So the RIAA just lost a lawsuit in Oregon for their practices, but I had a thought. Say they wanted to prosecute you for downloading some songs, if you went out and bought the CD's they could no longer prosecute you then right?

edit: Heres the link http://www.theregister.co.uk/2008/01/17/tanya_andersen_riaa_attorneys_fees/

^^ I think it really depends on what you do with those mp3's. If you sold them, I don't think buying the CD can stop them from prosecuting you.

If you are sharing the files that is what will get you in trouble!

I download MP3's all the time and have never been concerned about getting caught.
RIAA is more after the servers which offer the MP3's rather than individuals getting a song here and there.

I still agree, however, that the DMCA is bullshit and should be discarded. :nonono:

There's a chance that you could cut a deal after the fact that you agree to pay the equivalent in CD costs, then they might not prosecute.

So how does LimeWire and the users of it stay in business?

Trust me if they had enough time and lawyers to go after everyone sharing they would. Plus the fact that Limewire is supposed to be used for sharing uncopyrighted material. Using limewire to share copyrighted material is technically a violation of there TOS.

If you want to download in anonymity read into NNTP and the usenet. Since you are technically not sharing you run less of a risk of getting a nasty letter in the mail.
