the DUI story

i had been trying to get off of heroin for a while, but unsuccessfully. i was finally clean for a month or so when this happened: i stop at a store for gas. i walk in and theres my heroin guy(not in his usual part of town). instead of asking me where i've been or something like that, he says "wassup man, don't i owe you something?" so like second nature i said "hell yeah you do." -ok first off, nobody ever reminds you that they owe you something. atleast not around here they don't. secondly, i should have been more cautious with what i did next.......hindsights 20/20 right?- so he gives me a (big)bag and a spike, and i drive to a spot where i can get myself set up. by the way, this guy has always had the cleanest smack i've ever had. no cooking or any of that shit. completely cold water soluble. so anywho, i do the bag and sit there for a few minutes. everythings great as usual.-heres where things go horribly wrong- i make the dumbass decision to drive. so i'm headed up the road (8-10 minutes later) when i start blacking out and losing control of motor functions. i remember a flash of seeing cars stopped at a red light. obviously i hit the gas instead of the brake, because the next thing i remember is swerving out of their way. next (i was told later) i clipped the front of an EMT truck which caused me to hit a retaining wall in front of someones house (and ripped the front passenger wheel off of my truck as well) totaling my ride. no one got hurt (luckily), but i did make the evening news. after sitting at the hospital in handcuffs for about 5 hours, they take me to jail. after sitting in jail for a week, my arraignment comes up. my lawyer asks for a change of venue(the judge is well known for making an example out of people like me) because the DA says i will get 6 months at state, no questions asked. so my lawyer gets me out of jail and says he'll call me when he's got a new court date. after 2 months of getting nowhere with the court date my lawyer tells me that the jail has lost my file (i heard alot of people complaining about their files being lost too, while i was locked up). so 4 months after being bailed out, my file hasn't surfaced. my lawyer says he's gonna file a motion to dismiss the case, which sounds great if it works out, but i'm not counting on it. if it does happen, it could take months. everything is super slow at this place.

heres what i need some advice on: with the way that fucked up jail is run, i really don't know where i stand. i haven't received any notification of my license being suspended (should be a 6 month suspension for DUI drugs). so what i'm wondering is, do you guys think i can just go and get a replacement drivers license even though legally i'm still in limbo?

ya dude i got a dui and the faggot cops TOOK my license
so i didnt even have an ID
i had to go 2 teh DMV and get a replacement
thats wut u gotta do
thats crazy that ur H dealer not only initiated the IOU but gave u dank shiz

Most people I know don't get their license suspended until after the conviction. How can they take your license away before they prove you did it?

I would say go to the local mvd and give it a shot. The worst they can do is tell you that it is suspended. Or you could ask your lawyer.

yeah i know i gotta get a replacement, but i don't know if its under suspension. i've been taken to jail twice in the past while trying to get a license reinstated, because of a suprise FTA. yeah twice. i guess thats whats got me worried. i can't afford to be locked up again.

yeah i realise that coaster. what concers me is the possibility of having an FTA waiting for me. with as dirty and corupt as that police force is, its very possible. and i have no way of finding out right now. i guess i'll just have to suck it up and go up there. no guts no glory, right?

thats a damn shame.

Ive been through the dui case shit before, and I came out ahead after found not guilty by a jury.

but if the file got lost, you have a good chance of getting it dismissed. Get on your lawyers ass about filing the motion to dismiss ASAP.

what state are you in if i may ask?

my lawyers already on it but it takes forever to get anything done at that place(it took 6 hours for me to be processed and released after being bailed out). they don't even answer the phones. everything has to be done in person. and i'm in bama.
