If at first you don't succeed, it's not always wise to try, try again.

James H. Day should have thought of that last year when he tried, for a second time, to thwart a court-ordered drug test by bringing a bag full of someone else's urine to McHenry County's probation department.

For a second time, Day's plot failed, this time when the bag sprung a leak as he stood in a county office June 19 waiting to be tested, sending his friend's urine spilling down his leg as a probation officer looked on.

Now the 54-year-old Woodstock man is heading to the county jail to serve a six-month sentence for unlawful defrauding of a drug and alcohol screening test.

Day admitted guilt Monday to the felony charge under a plea bargain in which he was fined $500 in addition to the jail time.

"Clearly he was not probationable," Assistant McHenry County State's Attorney Sharyl Eisenstein said.

For Day, the jail sentence is an unlikely outcome for a string of legal troubles that began on the Fourth of July 2004 when Crystal Lake police arrested him for possessing a small amount of marijuana. He pleaded guilty to a low-level misdemeanor charge about six months later as part of a deal in which he received court supervision and agreed to undergo three drug tests.

In July 2005, he was caught trying to pass off someone else's urine as his own during one of those tests, leading to a felony charge that eventually would be reduced to a misdemeanor as part of another plea bargain.

The deal, however, included at least six more drug tests. And Day, it seems, couldn't resist trying again to fool the test. After his second attempt to thwart the test failed, Day admitted he had been using marijuana again, Eisenstein said.

Day had been working in a clerical role for the McHenry County Recorder of Deeds, county human resources Director Robert Ivetic confirmed Monday. The office terminated his employment Friday, Ivetic said, because of attendance issues not directly related to Monday's court proceedings.

Day will be eligible for day-for-day credit while in jail, meaning that with good behavior he could go free in about 90 days.

and all of our friends were stoners so i asked my lil step bro who is like 8, i handed hime $5 and said pee in this bag

When I was young I didn't believe pot was addictive. Stories like this or the ones about professional athletes that lose their multi-million dollar contracts cuz they can't pass on a joint proves otherwise. :spank:

That being said, I do believe pot is harmless when used responsibly, and in many cases very beneficial. :rastamon:

No doubt it should be legalized and lives need to stop being destroyed by asinine drug laws.:sad:

Amazing, our jails and prisons are overflowing and they continue to send non-violent offenders there. Decriminalize the shit. I dont even smoke and I think if people want to they should be allowed to. It should be legal because all the government claims it does now is that it's a "gateway" drug. I swear a lot of government officials are idiots.

The gateway argument is the biggest joke in the world. MJ is no more a gateway to other drugs than playing basketball is a gateway to skydiving. Both are sports, and I'm sure some basketball players jump out of planes and probably all skydivers have shot a basket or two. But one really has very little to do with the other.

What's sad about this as well is

McHenry County IL has a WAY overpopulated jail system, they're ending up sending people with pety crimes to IL State prison, this also goes for lake county il which is where im on probation for right next door :frown:

Sure marijuana is a gateway drug. But it has nothing to do with what weed does. The gateway is the door of the dealer who sells more than just weed.

It's a gateway drug because the government chooses for it to be. If they didn't want it to be they wouldn't make you walk through the gate to get it.

IMO, we should get marijuana out of there right away- at least that way the naive won't be exposed to harder things without trying to be- while we continue discussing whether the dehumanizing and rights violations over other drugs are really worth the nothing they accomplish.

Well I think we should thank the Crystal Lake police department for such fine policing. Just think, for possessing a small amount of pot this man has been forced to pay into our system heavily. First there is bail, then lawyer fees, court fees, fines, probation costs, costs for drug tests, and ultimately, in his case, more fines AND time served. Simply excellent. Think of all that money that would have remained in the hands of the man who worked for it; used to purchase nontaxable marijuana. And he would have gotten away with it too if it wasn't for such fine sleuthing.

I think we could all agree that if it wasn't for the concerted efforts of the Crystal Lake PD, and all police departments around the country, there would be a lot of money being used by the people who earned it and not coming directly into our governmental system. Not to mention now we have a perfect excuse to spy on this man and offenders like him.

So what if we are now paying for him to be incarcerated, thats all paid for by tax payers anyway! And so what if he has to file for unemployment once he is out because he now can't find work; should have thought about that before breaking the law and taking a puff of that devil's oregano. Actually, if he hadn't broken the law then we wouldn't have made all that revenue off him, soooooooo...scratch that. Light up and pay up, hippie!

Seriously though. Other than it being really depressing that this guy is getting anal raped (metaphorically) because he liked to get high it is still kinda sad that he couldn't last through three planned drug tests without weed. Sure weed is great and all, but when the man is
breathing down your neck sometimes conciliation must be made. Then again, fuck that! What right does he have to say what someone can't take into their body. None! And anyone who says differently is an enemy of the American people and a killer of the Constitution.

