Sometimes the lawyer tells you to plead not guilty at first to work out a better deal for you and you'll end up pleading guilty at a later date.
Either way, quit driving drunk. It's not just your life who is at risk. An innocent person could die or get injured for life.
yep took a breathalyzer and a urine test. failed all field sobriety tests.
i know driving drunk is bad. it is not a habit. it was literally a one time situation and that first time happened to also result in my first (and last) dui. i am seeking legal advice. i already am well aware of the faults of my actions
Just to say this - I would always refuse ALL field tests. The only test you have to take, is the breathalyzer at the station, or a blood draw/urine at a hospital.
Field tests are engineered to not be passed. The nystagmus test (eye test), is impossible to "prove" or they would record your facial outputs with a camera, and have something to "compare" it to.
Standing on one leg, and counting to 30? You will always second guess yourself that you are too fast, or too slow, and try to add a few beats in the moment, your in a highly vulnerable area when the test is performed, and can't possibly get this exactly right 99.9% of the time. Your out of a comfortable environment, lights, loud talking, being directed by an authority figure - and you can't hit 30 seconds. 29, and you've failed. 31, you've failed. Your "one-onethousand" trick, won't work.
The alphabet backwards? Unless you practice this, your going to fuck up when you get about 9-10 letters back, because your going to try to reverse engineer the song, which can't work, again - under a hypersensitive environment.
I just want to tell you, and others - don't take the field sobriety tests. YOU WILL FAIL, especially if you say "I couldn't do that, even if I was sober" - aka: YOU ARE INTOX'd. You can't win.
The "fact" test, is a blood draw, UA, or breathalyzer. Please don't get the police more ammunition to use against you, because THEY WILL USE IT ALL. And I would recommend "trying" a higher end portable before you think you are OK to drive - because the problem is, you are ALREADY intox'd after a drink (yes, despite what you say, and you can drink 3 and drive because your 290lbs) that ONE DRINK, flips a switch in your brain to tell you that you are "most likely" ok, and your not "drunk". Can you drink a beer and get behind the wheel? Sure, but if you hit someone and kill them, you are still in a world of shit. Can you drink 9 and get home safely? More than likely, if you are not a rook - you can. It is just stupid, when you can get a Uber, Lyft, or FREE rides from the bar (they have to legally). They might not want to, but they will. Hell, I'd bet you a hundo, if you even called the POLICE, they would help you get home ONCE.
One amazing thing I learned, which I have used so many times - I have AAA (or any towing company). When I used to drink, I would get fucked up, and not want to leave my sports car at the strip club, or bar, and I would just get it towed home, with me in the cab of the tow truck - and say it was having engine/ECU problems. The drivers don't care, they are getting flat rate paid. Obviously, you can only do this so many times, and they CAN cancel you. But I would do it twice a year during a certain 6 month event back then. It sure beats leaving your car if you have a nice car.
Now, I am 1 MILLION percent against drug/drink driving. Don't get on the roads I'm on, while your intox'd. Everyone should be able to alter their mindset how they chose, so long as they are not driving a weapon, or hurting people.
