jails are the suck, i have been jailed overnigh several times in my youth and also been to prison. and its better to be in jail than in a police cell at their station. there is nothing worse than people that steals your freedom for no good reason. but if there is a good reason, im all for locking you up. i mostly have sit in jail for hashish. anyways, there is nothing like a huge ass bong hit after a night in jail

Sorry for not replying...spent the last day and a half sleepin. I live in College Station, Tx and the cops here are goin crazy. They are now going into bars to arrest people for PI, and they will pull you over for just about anything.
What happened was, I was leaving a party where I only had two beers, so I was the best to drive. A friend of mine had managed to pour beer all over himself at the party so he reaked. On the way home I had to go thru a big intersection...the light had just turned yellow when I entered the intersection and was red when I got out. 5-0 followed me and pulled me over little bit later.
So when he walked up he immediatly smelled alcohol which was comin from my friend. So he told he smelled it and for me to get outta the truck. FUCK. I am underage by the way. I do a sobriety test and I know I passed it cause 1) I was acing all the tests...one of them I had to stand on one foot and hold the other one out at 45 degrees and count. I was barefoot, standing on an incline and still held it there for almost a minute. 2)At each test he kept getting upset because he couldn't find a test for me to fail.
Anyways he asked if I had been drinking, and I said I wouldn't answer that. Asked me for a breathalizer test and I refused. So he charged me with a DUI and running a red light. Now since they don't have proof that I had alcohol in my system..will I be able to get out of this?

I don't know what Texas law is like but in my state if you refuse a breathalyzer you immediately get your license taken away for a year....doesn't matter if you had a drink or not.

TX cops suck, i had moved there in my teens years, the morning i got there me and my friends ( who drove with me from In to Tx) decided to check out the neighborhood and burn one before they head back to indy.. a cop zoned in on us sitting an a small walkway over a drainage ditch.. he drove his harley right throught the walkaway ( had inches clearance on either side ) luckily we had timke to ditch the roach without him noticing.
this same cop HAUNTED me the entire 4 months i lived in Tx

He is underage. If anything registered on the breathalyzer, which it would according to his story, he would have gotten a DUI anyways - and they would have more evidence against him.

I was underage...zero tolerance for alcohol. Either way they were gonna take my license. Also I'm lookin over all the information and it looks like I can do some defensive driving and some community service to wipe the slate clean.

Yeah, my buddy got off pretty good on his first dui.. He did like 30 hours comm service and paid 600 in fines. Plus, his liscense was gone for a year. This same dumbass got 3 dui's before his 21st birthday. I hope you make better decisions than he did. He now had his liscense REVOKED and is facing jail time at 22.

yeah, in FLA it says right on your license that when you sign the papers to get it, you automatically give consent to any sobriety test. If you refuse it means that you admit guilt, or you at least breached the contract with the state...
