When they ask if they can search say NO. NEVER give consent to search your vehicle, home, or possesions, it is retarded. If you give consent to search you deserve to go to jail for a long time.
If the cops search even though you refuse permission the evidence should be excluded and you will walk. If you give consent there is no disputing the validity of the evidence and you will do time.
I would have told the porker to send for his sniffer dog. And in the case of the shroomies it would have gone undetected because canines aren't trained to sniff for mushrooms.

had an experience with nebraska's finest last summer along that very highway. pulled a friend of mine and myself over for using no turn signal (when we did). then smelt whatever he thought he smelt and tore the car apart. fortunately all he found was a little bit of personal pot and threw it out and let us go. fortunate for me, nebraska is a long way from home.

I think if you can't say no to a cop, then you shouldn't be driving with drugs on you. But to say that anyone who consents to a search deserves to go to jail for a long time is fucking stupid.You should get cancer for that.

I'm sorry guys, I kinda disagree here.
It depends on the circumstancies. So many people smoke weed, that this is the drug that I first think of when it comes to a search of a car. Lets face it, WE HAVE NO RIGHTS IN OUR AUTOMOBILES! It's not like were at home wacting tv with the police wanting to intrude. When your on the road the shit changes. For starters, and I have heard many first hand acounts, if one is pulled over all a cop needs to say to a judge is that the driver was acting suspious or stoned (no matter what is true)- This alone gives the police reason to ask to search. Futhermore when you combine this with a denial to search the cop can mearly radio the guy with the drug dog. OR, often they can mearly call the judge at home with what they consider "resemble cause" have have a search warrant faxed to the "Batmobile" in a matter of minutes.
You have very little rights on the road when it comes to illeagle search and seazer.

Jammer - Absolutely the cop can get a dog or get a warrant to search your car. BUT if you just say 'OK, search it' - they don't need to do that. MAKE THEM get the dog or get the warrant. If you give consent they are home-free from then on. BUT if you SAY NOTHING and make them do it themselves, you can later have your lawyer argue probable cause with no 'consent to search' crap blocking him in court. Remember YOUR RIGHTS and by allowing them to search you are GIVING UP YOUR RIGHTS! Do you really want to give up your rights? Just cuz they will search anyway?
Do this: (especially if illegal substances may be found)
1. Be polite (The cop really is just doing his job)
2. DO NOT argue (You really think you'll win an argument with a cop?)
3. Do NOT give a statement
4. Do NOT allow a search of your vehicle or home
5. If arrested, don't resist and see steps 1-3 and call a lawyer.
If you tell them that you do not want to make a statement and want to speak with your attorney BY LAW they must stop their interrogation. Make mental notes of any direct or implied threats. If you are underage they cannot question you without representation (parents, lawyers, etc) present. They will have to read you your rights and note that they will tell you that you have THE RIGHT to REMAIN SILENT. Notice that this is your right. By talking you are once again giving up your rights. Do you REALLY want to give up YOUR RIGHTS?
The cops only know what they observe and what you tell them. Making up lame excuses on the fly will only trip you up later in court. If you tell them nothing they will have to come to their own conclusions. And that is what your lawyer will poke holes in in court.

It's also a cops right to fuck with your head by just asking to search. I have seen on TV shows, such as COPS (Bad boys) where cops sometimes get permision to search and they didnt even bother. It's obvious that some cops play this game, and thats why so many people give them permision to do so.

... i never get pulled over in Nebraska, but every time i drive through south dakota i get fucked with. its ridiculous. last time i went through i was moving to Minnesota from colorado with all my things in the car, nothing illegal. my car was packed to the limit, so i was going 65 in a 70 zone, the cop pulled up next to me and checked me out then pulled me over. i am like what did you pull me over for? and he wouldnt anwser and searched all over my car for something he could pull me over for, then desided it was for a roserie that was hanging from the mirror. then the drug dog came, and dispite the fact that there is absolutely nothing in the car the dog claims to find something, so they take everything i own out and put it on the side of the highway in the ridiciulous SD wind, and find NOTHING, of course. and finally after 45 minutes they leave me to repack my own car that they fucked up, and act like they are letting me off easy. all of it was pure bullshit. and they can get away with it. especially in states where the admistrations are suporting that crap, no matter what your actual rights are, they do what they want. south dakota had bilboards up at that time that say "if you bring illegal drugs to south dakota, expect to stay for a long long time.. the state highway patrol."
i also get pulled over in michigan every time i am there, 5 times, for no apparent reason. i have terrible luck with run ins with the cops, dispite i still have no record. the only thing to do is just stay clean in a car. keep to the woods. damn.

man, I don't know what it is with the people on this board. I've travelled across the country through most every state, even the notorious ones, several times speeding at least 20 over the limit every time - never even came close to getting pulled over. When I have gotten pulled over in my state (3 times) it was never an issue, they said hi, wrote me a ticket, and left. When I wrecked in coming home from Chicago through Indiana (a well traveled drug route the staties never even said a word to me, just gave me a ride to the bus station). I think it might be an appearance issue.
I don't like to judge a book by its cover, but most of the time I can spot drug users, because they make it obvious. I'm not stereotyping completely, there are many exceptions, but of the users I know, I could spot most all of them if I were a cop, just by their demeanor and general appearance. No one would ever suspect that I am a user, because I don't look like one. I am pretty clean cut, don't act hard or pot-headish. I'm not saying pot-headish is a bad thing, but a dead giveaway. Not trying to be a dick or anything, but maybe you guys should try to clean up your appearance during interstate travel, whether carrying anything bad or not. Just trying to help out.
