Commenting on the ongoing kerfuffle between the Cupertino giant and the U.S. government, in which Apple refuses to help the FBI unlock an iPhone belonging to one of the San Bernardino shooters, Snowden called one of FBI's claims "horseshit."

Talking via video stream at the Common Cause’s Blueprint for a Great Democracy conference, which takes place in Washington, D.C., March 8-9, the NSA whistleblower mentioned the ongoing FBI vs. Apple case as a good example of a method to protect your data from government's reach that actually works. He then goes on to dispute one of FBI's key claims in the case.

“The FBI says Apple has the exclusive technical means to get into this phone," said Snowden. “Respectfully, that’s horseshit.”

You can hear Snowden's comments for yourself, if you can endure the poor audio quality, in the video below (at 30:05).

Snowden later commented on Twitter as well, providing one example of why he thinks the FBI's claim is incorrect. It's an article by ACLU Technology Fellow Daniel Kahn Gillmor, arguing that the FBI can easily defeat the iPhone's auto-erase feature.

One of FBI's claims is that it cannot test passcodes on the iPhone as it could trigger Apple's auto-erase protection mechanism, which erases all the data on the phone after a number of failed passcode attempts. Gillmor, however, claims (and Snowden agrees) that the FBI could relatively easily desolder the flash memory chip from the iPhone's motherboard, copy its data and then later replace it in case the auto-erase feature kicks in.

We've seen other, more or less technically feasible proposals on how the FBI could defeat the iPhone's security without Apple's help. Most experts seem to agree that it's possible, but very difficult.

Snowden is the last in line of prominent figures in the IT community expressing their views on the legal battle between the FBI and Apple. Facebook CEO Mark Zuckerberg and Google CEO Sundar Pichai, sided with Apple, as did Apple co-founder Steve Wozniak, who recently called the entire case "lame."

Yeah I'd have to agree. They would just unlock it and we would know nothing of it. On the other hand maybe they're using this terror attack as a tool to get companies to cooperate. Basically to take away some more privacy and find a way around encryption.

Let me explain something to you.  You have a right to privacy until a judge issues a warrant under the doctrine of probable cause.  They can knock down your door and go through everything you own including personal papers and diaries.  If a judge grants a warrant they can put a tracking device on your car.  They can wiretap your phone.  If a judge grants a warrant they can go through your phone records, bank accounts, credit card info, whatever they want.  Why these asshoels are drawing a line here is beyond me and I think they should be held in contempt.

I don't think so - they need a terrorism case with a locked phone to set a precedent that gets them into phones in other cases.  If they asked Apple to unlock a drug dealers phone and Apple refused and the court sided with Apple, it would set a legal precedent that would be bad for the FBI.

I seriously doubt Apple will prevail for the reasons I stated..  Please tell me what the difference is.

Apple designed a system that can not be cracked.  It's perfectly legal to do that.  The only thing is that they control the software updates, so they can make a malicious update. 

If the government prevails here, phone manufacturers could make phones that can not update, and then they can't be cracked and there is nothing the government could do.

Strong encryption is legal on first amendment grounds.  Computer code is a form of speech.  You can say whatever you want, and you can code whatever you want.  There is no requirement that you make your code weak so the government can break it.

It does.  The freedom to whisper in someones ear is a human right.  Just because they may be far away doesn't change that.

The freedom to write any computer program you want is guaranteed by the first amendment. 

If encryption was banned in one country, people would just use strong encryption coded somewhere else.  There are many people worldwide that write free software that implements strong encryption that would take current supercomputers thousands of years to crack.

They can try, but very strong encryption is widely available and very easy to use.  If you commit crimes, it would be very foolish not to use it.  There are plenty of strong encryption apps that people can use, so even if they crack a phone it wouldn't do them any good.

They'd have to do it the old fashioned way then, boo hoo :rolleyes:

Free and private speech is a right you are granted in this country, they can not take that away from you. It doesn't matter if it's just a conversation, or if it's phone messaging, encyrption, etc.

If you have physical access to the device and enough time, you can crack it. Electronic re-wiring is one of the best ways to do that, though I'm sure there is a way to prevent that... And I'm sure Apple has made it difficult to access the data even with the chip de-soldered.

I'm siding with Snowden on this one.

I met a young electronic engineer who made a cracker out of curiousity. It essentially did what Snowden talks about, it was a board that you could wire to an iPhone to unlock the data. This worked for the original iPhone, he said that after that he could not get in, for one reason or another. With enough work though I'm sure the gov could.

It is perfectly legal for them to employ lip readers and giant receivers to eavesdrop on even the tiniest whisper as long as they have a warrant.  Nobody is talking about banning encryption.  This is about following the law in regards to warrants for searches which have had the force of law since the founding.  Only unreasonable search is forbidden.  There is nothing unreasonable about the government's request.  Nothing at all.

I think you have a very flawed understanding of the first amendment.  There most certainly is speech that will get you thrown in jail.

If the victim wanted her crime to be solvable, she would have used a phone with crappy encryption.  She chose a phone with strong encryption, and that is her right.


Strong encryption does cause some criminals to not get caught.  That is the price of free speech.  The alternative is much worse - if the government can crack encryption, then all you have to do to break into anything is to hack the government.  All governments are very easy to hack.

The only way to ensure that the government can crack into your phone is to ban encryption.

Well, we'll see how those forms of encryption hold up to a quantum computer... there will be a 5~ or more year gap I'm assuming where a few quantum computers crush standard encryption wherever they want before the technology and programming ideas become prevalent enough for there to be the hardware and encryption to deal with it.
