job trouble due to criminal record
    #8097363 -

When I was 16 I stole a calculator from a kid at school because I needed one for math class. One of those TI-86 ones of course. Well I got caught and had to go to court. By the time it was my court date, I was 17, so I could be charged as an adult. So I payed the kid back and got off with one-year supervision.

The following summer I got a drinking ticket. Then, a month later a letter from the courthouse came and instructed me to come to court on a certain date. Apparently, I had violated my supervision.

So I go to court, and get a bunch of community service and a conviction on my adult record for something I fucking did when I was a minor. I mean yeah, it's totally understandable once you hear the story but on paper it looks bad no matter what. Misdemeanor Retail Theft looks bad on anyone's fucking resume. But come on, I'm fucking 20 now god damn it!

So besides the fact, I think I could be getting any job that I apply for but they always don't hire me. I think it's because I'm an honest person and always say that I have this conviction. The reason I do this is because I don't want to get fired later because they find out.

Well now this shit is getting fucking rediculous. I NEED a job and I think the main reason why I don't is because of this curse of mine. Discriminating fucks!!

So should I stop putting it on the applications and take my chances, or stay honest and hope for the best?

I don't blame you, I would probably put that stuff on my resume as well. I'm just really honest and upfront with people.

From what I've gathered, your higher end jobs most likely will come with a criminal check, but most of your hourly jobs have only a 50/50 chance of it happening.

That blows. Since it wasn't a felony, I'd omit it.

I wouldn't put that stuff down on principle.

Most jobs aren't going to run a background check unless you work in some kind of sensitive area.

I have a felony and it didn't stop me from getting work - try restaurants, they thrive on criminals

Those shouldn't matter, anyway. The way my dad always explains it (he worked with child protective, so he dealt with a lot of juvies) is that once you're 18 you essentially get a new record, and your YO (youthful offender) record is closed, and shouldn't come into play for things like jobs, at least not run of the mill jobs. I could be wrong, but if that's the case don't even put them down they shouldn't find out. Of course, I'd recommend looking into the laws before you run around taking my advice.

haha, yea. i don't know what it is about criminals and cooking, but the two seem to go together.

i got a job as a dishwasher at a very high-end restaurant and was amazed at just how shady all the cooks were there. they were putting out these $50 plates of filet mignon prepared as if by Emeril or something, but they had rap sheets a mile long.

They shouldn't matter....But they do. In my state they pull that 'adult at 17' bullshit. I mean, I should kill someone for that shit. Fuckers!!

When you go get a steak, chances are someone on probation or house arrest cooked it. You should ask for a felon to cook your food, because damn they cook well.
My best friends brother has a rap sheet a mile long, and he cooks at a nice restaurant lol.

On the serious side; I had a couple of things i did when i was 16,17, and 18. It drops off your record eventually i am thinking, because i pulled my record and it had nothing on it now. Granted i am 27 now, so it's been a while.

Anthony Bourdain employs a bunch of Mexicans. I'm pretty sure every single person in his kitchen at his restaurant is from Mexico. Probably not legal, either.

You got screwed. You should have got a better lawyer. Just because you were 17 when you were in court your crime was commited when you were a juvenile. I think that if you found a good lawyer now they could get it taken of your record. As for the job situation it does suck. I have a felony and other misc. crap on my record. When I got the job I have now I aced the interview and got a job offer letter. When I accepted the job I had to fill out an app. for their records. I listed my crimanal history and they ended up deleying my hireing for 2 weeks saying that they had to run a background check since I had a record and my job was now contingent upon what they found. I had to jump threw hoops to get that job but I had already moved over a hundred miles from home because they said I had the job. It was a stressfull 2 weeks. I ended up speaking with an attorney because I had a job offer letter and on there app. it said that they do not discriminate because of a criminal record. If I had not got the job I was going to sue the shit out of them.

I would leave it off and if it comes up, I would say that you thought that since it was originally a matter that was dismissed, it didn't apply. Then tell them the story and maybe they'll understand. At least you'd get a chance to plead your case?

Be careful, restaurants are screening more now, we had a huge lawsuit at our restaurant because they hired a manager who was a class I pedophile/rapist for sexually assaulting a 14yo and didn't do a background check on the dude until one of the girls at work looked online at that website that shows all the sexual predators around your area.

It dragged on until I was 18. (15 month period) I don't think the original prosecutor ever noted that I was a juvenile at the time of the crime. Trust me, I tried to bring it up and they didn't bite :frown:. . . Shitty system

Sorry to say your professional career is probably over forever due to these incidents, and you are WAY too old to try and start over again. I would recommend getting into drug dealing (something like crack or heroin) and stealing radios from peoples cars. Its your only shot at this point .

...you're young dude, dont worry. I wouldnt even be looking for a job if I were you, just livin life up.. also you could always go for some under the table work for a while.
