Another Jury Duty Q
    #8607067 - 07/08/08 05:02 AM (15 years, 9 months ago)

...instead of hijacking the other thread I figured I'd ask in a new one. What's the easiest way of getting out of it without not showing up? I'm scheduled for the 18th of this month and besides not wanting to do it it all, I really can't afford to miss work.

I thought your employer (if you're in the states) had to pay you if you have JD.  Anyway, they ask lots of questions during the first round of interviews, and maybe if you're honest they'll send you on your way.

I think the courts actually pay you like $10 a day or something ridiculous like that, I don't think the employer is obligated to pay, they just have to give you the time off. I could be totally wrong about that though...

your employer has to pay you for the time you spend on jury duty,
what's up with people that dont want to do their civic duty,
should we revert back to closed bench trials, no juries, just
convictions by biased judges?

I dunno, I just don't like situations like that.
You are right Pris, it is a civic obligation and I should just suck it up and go...I guess if I were compensated for at least the amount I would be missing from work I would probably do it.

the court pays $25/day, your employer has to pay you, you cant
be penalized for civic responsibility

Thanks, I'll have to look into it. Besides, come to think of it, I would much rather be sitting in an air conditioned court room (in a jury chair as opposed to the defense) than work all day in a hot kitchen...

Good for you, if you're not going to fight it. I've never understood why everyone gets all pissy over jury duty.

> What's the easiest way of getting out of it without not showing up?

It is a fine line.  Judges get really annoyed with potential jurors that try to get out of jury duty because they have other obligations.  (Judges, egos, and courtrooms go hand in hand... in a Judges court, nothing is a more important obligation .)

The trick is to find something that makes you biased.  Be honest and do not perjure yourself.  If you know somebody that has been tried for the same thing, let them (the court) know along with "because of my knowledge of this type of case and the way my friend who got screwed over, I don't think I can remain impartial".  Instant out.

Kinda like in the movie Trainspotting... you gotta convince them that you want the job, but you have to be careful or you might ^#$%ing get it!

If you do get chosen for jury duty, be sure and go to this website and read the Juror's Handbook.

Fully Informed Jury Association

Pay close attention to the Jury Nullification section.
