Re: Family sues friends of alcohol OD 'victim' [Re: OrgoneConclusion]

While the choice to drink to excess was clearly hers, it is likely that state law in her jurisdiction prohibits serving alcohol to anyone who is "visibly intoxicated." The bartender would have been required to attend alcohol server's training in order to receive his/her server's license, and been informed of the laws regarding service to intoxicated persons.

Though state laws vary, it is likely that the bartender violated state liquor laws by continuing to serve her after she was visibly intoxicated. He/she was probably fined by the state liquor commission, and the family will be able to include this as evidence of civil liability.

Legally, the friends would not be liable for her death. Ethically, encouraging someone to drink once they have CLEARLY consumed an excess of alcohol is questionable. Certainly, they used poor judgment in participating in that situation.

We can't really be certain the specifics of the situation to determine that they exercised poor judgement. She could have sucked down five shots when they were all in the bathroom and playing pool. Without knowing exactly what occured regarding that, we can't really determine the nature of their judgement.

It is difficult to believe that the birthday girl could have consumed SEVENTEEN shots without at least one of her party guests noticing.

For the record, I only slept with one seriously drunk girl that I barely knew - and she seduced me! (I was drunk as well.) Damn her! :mad2:

It's shit that her parents are suing her friends who are already probably fucked up enough about it, but its also pretty fucking lame that not one of her friends called her a cab and cut her off before she managed to drink that fucking much. Taking care of friends is important. I'm sure most of us has had at least one night of drinking too much and either blacking out (not me) or requiring a friend to call the cab and put you in it (my last birthday, ugh.) It's nice when friends watch out for each other because it's easy to get carried away without realising it sometimes.

I wonder how many more of these incidents there would be if they legal drinking age was 18:shocked:

You mean less?

Look at the binge-drinking stats for countries where the legal drinking age is around 16-18. I think you'll find that making it illegal until you're 21 increases problems like this.

Unless that's what you meant and were being sarcastic?

What makes you think there would actually be any notable difference?

This was NOT her first time drinking, by the way. She previously had problems with alcohol and had 2 DUI's on her record.
