Supremes to hear "hallucinogenic tea" case

They just took a medical pot case a couple weeks ago too that focused on medical rights. Now they took this case which focuses on religious rights. They are in a position to finally do the right thing and stand up for the constitutional rights of people to medical, and religious freedom. And after the whole Terri Shavio thing with the legislature attempting to interfere with the judiciary, the high court being recently attacked by the senate majority leader, and the judiciary being "under siege" by the other two branches basically lately, I'm hoping they decide to go against the grain and break the fucking stranglehold on drugs just to say "Fuck you", and re-assert their authority..

Remember they already banned infra-red heat signature searches without a warrant and handed some growers in Oregon their lives back a couple of years or so ago too, So I'm hoping for a 3 for 3 when they rule on these cases. They don't take cases unless they think there is something which needs to be constitutionally addressed, they all have lifetime appointments and need not rule to protect their jobs, and they're all pissed off too, which I believe is the single most important fact to consider here.

It just seems almost too good to be true that within weeks of being asaulted by the Bush administration and their congress, in an obvious attempt to manipulate and subvert the authority of the judiciary to make it's own rulings, by passing a special law pertaining to a certain case, changing the rules for judicial review in order to specifically usurp the authority of the Florida court's rulings in the case.

So, the federal courts which were all of a sudden handed the case courtesy of Bush and his congress, rightfully decline to take the case, noting the authority of the Florida court. The supremes decline to hear the case, making Bush and his congress look like the utter fools (which they indeed are). For causing a national uproar passing a bunch of crazy laws which end up being impotent.

So senate majority leader DeLay attacks the supreme court on T.V.,specifically Anthony Kennedy, calling the fact that Anthony Kennedy does research on the internet "outrageous", as if the internet is some sort of immoral, inane place Americans should avoid., and the court has made no public reaction or statement.

So, I find it strangely significant that all of a sudden immediately following all of this, the court decides to hear two drug-related cases, one regarding medical marijuanna and medical rights of patients, and the other regarding a church's religious rights to use an illegal substance in their sacrament.

Perhaps this is where the court will issue it's response to the recent attempt to attack the very foundations of judicial integrity, by restoring religious and medical freedom to the U.S.

Would you please explain to me why you think it's a good idea to allow an unelected and nonaccountable gang of nine jurists to have authority over the duly elected legislature. In reference to T. Schiavo the legislators had enacted a law that gave the spouse precedence over the parents in such decisions. Then these asshole parents wanted to make a federal case out of losing. A lot of legislators didn't like the results of the law they had previously passed, for whatever reason (i.e. bullshit grandstanding), so they tried to change the law. That is their purview. The purview of the judiciary is to interpret and apply the laws that Congress enacts. Questions of constitutionality are for the Supreme Court. The legislature and the voters can change the constitution if they wish. This is not an oligarchy as you seem to wish.

Nevertheless, fuck the law. I was merely stating that for once, even through the sheer blunderings of politics as it turns on itself, freedom-seeking substance users such as you and I might win a reprieve as a part of their own inner struggles. Stranger things have happened before, and it feels right to me that it might happen now.

Nevertheless, that gang of 9 jurists are unaccountable for a good reason, this lets them exercise sound judgements without fear of losing their jobs because they make a politically unpopular decision. In essence, this actually protects us from the president riding off into the sunset with the congress like John Wayne, which he's been trying to do. Naughty Bush  tsk, tsk. :nonono:

edit: this also protects from one political party assuming total control of the United States, because they can vote their concious without fear of being removed from office, which is what has Bush and the gang all upsetted. The poor Republican bastards.  :crying:

the SCOTUS will almost certainly rule in favour of bush..or else they would have dismissed the case and allowed the lower court ruling to stand...EDIT ..the UDV church might do better to simply drop their case and allow federal raids to continue..there would at least be no formal ruling banning ayahuasca..and the legality would be determined casewise...

or else they wanted to specifically rule against him in this particular case, as well as in the medical MJ case. The reasons which they would possibly do this are stated above.

time will see what their decisions are, a ruling in favor of just one of those would mean a gigantic fissure in the straglehold against drugs in general, and could very well occiliscate into the crumbling down of the U.S. drug laws which are laws against nature, as well as against general common sense, and therefore apt to crumble anyway.
