And what is... is we have technology which enables ripping, streaming, file sharing, etc. and there's really nothing the RIAA can do about it in the long run (big picture).
Yes, targeting random citizens for settlement money is an option, but how exactly does that fix the underlying problem?
It's a never-ending battle that can't be won.
Sooooo I dunno, maybe it's time for them to sit down at the round table and come up with a new business model or product line, one which can actually compete in the market place.


I agree with this.  RIAA needs to keep up with technology and maybe build some sort of gimmick into video and audio files that prevents them from being pirated or shared without authorization.

As for Enlil's argument that the $50,000 fine was not only just, but could've been more, I'm really sorry but I strongly disagree with that.

Your example of Bill Gates being issued a "price tag" to punch you in the nose is a faulty premise for your argument.  If you say the punishments are meant to be deterrents, then $50,000 should be much more than enough to make this woman never pirate anything ever again, assuming she doesn't get massive income.

I know if I got a $20,000 fine for stealing 24 songs, I would never do it again.  If I got a $5,000 fine I would never do it again.  We're not all Bill Gates with plenty of money to blow to download stuff illegally or punch someone in the nose and just pay the fine for it and do it again.

software companies do this frequently and on the day of release it's always
cracked and in usenet the next day, from there it makes it's rounds to other
sources, keep in mind that each time a security feature is added anyone
buying a game is paying for it, the game that cost you $30 last year is $40
in it's new release because of the copy protection

True.  That might also be why it usually costs a dollar to download a song.  Maybe if people didn't pirate it so much then it would be cheaper.  But it's all speculation.  Even if people stopped pirating who knows, the market might decide to be a dick and keep the prices the same or barely lower them at all.  And with the amount of music I listen to I would end up spending thousands, if not tens of thousands, of dollars on all my songs.

Don't get me wrong, I don't illegally download but I do listen to a lot of stuff on Youtube that I don't pay for.

What the judge did was within the law of the land.  The administration filed a brief in favor of the RIAA's position as part of the appeal process.  They're absolutely within the law to do that too, but the decision to do that is entirely at their discretion and it is blatant string-pulling.  It's POTUS pushing its weight around for the benefit of those who have money to spend on lobbyists or other political connections.

Admittedly, I would not be outraged if the RIAA were sued given that I don't feel the same sort of sympathy for a corporation that I do for a fellow human.  But in this hypothetical situation I would be in favor of reducing an "outrageous" fine (which would have to be in the tens of billions of dollars to be on the same level, given how much this woman probably makes vs. how much the recording industry makes) on the recording industry down to a more reasonable, but still crime-discouraging level (say, a couple hundred million).


I'm late back into the discussion so I think everything I had to say's been said, but I do want to say that these huge fines are probably not very effective at "making an example" out of people.  $1.5 million dollars is simply too huge an amount for the average person to comprehend.  It's the same reason people won't quit smoking to reduce their risk of death by lung cancer but will pull together the willpower to diet 5 pounds off in order to not look fat.
