An Ontario appeal judge has challenged a conservative religious coalition’s suggestion that Canada may just have to put up with safety threats to sex workers for the greater goal of stamping out prostitution.

“Most reasonable people consider prostitution to be immoral,” Ranjan Agarwal, a lawyer representing the Christian Legal Fellowship, Catholic Civil Rights League and REAL Women Canada told the Ontario Court of Appeal on Thursday.

Parliament was trying to stamp out prostitution when it passed laws that ban brothels and prevent sex workers from hiring bodyguards, he argued.

And while the possibility that women may be exposed to the risk of harm is a “sad side effect” of the legislation, Canada is “stuck” with it “notwithstanding the terrible consequences,” Agarwal maintained.

“I don’t make that submission lightly,” he said.

Last September, Superior Court Justice Susan Himel found the legislation infringed the right to security of the person because it exposed sex workers’ to risk of harm.

“Assume we accept the findings of the court below, that the legislation puts people at risk,” asked Justice David Doherty, interrupting Agarwal’s submissions.

“Are you saying that could somehow be justified by the criminal objective of trying to eradicate prostitution . . . At the cost of ‘x’ number of lives? Would that be okay?”

“You’re dealing with complex considerations,” Agarwal responded.

But there could well be “a consensus” that it would be better to “send a message” that prostitution won’t be tolerated rather than scrap the law, he said.

Meanwhile, a coalition of sexual assault centres and organizations representing female prisoners and aboriginal women are also urging the court to reverse Himel’s decision and restore the legislation.

“Criminalizing men who buy and profit from the sale of women is entirely consistent with principles of fundamental justice,” coalition lawyer Janine Benedet argued Thursday.

The federal and Ontario governments are appealing Himel’s decision, which found the prohibitions deprive sex workers of the ability to protect themselves.

Earlier this week, lawyer Alan Young told the court that decriminalizing brothels and other activities associated with prostitution wouldn’t bring every sex worker off the streets. But if it saves one woman from a predator like B.C. pig farmer Robert Pickton then reforming the law is worth it, he said.

“Even if one person moves indoors and does not end up on a pig farm (attacked by) parasites, then something good has come from a change in the law,” he argued.

Young represents three sex workers who succeeded in having three anti-prostitution provisions in the Criminal Code struck down as unconstitutional last year.
