Well, yeah...but there's a big difference between selling a lethal item and not stopping someone else from doing it...

I don't think drug prohibition is really tied to any theory that they are lethal anyway...It is more about the societal harms caused by addiction...

In the case of weed, it's probably illegal because mainstream america thinks that all weed users look like this:

not with the media covering the medicinal clinics, and the television shows like "weeds" and all of the educational networks like Discovery covering it. or even the fact that Obama was once a smoker, or that Michael Phelps is a stoner

you'd have to be really naive to thing that the most common cannabis smoker is a hippie, in this day and age.

yeah, but you also have to factor in the huge sums of money they make from busting those small time offenders. i had to pay over a grand for simply possessing a piece of resin covered glass.



They don't profit from that...the cost to arrest, charge, and process you through the system is far more than what you paid in a fine...



i highly doubt that, i wasn't even arrested. i'm pretty sure they profited just fine off of pulling me over for a traffic stop, issuing me a ticket, and making me pay hefty court costs on top of it all.

Enlil is right.  Instead of looking at it from a "treatment" perspective, why not look at it for what it is - an issue of freedom and civil liberties?

What if there is a drug user that doesn't want to be "treated"? Should we force "sick" people to go to the doctor when they have no desire to, especially when it is paid for on the taxpayers dime?  There is also the mistaken assumption that anyone who possesses drugs is an addict.

The whole idea behind drug prohibition is that we are going to focus on prevention by 'setting an example' out of the unfortunate few who are caught, in hopes of convincing others not to go down the same path.  Treating people as necessary collateral like that is disgustingly immoral and unjust on so many levels.

And the argument that "drug addiction doesn't just hurt the user" is no more of an excuse for tyrannical laws than it is when someone says "freedom isn't free" to justify invading foreign countries and killing brown people just to acquire political leverage, land, and resources.

If you think a few drug laws equal tyranny, I can assume that you've never lived under real tyranny.

And if you think that drug addiction only hurts the users, then I suggest you go work with families that deal with addiction...Every day I see the damage that drug addiction does..

Of course not all drug users are addicts...but...you can't deny that many are...you can't deny that addiction is a huge problem in the US...and you can't deny that drug addicts create a burden on the rest of society..

Your arguments are predictable.  I never said drug addiction only hurts the user, but it depends on how you define "hurt."  By "hurt", do you mean drug use projects negative externalities onto third parties (such as robbery, theft, etc)?  Or do you mean it simply offends some people?  You do not lose your right to do something just because someone else doesn't like what you are doing, whether that be family members, politicians, or just random people whom you have no connection to that have a moral objection to what you are doing.  I do not lose my right to marry outside of my race just because it "hurts" my family emotionally.

And just because the law doesn't recognize these "ethereal" rights doesn't mean they don't exist.

And that still doesn't solve the problem of injustices towards those who are arrested for drugs and AREN'T addicts.  What if someone possesses nonaddictive substances such as mushrooms or LSD, for instance?  What is your justification for prosecuting them for their own good then?

And the biggest question of all - let's say you only have the best, benevolent intentions in mind and you only want to help addicts.  How in hell is throwing them in jail and putting a felony on their record going to help them in any way?  Please tell me that.

Adultery can hurt people too, that doesn't make it a matter for criminal law. Whether a given country's legal system qualifies as tyrannical is open for debate but I'd say having a high incarceration rate relative to other countries is probably a warning sign.

I have consistently said that drug users should not be put in jail...I don't believe that legalization is the answer either...why is that so hard to understand?

If you think that society has no interest whatsoever in keeping people from becoming addicted to substances, then that's your philosophy..one that I do not share...I believe that society benefits from productive members..and that addicted members are not productive...Disagree all you want.

In the final analysis, however, this isn't about what I think or what you think..this is about getting a majority of people to agree to change the status quo...and if you really want to see that happen, you're going to have to couch it in a way that people understand...full legalization of all drugs is simply not on the table for mainstream america.

Well, ya know not throwing people in jail for drugs generally kinda means something called "legalization", or "decriminalization", or whatever you want to call it.  Excluding sale and manafacture of drugs for the time being, it is my firm belief that people should not go to jail for using drugs.  Looks like we agree there.

Speaking of straw men, I don't fancy your assumption that I "think that society has no interest whatsoever in keeping people from becoming addicted to substances".  I will react to this in the same you did - by calling you out on it, but minus the outrage typed in All Caps.

I never said society shouldn't try to stop or help treat drug abuse.  I simply don't think that is a job for the legal system.  I don't take substance addiction as a joke or think society should turn the other cheek.

And even without jail, arresting drug users and putting them on probation, drug treatment, whatever is still going to lead to a conviction and a permanent mark on their record, which will inhibit job opportunities, follow them everywhere they go, yada yada yada...thus it's still counterproductive to "helping" addicts and is not beneficial.

At one second you are blasting off against decriminalizing small amounts of drugs, and the next second you are on my case for assuming that you think drug users should go to jail.

So if you agree that drug users should not go to jail, then what exactly are you arguing with me about.  Drugs are bad?  Yes, I agree.  Substance addiction is bad.  Drugs can be potentially dangerous.  What more is there to discuss

And this is an argument about whether drugs "should" be legalized, not about whether or not they will be (Yes, that was the original thread title and subject but it seems to have changed since then.)

Just because drug prohibition is mainstream and something that all Governments are doing doesn't make it right.

Ok...well what does Enlil think about giving criminal records to addicts who get caught?

The question of how to deal with manafacture and sale of drugs is a bit stickier but if we're strictly talking personal use, I don't know why we're arguing if we both believe personal possession should be legalized/decriminalized.

Maybe not where you live but here in HMP England half of the prisons and secure installations are run by Serco, whilst the other half by her majesty's prison service. They do that because there's money in it. As one screw put it to me (and he was a good chap. Can't remember his name. Welsh bloke)

He was an honest and compassionate human being and I enjoyed talking to him as he escorted me to my job. Being that it was the library I got to chatting with him a fair bit as it was fairly quiet most of the time, so it was a great opportunity to read.

you say "legalized/decriminalized" as if they are the same thing...

I think they should stay illegal..but not criminal..meaning no one would get a criminal record for it...I do, however, think that there should be civil options available to send people to a drug school similar to a traffic school...and for more serious addicts, there could be mandatory treatment which might be inpatient or outpatient depending on the severity of the problem..

That is a far cry from throwing people in jail and also a far cry from legalization...
