a little tip to all of you. never allow a search, even if they threaten to get sniff dogs to tear your interior open. youre protected by the fourth ammendment. they cant searh you or your car without probable cause. and i dont think smell alone is enough unless theres a bunch of smoke piling out of the window. if they continue a search without your consent then anything they find will be thrown out in court. if anyone knows how i can post vidoes that are saved on my hard drive ,i can share a really helpful video that i downloaded sometime ago that goes really indepth into all of this.

Basicly what i was going to say. Don't give up your rights!!!! even if you have nothing to hide. Think of it this way, if they had probabkly cause they would be asking for your consent!

We should make a bumper sticker that says " firm supporter of the 4rth amendment" maybe they wouldn't even ask then.

I'm curious as to how many of you have refused consent to a search, when you could, and it either worked, or didnt. I've tried a few times but they always had "probable cause"..smell usually. Such an easy one...pains in the ass, well anyway..

"I understand completely officer, you have to say that in order to establish for
the courts that you have probable cause and since you are aparently recording
this stop and search I'll again have to formaly refuse a search with out a

that cause"

I carry an ACLU card in my wallet. You can print them up on the ACLU web site. I've only used this once, and the cop gave me no shit whatsoever. Jus tell the Pig In Question that your a member of the ACLU and it's your association's policy to never consent to a search without probable cause.

Most pigs have a rabid fear/hate relationship with the ACLU and will have you on your way in no time....

Please explain more about this membership? I tried looking it up on the website and all you get is a card? Do you get any services?

Smallworld, it is a small world. I've had a cop pull out a baggie with 13 hits out of my wallet, look at it and put it back. I was pretty shaken.

You guys are ignorant bastards, well not all but alot of you. It seems most of you have yet to really encounter many cops out there. The majority of police officers have extreme ego's, they WILL break the rules, its THEIR word against YOURS and believe me, for a cop to admit fault is a miracle that would make the entire police force look bad.

Cops either like you or they dont. Do you guys really think the "court" and your "rights" are actual people out there witnessing you getting pulled over? There are never any witnesses only claimed words that were exchanged.

To the IDIOT kids out there who talk about saying "no you cant search my shit you fuckin pig" and expect to get away with it, you deserve what you get for being a MORON.

I'll tell you from experience, ive dealt with enough cops to get their general mind state down. You ALWAYS treat a cop with the respect they deserve, theyre generally great people who put their lives on the line making shit for money but get a sense of satisfaction out of it. Theyre always under alot of pressure that can easily come out on you.

They will not tolerate some punk ass kids attitude, some will beat the shit out of you without thinking twice and hit himself around then claim you attacked him.

Fuck the 4th amendment, its bullshit just like the american system. The only time you ever want to deny search is when there are 3 or more cops present as witnesses. Never deny search any other time.

If you're hauling shit around under your seat, you fuckin deserve jail. Always build air tight hidden compartments in the vehicle that are impossible to enter easily. Then let him search all he wants.

While I can't claim any personal experience, your idea not to deny a search unless 3+ cops are present seems like pretty bad advice. Say there's a single cop that wants to search your stuff: if you give him permission, he WILL do so, and if he then finds anything you're screwed. If you don't give permission, he may or may not be an ass, search anyway and say you allowed it, but there's at least a reasonable chance that he'd be honorable about it (particularly if you're respectful) and leave you alone. So combine the chance of getting off free if you deny the search and not having much to lose by doing so, I can't see why you'd suggest doing otherwise at any time.

Let me know if I'm missing something here.

Gotta agree, I would consider this to be bad advice as well.

Many cop cars have cameras and many cops carry wireless microphones these days.

Maybe I went a little overboard but i've been in situations where I was completely at the will of the cop and he let me go (drug related) all i'm saying is just remember, theyre good people who don't want to fuck your life up unless they don't like you.

Denying a search isen't necessary and causes unneeded suspicion, SECURE the cargo correctly and it doesent matter if you consent or not, they won't find anything.

by the way, trying to figure out why he let me go has fucked with my mind for some time. Maybe thats why I have a general respect/quasi-fear of cops.

Oh, and if you guys are talking about transporting a couple X pills or maybe an 8th of weed, disregard the belligerent tone of my retorts. Simply carry it around in a small water baloon and swallow it if pulled, itll be out your ass in 48 hours.

In my opinion (maybe I am wrong?) it is much better to reference legal council than to play the part of a legal expert. Something along the lines of, "I apologize officer, I know that you are only doing you job and trying to keep the public safe, but I am very late for an important business meeting. My attorney has advised me to always refuse consent to a search and to never answer questions without him present. Unless I am being detained, I would like to leave so that I can attend my meeting."

The important parts here are that you were polite, that you know your legal rights, that you refused consent to a search, and that you have refused to answer any questions without legal council present. You have shown that you are one of the few that know your rights and are therefore going to be a hard nut to crack. Unless the cop has a reason to harass you, they will move on to an easier target.

If your in a Wifebeater and shorts at 10 at night that doesnt help you though. Its all about the situation

Why should it fuck with your mind? The cops and court system aren't as corrupt as you think. To corroborate that position, read the following police experiences of me and my friends.

I have been pulled over twice, once for speeding and once for running a stop sign right in plain view of a cop on foot. Neither time did the cop even ask me to consent to a search, even though I acted nervous, and the car was full of cigarettes in plain view, and I was under 18 both times, making the cigarette possession illegal. Curiously, I only got a verbal warning from the cop who I ran a stop sign in front of, despite his heavy-handed attitude toward my "crime".

Another time, a friend of mine was pulled over and consented to a search. A few grams of weed was found and he was arrested. He went to court, insisted that the cop was lying, and that he didn't consent to a search. The evidence was suppressed, and the charges dropped.

Another friend of mine was pulled over twice and searched both times (one time was probable cause, the other time was consent), but they found nothing both times because he had the drugs on his person.

No one I know has ever been arrested for drugs in connection to a vehicle stop. Either they were arrested because they were narked on, or they were caught smoking in public. The cops around here are all bark and no bite. They draw their guns frequently and yell a lot, but if you don't cave in, they end up doing nothing.
