What kind of snake is this?

The person who found it said it was able to stand p about 6 inches off the ground to raise it's head, can a gater snake do that?

Neg, definitely not a rat snake. It's a garter. It's dirty and it is about to shed. It would have the stripe all the way if it was clean and had recently shed. You can see the line starting at the head.

I think it's a red-spotted garter snake. Definitely some kind of garter.
