Re: hypothetical question about Obama care [Re: imachavel]

This thought experiment is broken.

If a driver drove a car 65 mph in a parking lot and didn't flee the scene he WOULD be held responsible for causing you to jump out of the way or get hit.

Costco would ABSOLUTELY be liable for a pothole in their parking lot that, while you were evading a fatal incident, caused you such immense trauma and physical anguish.

In a country where a guy hands a woman a cup of (granted, too hot) hot coffee and she spills it on herself and her labia fuse together and she can sue McDonalds for millions, I don't see how such an incident would occur in which n either Costco or the driver are held responsible and forced to pay large settlements.

you make a good point but law suits like this happen all the time and people get shit settlements with no real compensation for a person never being able to work again in their life. A few thousand might be given away, but a guy retiring these days is basically a million. If Costco really didn't want to pay so much, they should fix ALL pot holes, they certainly can afford it. Maybe not Costco by DEFINITE example, but definitely this is a known scenario from SOME very large known retail type stores etc.

I'm sorry I think your question is very unclear. You were just talking about how we should give every single citizen in the United States free health care and now you are saying companies shouldn't compensate people for ruining their health and shouldn't be liable for it?

If I mis read your question I apologize I feel you were very un clear

I referred to your claim-culture. To us it seems its over the top. The case of the woman spilling hot coffee is well-known here and a source of ridicule.

I think mostly our take on it is this, that someone who spills coffee should have been more careful. It seems like Castaneda's 'little baby syndrome' of some sort. The woman makes a mistake and then cries out blaming others for her stupidity because she cannot accept she was stupid.

The second aspect is that we are amazed she can then sue MacDonalds for millions. Our laws do not allow for such claims at all. Now you could argue that government has no right to limit such high claims and that it is your right to claim as high as you like. That is fine by me. But it brings up point three.

The fact that suing seems to be based on little but greed. Of course there are arguments about how hot coffee should be served and if it is not wiser to have the coffee a little less hot. Still that doesn't warrant in our eyes claims of millions. It seems to me that when Macdonalds needs to pay a high claim, the price of coffee for all will go up to compensate for the loss. Maybe this unforeseen loss is part of a bad turnover that year and so someone loses their job somewhere else over it.

Anyway, speculation perhaps, but things lead to another. How we behave affects others. Maybe that is why specialists can ask so much per hour. When they screw up the liability suit will ruin them.

In our laws we have maximums for certain situations. I think recently the highest claim was paid. I believe it was over a million euro's but it isn't public information. This was the case of a wrongly convicted innocent person who spent years in jail.

There are iirc from my law classes certain amounts that are fixed. If you go in a hospital and they amputate the wrong leg there is a standard amount for it. Someone using fireworks and throws your eye out you can sue them for a maximum of... I don't know these figures.

So the whole OP's issue of stepping into a hole etc... I do know that we can sue local government if you ride your bicycle and your wheel bends because the street is broken. It is their job to keep the streets in good condition. Of course it will be filling in forms and waiting months for a response. :-)

I just think we should take some more responsibility for our own stupidity instead of cruing out and opportunistically sue for large lump summs.

I can see both sides, and I feel socialism sadly looks the same that it always has. A one sided view. Sure, many court cases are won on greed. But in reality I feel that a person has a right to want their life compensated. Is a person who burned their labia with an extra hot cup of coffee a complete idiot? Absolutely. So now they put a warning on the cup, saying "extremely hot coffee"

I don't know about this situation. But to me a person who steps into a pot hole, breaks their fucking back, fucks them self up for life, and can never work a day in their life, truly deserves compensation. If the company didn't want to be liable they should fix the damn parking lot, if they are worth tens of millions as most retailers who own extremely large parking lots are, they should be able to compensate AT Least peoples medical liability.

Which brings us back to point one, will Obama care actually take care of disabled people who need $300,000 surgery? I doubt it. Many say doctors shouldn't be able to charge that much. Well sorry, I don't control that. It's beyond the point, if they wanted to regulate the cost of surgery, they could have done so, then created Obama care. I don't believe in paying taxes for a health plan that doesn't cover shit. It's inevitable so I'll quit bitching. But you question "peoples heart of hearts" and yet, you feel that a person injured severely unable to work again in his life shouldn't be compensated? A million is too much? Do you realize the cost of medical care and retiring these days?

I think we are in agreement then. We should put some limits, for our mutual benefit, on what medical specialists can ask for their work. At the same time we need to limit the claim-culture by limiting to what extent people can make claims whilst also covering high medical costs of people as to make sure they are taken care of even if they can no longer make high claims.

