Gonzales to Replace Ashcroft
    #3341145 -

Gonzales, who would be the first Hispanic attorney general if confirmed by the Senate, would replace John Ashcroft (search).

"I would not rule out an announcement today," said White House spokesman Scott McClellan.

Ashcroft and Commerce Secretary Don Evans (search) formally resigned from office on Tuesday, handing in letters that suggested Bush will have a prosperous second term but that they are too tired to continue with him.

Word had floated last week that Ashcroft was planning on leaving the Justice Department (search). In fact, the attorney general handed in his five-page, handwritten resignation to the president on Election Day.

In it, Ashcroft said he had never been more honored than to work for the president, but his time to retire had come.

"The objective of securing the safety of Americans from crime and terror has been achieved. The rule of law has been strengthened and upheld in the courts. Yet, I believe that the Department of Justice would be well served by new leadership and fresh inspiration," Ashcroft wrote in the letter he scripted himself, aides said, to prevent any leaks.

I don't know much about him really. I've been searching for more info about him for about an hour though.

Anybody else have any ideas on what kind of guy he is?

From the article:
Quote:
It is uncertain whether Gonzales, 49, will have more affection from Democrats. He is expected to face the same criticism as Ashcroft for trying to develop a balance between civil liberties and waging the War on Terror.

Gonzales has been at the forefront of developing White House policy about detaining terror suspects for extended periods without access to lawyers or courts. He wrote the February 2002 memo that allowed Bush to claim the right to waive international treaties when it comes to prisoners of war who do not represent other countries. Human rights groups criticized the memo, which they said gave way for abuses like that in the Abu Ghraib (search) prison scandal.

"He has to have the confidence of the country and there's a lot of questions he needs to answer as far as I am concerned before he has my support. But those are legitimate questions that are a part of the confirmation process," Sen. Carl Levin, D-Mich, told FOX News. "I think he's going to make it ... the question I thought is whether I am going to support him and that's going to depend on whether or not he can satisy me as one senator that he will be objective, that he will be fair, that he will defend the law of the land that is the Constitution."

Gonzales may also face questions from conservatives about his core social beliefs. As attorney general, Gonzales would be responsible for elucidating U.S. policies on such issues as abortion and assisted suicide, among others.

In addition, some administration officials say that the choice of Gonzales is a "concern" to them because the Justice Department should have some independence from the White House, and Gonzales is "weak" and "controlled" by the White House.

They also point out that individuals at the White House are being questioned in the grand jury probe over the leak of CIA employee Valerie Plame's (search) name. They question the propriety of having someone from the White House head the Justice Department when the Justice Department is responsible for a probe that is looking into whether someone at the White House committed any wrongdoing.

Alberto R. Gonzales, the second of eight children, grew up in a two-bedroom house in Houston, and rose to become one of President Bush's closest advisers, who has followed him from the Texas statehouse to the White House.

If, as expected, Bush names him to succeed John Ashcroft, he would become the first Hispanic attorney general.

Gonzales served in Bush's administration when the president was governor of Texas, and was named White House counsel in January 2001.

Being considered to replace Ashcroft raised the profile of one of the most prominent Hispanics in the administration ? a man whose name has often been put forward as a likely Supreme Court nominee, if there is an opening during Bush's time in office.

Gonzales, 49, was born in San Antonio and attended public schools in Texas. He served in the Air Force from 1973 to 1975, then attended the U.S. Air Force Academy from 1975 to 1977.

After his military service, he attended Rice University, graduating in 1979, and received his law degree from Harvard University Law School in 1982.

In private practice, Gonzales joined the law firm of Vinson & Elkins in Houston in 1982, and eventually was named a partner in the firm.

As governor, Bush brought Gonzales into his administration in 1994 as a senior adviser to the governor, chief elections officer, and the governor's lead liaison on Mexican and border issues.

Gonzales was named Texas' secretary of state in December 1997 and served until January 1999, when he was appointed to the Texas Supreme Court. He was a justice until January 2001, when Bush invited him to join his administration in Washington.

His term as White House counsel was not without controversy, as he fought with Congress to keep the details of Vice President Dick Cheney's energy commission meetings secret and defended the administration's right to detain terrorism suspects indefinitely without formal charges and to deny them access to counsel or to protection from the court system.

Perhaps even more controversial was the February 2002 memo he wrote in which the Bush administration claimed that the Geneva Conventions did not apply to certain prisoners taken in the wars in Iraq and Afghanistan.

The memo claimed that the importance of gaining information about possible future terror attacks from people suspected of links to terrorist groups "renders obsolete Geneva's strict limitations on questioning of enemy prisoners."
