It's a good lesson either way: Don't say shit without a lawyer. Either they've got you, or they don't. Lying on the spot can cause more problems than it solves. If they're trying to get a confession out of you, they're going to ask for some specifics that you aren't going to be able to keep constant down the line.

On another note, I'm not sure how likely it is that a small town got lab results so quickly, and getting the stuff back so soon. I've heard in some cases it takes a very long time. Long enough that if all the product is fresh, it'll be spoiled by the time the tests are taken. It sounds like perhaps the fruits were visually identified as legal, common mushrooms. The purple spores weren't even considered.

They charged me with manufacturing in Virginia. YES!!! the worst of all states.

They had casings with myc (but no shrooms)
and shrooms in sealed ziplog bags.

They a Martha with 2 humidifiers? everything?

Only because they didn?t have shrooms growing in a casing, but MAINLY BECAUSE OF THE SMALL QUANTITY OF SHROOMS THEY FOUND (according to the $ 15.000 lawyer mommy and daddy bought for me) they couldn?t get manufacturing. What counts is how much drugs you had. No drugs, a joke. They just wanted to fuck with you, scare you, you will never hear from then again.

They took tons of JARS FILLED WITH SPORES. On the forensic analysis of these jars says: No Controlled Substance Found. They don?t even know what a spore is I think.

When they basted me and confiscated my entire room, I said "I want a lawyer" and the detective said "In the moment you say that I can?t ask you incriminating question". So Use that pal. Don?t speak. Say ?I want a lawyer? as many times as the number of questions they ask. Some detectives are very smart. They fuck up your mind. Don?t let them manipulate you.

Any way. They don?t have anything illegal. They are not going to even analyze the spores. You probably never going to hear from them again. They don?t have a case.

The original poster's problem happened over a year and a half ago. And it worked out fine, I think he doesn't need any advice. :smile:

Anyway, how is Virgina the worst state? Everyone makes this claim, but some sure as hell seem worse. Texas seems god awful to get caught in... so do a few others. In fact, in your story, you got off pretty easy. Some prosecutors would push a lot harder than those guys did, and some detectives wouldn't say, "Oh no, you're asking for a lawyer. That means I can't ask any incrimnating questions! Sigh, you've beaten me at my own game. :frown:"

Sounds like you got off quite easily, for any state's standards.

I haven?t got off yet. They offered simple possession of mushrooms and we didn?t accept, cause is a felony. We expect to get simple possession of marihuana which is a misdemeanor (yes, you can do that), and a disposition 251 (if you know what that is). Why I will succeed? Because the lawyer is a trial lawyer, his famous and well known, he will take the case to trial if necessary and that is too expensive for the state.

Regarding how tough Virginia is. I was not accurate on this, it was a light comment. Three lawyers have told me Virginia is one of the worst, along with Texas (you are right on that). By law, for manufacturing of mushroom I CANT get less than 5 years. Manufactory of Shrooms and heroin in Virginia are the same thing. My lawyer read that to me several times. The data I?m giving you is no bullshit; I haven?t told you anything I don?t know from a fact. Also, the ambassador from my country said that to me (I?m not American).

You are very wrong if you use the term ?easily? on my case. I was held without a bond because I was a risk of flight (again, I?m not American) until I got a lawyer and offer to surrender my passport to the court. That cost me 15 days in jail. The lab report took more than 6 month to be ready. The judge null process the case on the second preliminary court for the delay, and after that the detective went crazy, he was so pissed off, wouldn?t believe his face!! He convinced the prosecutor that they re issue warrants and I had to turn my self in. It was a friendly procedure, pre agreed with my lawyer. I was release without bond this time, immediately.

Any way, I expect the information I give to be useful for someone. I know when all this happened to me I read all the post regarding the issue. The first thing that crosses your mind when something like this happens is ?what the fuck do I do!!?.

I?m an exchange student, not an experienced offender.

The key here is you had nothing illegal at the time of the search,so think of it like this mr.x informs the police you are growing mushrooms the cops go to a local judge and say what?your honor we have ONE man tell us that "magic mushrooms" are being cultivated at this location.well folks it just is not that simple they must provide some sort of evidence i.e an affidavit pictures or...a fist hand report from a law enforcement officer that he observed this taking place.did you see the warrant?well now if what you say is the entire story the local cops really want this to go away,why you ask?the judge signed the warrant on the evidence the police provided him now he along with the judge would look bad if all this came out and with no illegal contraband taken they all look pretty stupid.use it and p.s make them give you back you LEGAL property