This way we mitigate the need for specialists to insurance themselves against such claims, driving medical health care prices up, which, to me, seems to be burdening society as a whole out of fear for the few who misuse the claiming rights.

Deal?

Vaipen, let me ask you this:  What does McDonald's care about people's safety if claims against them are limited?

Do you think McDonald's is gonna notice a $10k payout?  The restaurant in that case was warned multiple times before and ignored it...so...what does it take to make a huge international corporation notice a problem?  The answer is clear...they notice large amounts of money being paid out.

Everyone wants to talk about tort reform, but what keeps businesses responsible if not the courts?

I still completely agree. If a hole is in a parking lot and someone injures them self in that hole, the corporation should have known better then to allow the holes to be unfixed. What better way to make sure no hole in any parking lot is ever unfixed ever again? Simple, they get the shit sued out of them for $3 million, and end up having to pay $1 million. Lesson learned. Otherwise I respect some of Vaipen's point of views

Really?  Hot water is now a hazard?  Did you know that you have to use hot water to make coffee and tea?  True story, shyster.  Maybe we should require intelligence tests to buy coffee.  Idiots and assholes increase the price of just about everything we buy.  Idiots being the injured and assholes being the people who do anything other than laugh at them.

If you want to make your own hot coffee and spill it on yourself, no problem. But last I heard, you dont need 375 degree water to make hot coffee. If you give someone coffee thats too hot, and they get 3rd degree burns, you get sued, its that simple. Perhaps mcdonalds should have had hot coffee liability  insurance, then they would have been covered, and companies like AIG wouldnt have gone broke

In an autoclave...

Nonetheless, hot water is, in fact, a health hazard.  180 degree water is way hotter than necessary to make coffee...

The lady had 3rd degree burns...spent 8 days in the hospital, and required 2 years of surgery to recover...we're not talking about someone a little miffed because they accidentally spilled some hot coffee...

If you don't like it, you can go somewhere that allows corporations to do whatever the fuck they want without having to pay for their mistakes...

I'm surprised the water was only 180 degrees. You assume because water is not boiling that it's temperature is no longer above 212 degrees. If the lid is covered it would most likely stop boiling. If heat was still applied obviously the lid would pop off from pressure but off the coffee burner it would stop boiling. Have I heard of making coffee that was boiled? Obviously not, it pours out of the filter with the coffee grinds into the pot on the burner. However, I've never made coffee at McDonald's and can't under stand how they make coffee. I've spilled boiling water on myself before and while it hurt like a son of a bitch and burned like hell I didn't get 3rd degree burns or need surgery, it didn't hurt my labia, of course I don't have one. I know you go too far above 212 and water instantly vaporizes but how could it have caused such damage she needed surgery and what not if the coffee was only 180 degrees?

Such a thing is MAJORLY CONFUSING. That is a bitch to deal with but whatever.

I must add though, that time I spilled boiling water on myself I was not wearing cotton and was DEFINITELY NOT happy about the burn and the pain. One of the worst burns ever, I stand corrected:

"Trial and verdict

The trial took place from August 8–17, 1994, before Judge Robert H. Scott.[16] During the case, Liebeck's attorneys discovered that McDonald's required franchisees to serve coffee at 180–190 °F (82–88 °C). At that temperature, the coffee would cause a third-degree burn in two to seven seconds. Stella Liebeck's attorney argued that coffee should never be served hotter than 140 °F (60 °C), and that a number of other establishments served coffee at a substantially lower temperature than McDonald's. Liebeck's lawyers presented the jury with evidence that 180 °F (82 °C) coffee like that McDonald’s served may produce third-degree burns (where skin grafting is necessary) in about 12 to 15 seconds. Lowering the temperature to 160 °F (71 °C) would increase the time for the coffee to produce such a burn to 20 seconds. (A British court later rejected this argument as scientifically false, finding that 149 °F (65 °C) liquid could cause deep tissue damage in only two seconds.[17]) Liebeck's attorneys argued that these extra seconds could provide adequate time to remove the coffee from exposed skin, thereby preventing many burns."

Also, to add on, it should be noted, that McDonald's had several warnings and several chances to actually serve coffee at lower temperatures:

"Other documents obtained from McDonald's showed that from 1982 to 1992 the company had received more than 700 reports of people burned by McDonald's coffee to varying degrees of severity, and had settled claims arising from scalding injuries for more than $500,000.[6] McDonald's quality control manager, Christopher Appleton, testified that this number of injuries was insufficient to cause the company to evaluate its practices. He argued that all foods hotter than 130 °F (54 °C) constituted a burn hazard, and that restaurants had more pressing dangers to warn about. The plaintiffs argued that Appleton conceded that McDonald's coffee would burn the mouth and throat if consumed when served.[19]"