He is going to be another martyr for the cause of legalizing marijuana and unfortunately being a martyr does not get you much in our society but it is helpful by displaying a problem. Just sucks that this is how it is working out for so many Americans who harmed nothing more than some of their brain cells.

I feel for the guy but he should have done some research. Trying to take someone else's piss into a drug test where you are monitored while pissing, while ballsy, seems like a pretty low percentage move for success. Especially when there are better means, remember kids:

I have been making that argument for years. People never want to believe that is the way it really works.

I seriously doubt that I would have ever tried another drug, except possibly hallucinogens had I not had to buy my weed from dealers that also had other drugs available. I was really scared of coke and opiates for a long time, however when I realized what a joke it was that MJ was illegal I decided to experiment further. I wound up with a pretty serious opiate problem and only a year ago started to put my life back together.

The bottom line is if we can't trust what they tell us, we have to figure it out for ourselves.

The blatant dishonesty of it all is what really turns my stomach.

I strongly disagree, the vast majority of people that try marijuana do not go on to try anything else. The vast majority of marijuana dealers do not sell anything other than marijuana, and the fact remains that many legal drugs are abused more than illegal drugs, and many legal/prescription drugs (DXM, pain medication, benzos) are consistent with illegal drug use. Illegal drug use will always be there, and the #s aren't going to change that much just like people won't change that much. That argument for legalization purposes is extremely flawed and really doesn't have any good data behind it. Yeah less people in Holland use hard drugs and marijuana, but its a different country and a different culture. Using them for the sake of that argument is like using Saudi Arabia for the sake of full out prohibition. I never tried any illegal drug because my dealer also had it, I sought after it and obtained it myself. People aren't that fucking stupid, its curiosity that brings people to try other drugs, not peer pressure and it sure as hell isn't because "My dealer also has smack". DARE had more to do with me trying LSD, mushrooms, and cocaine then my drug dealer did. Biggest problem with that argument though is you are obviously only advocating marijuana legalization. To argue marijuana legalization without including a full end to the drug war really weakens your argument.

I agree its inconsistant, however I think it has merit, though I don't think all the marijuana dealers will disappear if its legalized, they'll just sell hydrocodone, xanax, valium, et cet. In my experience, the soft drug dealers sold these. Elsewhere may be different.

For those who don't live in a decent sized city, w/ dealers on the corners, you don't know how to get smack, or coke, et cet. I also tried many other drugs cuz my dealer in school had them. That's not to say I didn't seek them out, but I wouldn't have found them if they weren't offered, and if all the weed dealers only sold weed, I'd likely never have found them.

Now you're correct in that these weed dealers would probably just be pill dealers if not for weed prohibition, but I do think this demonstrates that their is a third variable problem in the marijuana is a gateway theory, namely that those who get marijuana already have a source for other drugs, generally, as well as the fact that those willing to break the law and some societal norms are also more willing to try other drugs besides marijuana.

Rome wasn't built in a day. I do support the end of the drug war, but lets face the facts. An all out end to drug prohibition will never happen, at least not in one fell swoop. And there are huge differences between MJ and Hallucinogens from drugs that can be far more toxic.

MJ is less toxic than aspirin. Take a bottle of Tylenol for a head ache and it could be your last.

Unless the truth is told about drugs, the uninformed public cannot make an honest evaluation as to what type of controls if any should placed upon that substance.

It has to start with the truth. If we start with a drug that most people realize does very little long term harm we can advance the discussion to other substances that have safe medical and recreational qualities. But our society is not going to just release all of the unfairly convicted drug offenders from jail and tell the rest of us "Sorry we were wrong guys, do whatever drugs you want, go nuts." We have to start slowly and stem the tide of drug addicts to prison.

Everyone has different reasons for doing drugs, and people are exposed to them in different ways. Just because you wanted to try drugs after a police officer showed them to you doesn't mean someone else didn't get offered a line of something they new little about because their buddy said it would make them feel great, and then they wound up with a problem.

I feel like I could go on forever.

Many however do sell and use other illegal drugs, mine did. I am not trying to shirk responsibility, but if I was able to get my pot at the 7-11 I may have never been exposed to opium, or oxycontin, or coke or crack. Sure maybe I would have still sought it out, maybe not. And I realize that just because Kmart sells guns it doesn't mean that I am going to pick one up while I am Christmas shopping.

I am sure many people bought only weed from my dealer. But the cashier at Kmart never asked if I wanted to take target practice. My dealer however did ask if I wanted a "bump"
