I sent you a link of the first scientific evidence of who truly owns and controls corporations.  Relatively small (let's say less than one billion) investors have no real influence on the big Fortune 1000 companies.  The influence comes from a very small group of banks and investment groups that control the real leverage in our financial system.  Small investors typically vest their voting power in someone else ala a mutual fund and these "investors" are pushing corporations all in essentially the same direction.

Bill Gates is an extreme example of a very rare individual.  Most wealth is created through the conversion of debt into assets and, a good case could be made for Bill Gates that most of his wealth has been made the same way.  Does he know software? Sure. Did he build a very prosperous software company?  Absolutely.  Look up Cascade Investment to understand where a sizable percentage of Bill Gates wealth has come from (hint - it's not Microsoft)

Real wealth comes from gaining access to enormous pools of debt that are then converted into assets.  It's a giant scam you seem unaware of. 

I own my own company.  I am successful financially.  I am not jealous of individuals that succeed and, in fact, cheer them on.  We are talking about who controls the giant global multinationals that operate in a borderless world that are steadily purchasing the political processes of virtually every country that matters.

You are talking about GOP slogans about personal responsibility.

That's a very obvious fact to most people here, but zap's a little slow (actually, slow is an overstatement; he'll never budge on a lost position).  In fact, even after being corrected, you'll hear him repeat this nonsense in the next thread.

But how do you determine what counts as an advertising cost and what is the fair market value? For example, if a movie maker makes a politically themed movie, is that subject to limitations even if no third-party was involved? I could definitely see that movie being considered advertising in many ways.

But I will ask everyone on this post what lost position I didn't budge on?

In the example above, KauaiOrca said "a tiny, tiny fraction of humans have the ability to exert tremendous influence and control on most of the corporations that own/control virtually all of the resources on this planet".  Zappa's response was "nothing ever gets through"; there are "millions and millions of shareholders", including "pension funds", "Workers", and "regular people" who have control of the corporations.  Anyone here who is a stock owner knows that's bullshit, unless they own tens of millions of dollars in stock.

So what lost position have I not budged on?  Certainly someone can remember one?  And if you include this thread, you should note it's actually been a series of budging in response to all shortcomings found with the definition.

An  ad was defined as "any form of communication used to attempt to persuade an audience to take or continue some position."  So by that definition, political movies would likely be an ad.  If they paid to have their movie played, it's subject to the spending cap.  But if theaters paid the movie company to have it played, then it would be under the spening limit (remember, production costs don't count towards advertising costs), and there's no issue.

Fair market value comes into play so the rule can't be circumvented.  For example, if someone put a political ad on a billboard they owned, it would be costed based on what another local billboard company would charge to publish the ad.

So you just limited that persons speech also....  Your definitions are so vague and non-specific that there are countless arguments against them.  'Any communication'  ''an audience' 'some position'  I don't think you can use weasel word modifiers like that to write a law.  Based on everything you have posted for days on this topic, this Turd still sinks to the bottom of the cesspool.

First of all, if it were a single person that wanted to pay for 10,000 billboards, then his spending would be limited.  If he wanted to pool his money together with like minded people to pay for 10,000 billboards, he's free to do that.

Secondly, the goal of this thread is ideas to prevent one wealthy person from buying Congress, to help eliminate corporate cronyism.

My thoughts on this - First of all, let's go with the analogy that money is somehow speech. So, I've only got $5 to give to my favorite candidate whilst Mr. Rodney Richpig has millions to give to his candidate. So what we've got here is that I'm in the back of a very large stadium whispering whilst Mr. Richpig is in the front with a bullhorn. How is that fair? What's next? Giving someone more votes depending on how big your bank account is? I've actually heard this proposed by some Libertarians once. :facepalm:

This is exactly the situation.  For some reason, we have a bunch of people that truly think that wealth SHOULD give you a bigger voice in terms of influencing politicians in our Republic.  It's bound to happen even without the kind of campaign finance idiocy we have in place, but with the idiocy, it's full on legal to essentially buy off the political process.

The extent to which Americans will vote against their best interests never ceases to amaze me.

I reject the premise that the wealthy are having an ever greater influence on government or that the government was set up for the 'people' as you imply to be a class seperate from the wealthy.

The constitution was promulgated by rich, powerful, landed members of society and I don't see how to read it as some document granting power to the downtrodden particularly. It works well percisely because it doesn't make those distinctions, however; I doubt all the protections of possesory rights were included to protect the poor. This seems to be some fantasy history.

As for the greater influence claim, I doubt that as well. How hard is it for you to make one thousand leaflets?  How hard would it have been for someone in 1950? 1787? This fantasy of things getting worse is just self-pitying narcisim in my view. The ability to make fliers is something that was reserved for the wealthy and powerful (without laborious manual copying) a very short time ago. Further, the poor couldn't vote in years past.

How exactly are things getting worse? If anything theres a much greater diversity of opinion and much more competition in business sectors that tend to resist monopolistic power.

I think you are grossly underestimating the power and reach of global corporations.  There was nothing even remotely like that in the 1700's and, in fact, the Founders saw the money that was influencing British politics and tried to steer away from that.  Global multinationals are a form of uber government on our planet … they fund campaigns, create the PR and News and essentially employ the politicians.  If you think printing some leaflets and handing them out in a plaza gives you an equal voice with corporations that control the media, then we see the world very differently.

We have separation of church and state, we now need separation of corporation and state.

You want to give me an example of a present-day company with the wealth and political power of the Dutch East India company? It was practically a nation state on its own.

How about the South Sea Company? The Mississippi Company?

How is the present situation fundamentally different in terms of company sizes? If anything, they've gotten smaller and much less powreful. More transparency, more auditing, and more recourse for agrieved parties has been the steady trend through the years.

Nice straw man. I don't believe I addressed that one way or the other, but if I grant your conclusion as true, so what? That's not an argument against my position, simply an observation that with more money, people, and wealth you can speak to more people. So what?

A corporation is a legal entity, it is not a being that is given "rights" like freedom of speech.  It is not alive, it is a shell for liability protection.  I think it's important to keep some clarity here.

I have no problem at all with individuals speaking their minds about politics, spending their own money on their political motivations … but I favor getting corporations completely out of the process and that would include lobbies, unions, churches, PAC's and corporations giving directly to candidates. 

I favor campaign finance sunshine laws to clean out the distortions.  And favor a new law that would require every elected official to, once a year, hold a public meeting where, under oath, they take questions about campaign contributions and meetings with large donors to fully disclose what, if any, favors are being asked by large campaign contributors.

You accused me of being ignorant of the relative wealth of businesses around the time of the founding and now. I challenged that claim and I'd like to see your reply.

You've also apparently abandoned the other points I challenged. I'd appreciate a reply or concession as to those points as well.

Even if true, so what?  This is an obvious is/ought fallacy.

Further, you are simply wrong. Corporations, as legal entities, do have rights. Is your preference that the secretary who places the orders for some big corp. be legally liable herself when the company doesn't pay their debt? How do you propose to work this new legal structure without corporate rights?

Finally, what practical effect does your scheme have? Corporations, as you recognize, are legal fictions which act through natural persons. So is your only gripe, besides wishing to ban anonymous political speech apparently, that the board members should take authorship of corporate speech? Exactly what would the point of this bullshit be?
