety procedure and some guy gets hurt because he was high, the company doesn't get in shit and the employee doesn't get paid due to his own negligence. Or even worse, someone hurts somebody else because he was high (forklift operator was high and impaled another guy), thats called criminal negligence.

Many factors are more important causes of job accidents than drug use. Failure to follow proper safety measures is a primary reason for job accidents. Fatigue and stress are much more important causes of job accidents than drug use.

You also have to take in consideration that a majority of drug users don't go to work high because they could get terminated.
